Abstract

This study analyzes the judge's considerations in determining criminal liability in cases of assault resulting in death. The focus of the study is to examine the aspects that form the basis for the judge's considerations in determining the element of guilt, proof of intent, and application of criminal sanctions. This study uses a normative legal method with a statute approach and a case approach. Primary data were obtained from court decisions related to assault cases resulting in death at the Medan District Court for the 2020-2023 period, while secondary data came from laws and regulations, books, legal journals, and related literature. The results of the study show that in determining criminal liability, judges consider several crucial aspects: (1) proof of the element of intent in acts of assault which is different from intent in premeditated murder, (2) the causal relationship between the act of assault and the victim's death, (3) aggravating and mitigating factors, and (4) aspects of justice, legal certainty, and benefit in the application of sanctions. The study also found variations in the application of criminal sanctions, with the average sentence handed down ranging from 7-12 years in prison, depending on the severity of the abuse and other accompanying factors. The theoretical implications of this study contribute to the development of the doctrine of criminal liability in cases of abuse resulting in death, while its practical implications provide a reference for judges in considering the elements of criminal liability in similar cases.

Abstract

Penyalahgunaan dan peredaran narkotika merupakan permasalahan serius yang menjadi ancaman bagi Negera Indonesia dari tahun ke tahun. Penelitian ini bertujuan menganalisis ketentuan hukum, pembuktian unsur pidana, dan bentuk pertanggungjawaban pidana terhadap pelaku tindak pidana Narkotika Golongan I sebagai perantara jual beli. Penelitian ini menggunakan metode hukum normatif (yuridis normatif). yang berfokus pada kajian peraturan Undang-Undang Nomor 35 Tahun 2009 tentang Narkotika dan Putusan Pengadilan Negeri Mandailing Natal Nomor 27/Pid.Sus/2025/PN Mdl, buku-buku, maupun karya tulis para ahli hukum. Ketentuan hukum dalam UU Narkotika menetapkan sanksi pidana yang berat, bagi pelaku yang berperan sebagai perantara dalam jual beli Narkotika Golongan I, yang dijerat dengan Pasal 114 Ayat (1). Studi kasus menunjukkan Terdakwa Edi Afrizal Als Edi Bin Aslan terbukti secara sah dan meyakinkan melakukan tindak pidana "menjadi perantara dalam jual beli Narkotika Golongan I". Semua unsur tindak pidana terpenuhi karena Terdakwa bertindak secara sadar dan sengaja dan tidak memiliki alasan pembenar atau pemaaf. Majelis Hakim menjatuhkan pidana penjara selama 9 (sembilan) tahun dan denda Rp1.000.000.000,00. Penjatuhan pidana yang cukup berat ini sudah tepat,serta menjadi wujud ketegasan aparat penegak hukum dan diharapkan memberikan efek jera bagi pelaku dan masyarakat dalam menanggulangi kejahatan narkotika.

Abstract

This study examines the effectiveness of fulfilling the rights to healthcare services and adequate food provision at the Class IIA Pancur Batu Correctional Institution amid the regulatory transition during the 2024–2025 period. Employing a juridical-empirical research method with statutory, case, and comparative approaches, the study analyzes the harmonization between the mandates of Law Number 22 of 2022 and Minister of Immigration and Corrections Regulation Number 1 of 2025 and the State’s fiscal capacity. The findings reveal a disparity between normative expectations (das Sollen) and operational realities (das Sein). Although prison management demonstrates procedural compliance through the implementation of Standard Operating Procedures (SOPs), food security innovations, and financial digitalization, the substantive effectiveness of service delivery remains constrained by structural barriers. These obstacles include budget limitations under the Standard Input Costs (SBM), food price volatility, and demographic pressures resulting from overcrowding, which heighten health risks. A comparison with the Nelson Mandela Rules confirms gaps in meeting the standards of wholesome food quality and the principle of equivalence of care in healthcare provision. Accordingly, institutional strengthening strategies are required, including budget rationalization, optimization of telemedicine services, and integration of prison healthcare into the national social security system to ensure the protection of inmates’ fundamental rights.

Abstract

This research is motivated by the convergence of digital technology disruption, which gave birth to the phenomenon of “Uberization of Drug Trafficking,” and the national criminal law reform through the enactment of Law Number 1 of 2023 concerning the Criminal Code (National Criminal Code). This study aims to analyze the dynamics of narcotics trafficking crimes through mass media ranging from the surface web to the darknet within the new legal framework, as well as to identify potential impunity gaps due to the regulatory transition period. The research method used is normative juridical with statutory, conceptual, and comparative approaches, sourced from secondary data. The results indicate that the shift in the penal paradigm of the National Criminal Code from retributive to rehabilitative and restorative provides a sharp differentiation in handling between abusers and syndicates. However, the revocation of certain lex specialis provisions in the Narcotics Law potentially creates a legal vacuum (rechtsvacuum) regarding electronic transaction offenses if not anticipated with progressive legal interpretation, particularly through the construction of “intermediary tools” and corporate criminal liability. The complexity of modus operandi utilizing end-to-end encryption and cryptocurrency demands a reorientation of law enforcement strategies from conventional approaches towards a Smart Power approach that integrates digital forensics, Artificial Intelligence (AI), and solid international cooperation.

Abstract

Law enforcement against children as perpetrators of sexual abuse often faces a dilemma between the principles of child protection and restorative justice. This study aims to analyze the legal application of restorative justice in cases involving children who commit sexual abuse in Indonesia, focusing on Law No. 11 of 2012 concerning the juvenile criminal justice system and Law No. 35 of 2014 concerning child protection. The approach used is normative legal analysis of legislation, court decisions, interviews, and literature studies. The results show that restorative justice can be an effective alternative to reduce stigmatization and support the rehabilitation of child perpetrators, but its implementation is still hampered by a lack of coordination between institutions, such as the police, prosecutors, and child protection agencies, as well as minimal victim participation in the mediation process. The restorative justice perspective offers a holistic approach that prioritizes the restoration of social relationships, the prevention of recidivism, and children's rights, but requires regulatory strengthening to ensure balance with the rights of victims.

Abstract

In the Indonesian Criminal Code (KUHP), assault is classified as a criminal act directed against a person’s body, causing pain, injury, or impairment of health. Article 351 paragraph (2) KUHP regulates assault resulting in serious injury, punishable by imprisonment for up to five years. Any person who suffers pain, injury, or physical loss as a result of such conduct is regarded as a victim and is entitled to legal protection. Legal protection for victims of assault resulting in serious injury is essential to ensure the fulfilment of their rights, to provide a sense of security, and to guarantee adequate support, including proper legal assistance. This study is a normative juridical legal research which aims to examine the criminal law provisions and forms of legal protection for victims of assault resulting in serious injury, by focusing on statutory regulations, legal principles, and relevant legal doctrines. The method of analysis used is deductive reasoning, with data collected through library research on legislation, legal literature, and court decisions. The results of the study show that the Public Prosecutor charged the defendant primarily under Article 351 paragraph (2) KUHP, and the panel of judges in its decision accepted the primary charge, imposed a term of imprisonment on the defendant, and ordered the defendant to compensate the victim’s medical expenses. This decision reflects that law enforcement is directed not only at punishing the offender, but also at accommodating the protection and recovery of victims of assault resulting in serious injury.
