Abstract

The happening of “Syariah” Funding Committee had to be pushed by transactional agreement to the variety of products. It was done to avoid imitating products that had been created by conventional funding committee. Inovation of product by this commitee was also hoped that it could throw away negative opinion among society that could say that this committee just gave”Syariah” label to a specific product which was already in public market. Therefore, this study was done to push or to interest people to reexplore some other agreements that mostly could be found in classic fiqh hollybook.

Abstract

Minangkaubaunese has believed the importance of  land for centuries. Rules concerning with  land within the life of Minangkabaunese traditionally can be said to be genuine community. Lands, as they believe, is basically a symbol of their own identity which is called ulayat. Furthermore, land is one of the institutional elements of matrilineal system which determines individual and communal integrity, and original and migrant residents to base any decision dealing with succeeding the right of particular region. According to rules, land are not to be sold or used for as a warranty the purpose of making loans. The influence of Muhammdiyah toward Minangkabau has colored the pattern and offered new model of the management of ulayat from succeeding communal to organizational communal by keeping the tradition concerning with the status of waqf  and prohibition to be sold and diminished. All land assets, therefore, are in the control of business division of Muhammadiyah.Keywords:

Abstract

In matrilineal system of Minangkabau, women gain strategic position. Beside the central line of generation, females also act as ‘bundo kanduang’ who have the right to inherit the tribal heritage from the ancestors and have the authority for the tribal land (tanah ulayat). This position needs to be reconsidered in terms of implementation whether it is still relevant to the principles suggested by the genuine tradition since the concept of inheriting the heritage last forever. The Islamic law (syarak) referred by the tradition points out that the women’s position in the doctrine of fiqh (Islamic jurisprudence) should be respected and has equal rights to men in respect to land ownership and authority.

Abstract

Minangkabau, with all of its aspects, has attracted academician to conduct researches about it. In terms of wealth, this tribe has a great detailed concepts. Comprehensive descriptions upon wealth center around the systems of kinship, power, and land ownership which is known as suku, sako  and  pusako. Social value of wealth is realized through communal wealth ownership. The authority of wealth is socialized by presenting tribal address to other people through the concept of sasongko. This wealth is supposed to inherit from generation to generation by means of communal authority system. However, some external systems, such as Islam, have given fundamental change which is considered too intervening. Consequently, the community cannot fully accept the change but, in other hand, do not want to reject it.
