Abstract

Sumberejo Village is a village located in Sine sub-district, Ngawi Regency. Which is in a mountainous area. Dusun Ngasem itself has many assets in terms of community or social group, nature, knowledge, culture, physical, financial, personal. Interestingly, Ngasem Hamlet has several assets that are different from other hamlets in Sumberejo Village. The assets owned are the community assets of the bamboo booth craftsman group, the business of making bamboo booths is the community's livelihood. The method used is ABCD (Asset-Based Community Development) which prioritizes the utilization of existing assets and potentials around the community, namely the booth craftsman group. Based on the explanation of the ABCD approach, the skills improvement of the craftsmen and the addition of cubicle craftsmen in the strategy of running the business are obtained. With the progress of the business that can help the community in family life such as work, income / income, education.

Abstract

Along with the number of dealers standing in Ponorogo district. In this context, MPM Ponorogo dealers provide various facilities and conveniences to the community, so that this convenience makes the lower middle class interested in owning a motorcycle with purchases on credit or cash. In this case, the purchase of a motorcycle with an indent system is in great demand by the public because of the easy indent requirements by paying a down payment of less than 1,000,000 can already carry a motorcycle. The purpose of this study is to find out how the legal consequences of agreements with the indent system. The research method used is to use qualitative methods, using descriptive analysis methods. The legal consequences in the practice of buying and selling motorcycles with an indent system are contained in article 1338 of the Civil Code paragraphs (1), (2), (3), while the seller's obligation in delivering goods to the buyer is contained in article 1417 of the Civil Code. And for the validity of data in the practice of buying and selling motorcycles with an indent system, it has also been regulated in article 1320 of the Civil Code, which is one of the conditions for the validity of the agreement.

Abstract

Along with technological advances, it has a full impact on changes in civilizational lifestyles. Humans seem to be required to live in an instant world. Even cruelly, humans are served with various conveniences to achieve every desire they have without having to know about the meaning of social life. In this 5.0 era, Tiktok Shop is present as one of the days of technology organizationwith the sophistication of various features to make it easier for everyone to achieve their wants and needs efficiently and effectively. However, it is not uncommon to find cases that bring a ratan to every circle. Such as fraud committed to objects of interest because transactions are carried out in cyberspace. With phenomenal research methods and descriptive research on these problems, researchers conducted a study on the validity of buying and selling contracts on one of the Tiktok Shop platforms based on Islamic law. The results of this study show that in Islamic sharia, the buying and selling contract on the Tiktok Shop platform is valid because it can fulfill the pillars in the buying and selling contract. However, the level of validity does not guarantee the security of business transactions on the platform.

Abstract

Control of the pawned coconut object over the damaged plants around the pawned object. The pawnbroker demands compensation for the damage to his plants around the pawned coconut tree. The purpose of this study is to examine how the control of the parties who carry out plant pawn transactions is exercised and how the legal responsibility is when damage occurs to the plants around the collateral object. This type of research is in the form of field research in the Lima Kaum Batusangkar area of ​​Indonesia. This study is descriptive qualitative with a case study approach. Primary sources from both parties who carry out the coconut tree pawn agreement. Secondary sources from the local community. Data collection techniques through in-depth interviews and observations. Analysis techniques with qualitative descriptive analysis. Findings from the field show that the pawnbroker still has power over the land where the coconut grows and plants young plants in the form of cayenne pepper around the area, while the pawn recipient also has power over the coconut fruit that has been pawned to him. This study concludes that compensation for damaged plants cannot be justified according to Custom, because the cayenne pepper plants prevent the pawn recipient from taking the fruit, in line with the pawn recipient's power, which includes the boundaries of the coconut tree land attached to immovable objects (land). According to Islamic jurisprudence, this is a naqish (limited time) property right, only one of which is owned (material or benefit).

Abstract

In determining Al-Ujrah (wages) amount in Indonesia, the current approach focuses on meeting the minimum physical requirements rather than ensuring a satisfactory standard of living based on fundamental human needs. In the context of Islamic beliefs, Afzalurrahman had addresses similar topics as mentioned in this research. In reality, the disparity in wage representation remains far from the desired equality set by Indonesian law. According to Islahi's reference to Ibn Taimiyah, fair or equal wages are wages that are determined solely by market demand and supply factors, without any involvement from the government. Economists and Islamic economic thinkers view wages as a crucial concept in economic activities. In this situation, the primary emphasis is on the principles of fairness in providing Al-Ujrah, as elaborated in the Al-Qur`an. Afzalur Rahman advocates for the idea of Ujrah Al-Mitsli, highlighting the significance of offering fair wages that uphold principles of justice rather than exploiting workers. The research employed a literature review using a qualitative method. The findings of this study support what was stated by religious figures in Al-Islah who advocate for equal and fair wages that are determined solely by the laws of supply and demand in the market, without any interference from the government

Abstract

Sharia financial inclusion has significant urgency in economic and social development, especially in countries with a majority Muslim population. Small traders often face difficulties in obtaining financing to support and sustain the growth of their businesses. This descriptive qualitative research, employing an ethnographic approach, aims to document and explore Sharia financial inclusion initiatives carried out by Baitul Mal wa Tamwil Mandiri Mandiri Berkah Sejahtera Sharia (BMT MBS Sharia) in support of the sustainability of small trader businesses. Data collection techniques are through observation, interviews, and documentation. Data analysis involved data reduction, data presentation, and drawing conclusions. The results of the research show: 1) the implementation of financial inclusion carried out by BMT MBS Sharia by providing easy savings transactions with sharia contracts, implementing a pick-up system with a Jagongan communication pattern, giving direct prizes without drawing lots, and adjusting to the trading times of partners who use the Krempyeng market system in Javanese calendar market days,  2) BMT MBS Sharia adopts local cultural values because they are more acceptable and easy to adapt to the conditions of market traders, and 3) the impact of inclusion carried out by BMT MBS Sharia is that as many as 863 small traders from 15 traditional markets are disciplined in saving, no again trapped by loan sharks,  and has a priority to get a financing program from BMT MBS Sharia, and can set aside to share. In this way, the existence of BMT MBS Shariah, a micro-Shariah financial institution, can help small traders survive.
