Abstract

Perjanjian elektronik dalam layanan pemesanan tiket melalui aplikasi Access by KAI menimbulkan hubungan hukum yang mengikat antara pelaku usaha dan konsumen. Salah satu layanan tambahan yang ditawarkan adalah Jaminan Refund 100%, yaitu layanan yang memberikan jaminan pengembalian dana sebesar 100% sesuai dengan syarat dan ketentuan yang berlaku. Namun, dalam pelaksanaannya, konsumen hanya menerima pengembalian dana sebesar 75% pada tahap awal, sedangkan sisa dana sebesar 25% harus diperoleh melalui mekanisme klaim terpisah kepada Qoala sebagai pihak ketiga. Kondisi tersebut menimbulkan persoalan mengenai kesesuaian pelaksanaan prestasi dengan manfaat layanan yang diperjanjikan, transparansi informasi mengenai mekanisme pengembalian dana, serta tanggung jawab hukum pelaku usaha terhadap konsumen. Penelitian ini bertujuan untuk menganalisis pemotongan dana pada layanan Jaminan Refund 100% berdasarkan Kitab Undang-Undang Hukum Perdata (KUHPerdata) serta menganalisis bentuk tanggung jawab PT Kereta Api Indonesia (Persero) berdasarkan Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen. Penelitian ini menggunakan metode hukum normatif dengan spesifikasi deskriptif-analitis. Data yang digunakan berupa data sekunder yang terdiri atas bahan hukum primer, sekunder, dan tersier yang diperoleh melalui studi kepustakaan serta dianalisis secara kualitatif. Hasil penelitian menunjukkan bahwa pemberian pengembalian dana sebesar 75% pada tahap awal dan kewajiban melakukan klaim tambahan untuk memperoleh sisa dana sebesar 25% dapat dikualifikasikan sebagai wanprestasi dalam bentuk melaksanakan prestasi tetapi tidak sebagaimana mestinya apabila mekanisme tersebut tidak sesuai dengan informasi dan ketentuan yang telah diperjanjikan. Berdasarkan Undang-Undang Perlindungan Konsumen, PT Kereta Api Indonesia (Persero) bertanggung jawab memberikan pemenuhan kekurangan dana atau kompensasi atas kerugian konsumen serta menyampaikan informasi yang benar, jelas, jujur, dan transparan mengenai mekanisme pengembalian dana dan keterlibatan pihak ketiga dalam layanan Jaminan Refund 100%.

Abstract

The alleged leakage of customers' personal data at Bank Syariah Indonesia (BSI) resulting from the LockBit 3.0 ransomware attack in 2023 has raised serious concerns regarding the protection of personal data in the digital banking sector. This incident demonstrates that digital transformation in banking services not only enhances service efficiency but also increases the risk of personal data security breaches. This study aims to analyze the legal protection of customers' personal data at Bank Syariah Indonesia based on Law Number 27 of 2022 concerning Personal Data Protection and to examine BSI's legal liability for the alleged personal data breach. This research employs a normative legal research method using statutory and conceptual approaches. Legal materials were collected through library research, including legislation, legal textbooks, scholarly journal articles, and other relevant legal documents. The findings indicate that the protection of customers' personal data in the banking sector is regulated under the Personal Data Protection Law, the Banking Law, the Islamic Banking Law, and regulations governing the financial services sector. The alleged data breach at BSI indicates a potential failure to fulfill the obligations of a data controller in safeguarding personal data and providing notification to data subjects. BSI's accountability measures were primarily implemented through the restoration of banking services and the strengthening of cybersecurity systems. However, transparency in notifying affected customers has not yet been fully optimized.

Abstract

Interfaith marriage in Indonesia continues to generate legal uncertainty because of the complex relationship between the Marriage Law, the Population Administration Law, constitutional interpretation, and judicial practice. This study examines the development of legal certainty and judicial uniformity following Constitutional Court Decision Number 24/PUU-XX/2022 and Supreme Court Circular Letter Number 2 of 2023. The research employs a normative legal method using statutory, case, conceptual, historical, and comparative approaches. Primary legal materials include the 1945 Constitution of the Republic of Indonesia, the Marriage Law, the Population Administration Law, relevant Constitutional Court decisions, and Supreme Court Circular Letter Number 2 of 2023. The findings show that Constitutional Court Decision Number 24/PUU-XX/2022 reaffirmed the constitutional position of religious law in determining marital validity, while Supreme Court Circular Letter Number 2 of 2023 strengthened consistency in judicial practice by directing judges not to grant applications for the registration of interfaith marriages. These developments have increased predictability and judicial uniformity, but they have not completely eliminated normative tensions concerning marital validity, administrative registration, judicial authority, and constitutional protection. The study therefore finds that the current legal framework has strengthened formal legal certainty, while substantive legal certainty still depends on greater coherence among statutory provisions, judicial interpretation, and administrative implementation. The study contributes to the legal discourse by distinguishing substantive legal certainty from judicial uniformity in the regulation of interfaith marriage in Indonesia.
