Abstract

Sintang district’s regional government has issued its decree no. 57 year 2018 about the proposed land opening ceremony for people in sintang district. Such policies restrict the rights of local people and their generation to burn-through what has always been done according to local policy values. The study used the normativejuridical approach method, conducted to identify and analyze in detail the restriction of traditional field farmers’ rights in land opening by burning that had been set in the 57th year 2018 regents’ rule and the local farmer’s traditional field wisdom in clearing by burning. Studies show that in article 6 of the 57th year 2018 regaining rule, regulatory the traditional farmers’ rights to perform land clearing by burning. The complex requirements of the conditional provisions made it difficult for traditional farmers to carry out the traditional traditions passed down in the indigenous dayak community in sintang district.

Abstract

This study was conducted with the aim of knowing and analyzing how the supervision of construction work by Commitment Making Officials towards bridge construction service providers and what factors were an obstacle for CMO to supervise construction service providers in the construction work of the Imat river bridge construction in Melawi Regency. By using normative juridical research methods, it can be concluded that first, CMO has carried out supervision, but it is not optimal because the construction of the Imat river bridge was completed beyond the specified time or not on time as stated in the contract and SPMK. For delays, construction service providers are subject to a late fine of 1/1000 (one per thousand) of 777,337,000, and payment delays are made until the work is completed. Second, for the convenience of CMO in carrying out supervision at the planning stage, a Letter of Agreement/Contract, SPMK (order to start work) and work planning related to ordinary embankment and stone installation on the Imat river bridge have been made which are used as guidelines for supervision of work. However, there are internal and external factors that hinder the implementation of supervision as planned. Internal factors are the limited number of supervisors and quite a number of construction projects/works that must be supervised by supervisors in 2019. Meanwhile, external factors are the condition of damaged roads as accessibility to the monitoring location, and project/construction work locations that are far from the PUPR office.Keywords: Supervision, Construction Service Users, Construction Service Providers.

Abstract

Penelitian ini bertujuan untuk mengetahui harmonisasi hukum dalam pembentukan peraturan daerah, faktor penyebab disharmonisasi dan upaya penanggulangannya. Jenis pendekatan yang digunakan adalah yuridis normatif. Berdasarkan hasil penelitian, keberadaan harmonisasi hukum dalam pembentukan peraturan daerah saat ini belum memadai apabila dilihat dari konstruksi pengaturan, tolok ukur, tahapan/prosedur, dan subyek pengharmonisasian Raperda. Selain itu faktor penyebab disharmonisasi hukum dalam pembentukan peraturan daerah dapat muncul dari internal dan eksternal lembaga pembentuk peraturan daerah sehingga dibutuhkan upaya penanggulangan secara internal dan eksternal pula. Solusi yang dapat ditempuh adalah dengan membentuk regulasi yang baku dan eksplisit mengatur harmonisasi hukum dalam pembentukan peraturan daerah.

Abstract

Conversion of kerosene to gas has a positive impact, because switching from kitchen fuel to gas or LPG causes an increase in demand for 3 kg LPG for households or small and medium enterprises. The magnitude of demand, has an impact on the emergence of 3 Kg LPG gas bases that sell gas directly to consumers. However, the base has responsibility in preventing the circulation of 3 kg broken / leaked LPG tubes before being sold to consumer consumers. The purpose of this study is to find out and examine the implementation of Article 8 of Act Number 8 of 1999 concerning Consumer Protection in an effort to prevent the circulation of LPG 3 gas cylinders kg was damaged / leaked by Pangkalan in Pinoh City of Melawi Regency and to find out the efforts made by the base in preventing the circulation of damaged / leaked 3 kg LPG gas cylinders to consumers in Pinoh Kota. The results of the study revealed that the implementation of Article 8 of Act Number 8 of 1999 concerning Consumer Protection in an effort to prevent the circulation of damaged / leaked 3 Kg LPG gas cylinders by Pangkalan in Pinoh Kota Melawi Regency was properly implemented and in line with the mandate of the law. . It is evident from the absence of consumers who have bought or exchanged tubes in damaged / leaky conditions, meaning that the protection of consumers using 3 kg LPG in Pinoh City Melawi Regency has been carried out by the LPG 3 Kg base properly and responsibly. Thus, the 3 Kg LPG base has tried to prevent the circulation of damaged / leaked 3 kg LPG gas cylinders before arriving at consumers in Pinoh, Melawi Regency. This is evidenced by the examination effort every time there is a distribution of tubes from agents to the base before being marketed at the consumer level, the findings of damaged / leaked tubes are stored in special storage warehouses and not sold to consumers with the intention of providing security and safety for consumers user of 3 kg LPG in Pinoh, Melawi Regency. Abstract

Pedagang Kaki Lima (PKL) merupakan pedagang yang menjajakan dagangan dengan menggunakan gerobak, di tepi jalan-jalan umum, trotoar, dan di depan toko. Pemerintah Kabupaten Sintang telah mengeluarkan kebijakan berupa Perda Nomor 9 Tahun 2011 tentang Penataan Pedagang Kaki Lima di Kabupaten Sintang yang didalamnya terdapat larangan melakukan kegiatan usaha pada tempat di luar lokasi yang telah ditetapkan. Masalah pokok yang akan diselidiki dalam penelitian ini adalah “Bagaimanakah Efektivitas Peraturan Daerah Kabupaten Sintang Nomor 9 Tahun 2011 tentang Penataan Pedagang Kaki Lima Di Kabupaten Sintang terhadap ketertiban pedagang kaki lima di Jalan Pattimura Pasar Inpres Sintang?” Tujuan penelitian ini yaitu untuk mendapatkan informasi yang mendalam dan obyektif mengenai Efektifitas penerapan Peraturan Daerah Kabupaten Sintang Nomor 9 Tahun 2011 tentang Penataan Pedagang Kaki Lima Di Kabupaten Sintang. Metode penelitian yang digunakan adalah metode Deskriptif dengan pendekatan kualitatif, penelitian ini berusaha untuk mengeksplorasi secara mendalam mengenai Efektivitas penerapan Peraturan Daerah Kabupaten Sintang Nomor 9 Tahun 2011 tentang Penataan Pedagang Kaki Lima Di Kabupaten Sintang.Hasil penelitian ini diketahui bahwa Perda Nomor 9 Tahun 2011 tentang Penataan Pedagang Kaki Lima di Kabupaten Sintang belum berlaku secara efektif dalam dalam penataan Pedagang Kaki Lima di Jalan Pattimura Pasar Inpres Sintang, hal tersebut disebabkan oleh beberapa faktor yaitu : pedagang kaki lima yang umumnya memiliki keterbatasan modal, pedagang tidak mengetahui ketentuan larangan pada Perda No. 9 Tahun 2011 tentang Penataan Pedagang Kaki Lima Di Kabupaten Sintang, Pemerintah Daerah tidak melakukan sosialisasi terhadap Masyarakat perihal Perda No.9 tahun 2011 dan Petugas tidak tegas melakukan penertiban secara Permanen. Untuk memberlakukan efektivitas Perda No. 9 Tahun 2011, Pemerintah hendaknya memberikan penindakan tegas secara permanen kepada pedagang kaki lima yang berada di Jalan Pattimura Pasar Inpres Sintang.

Abstract

In the context of regional expansion, Article 4 (paragraph 3) of Act. Number 32 of 2004 about Regional Government give assurance that the possibility of the formation of a merger of several local or regional sections of biting or expansion of an area into two regions or more. By referring to Act. No. 32 of 2004 and the procedure refers to Government Regulation Number 129 of 2000 about Formation Conditional and Criteria for Expansion, Elimination and Regional Merger, the administration proposed splitting of the Province of West Kalimantan Kapuas Raya with the formation of the Province are complete and are qualified conditions of administrative, technical and physical territoriality. By the Governor of West Kalimantan, give information to the Commission II Advisory Council of the Republic of Indonesia. As suggested in the current domain and the Central Government Advisory Council of the Republic of Indonesia came to pass repeal of Government Regulation Number 129 of 2000 which has been used as a guideline proposed for establishing the Province of Kapuas Raya and replaced by Government Regulation Number 78 of 2007 on Procedures for Formation, Elimination and Region Merging. Cancellation of Government Regulation Number 129 of 2000, has implications for certainty of law (legality) the completeness of the proposed administrative division of West Kalimantan Province. With the Government Regulation Number 129 of 2000 jo. Government Regulation Number 78 of 2007 then, needs to be done in a normative study of the Act. 32 of 2004 by Government Regulation Number 129 of 2000 and Government Regulation Number 78 of 2007. Based on the result of analysis the problems examined, it is known that the proposed of the Province of West Kalimantan Kapuas Raya based on existing provisions in the Government Regulation Number 129 of 2000. While the enactment of Government Regulation Number 78 of 2007 automatically revoke the previous government regulation and no longer valid, because the Argumentum contrario Government Regulation Number 78 of 2007 Concerning Formation, Elimination and Regional Merger may not be used against the events referred to regulations occurred prior to the otherwise applicable government regulation. Based on the results the Government recommended, given the division of the Province of West Kalimantan province with the establishment of Kapuas Raya domain was already in the Central Government to get the draft Law Kapuas Raya Province Formation of Advisory Council of the Republic of Indonesia, the final step until now realized yet, in expect for the entire Local Government and Regional Representatives Council of the District Sintang, Sanggau, Sekadau, Melawi and Kapuas Hulu regency or provincial government more intensive approach the House of Representatives Commission II of the Republic of Indonesia and the Minister of Foreign Affair.

Abstract

The purpose of this research is to study the application of the principles of good environmental governance by the Sintang District government in environmental protection and management. This research is a normative research. Data collection tools consist of document studies and library studies. The document study was carried out by examining the Sintang District Regulations on protection and the environment. The focus of this research is the application of seven principles of good environmental management according to Belbase, namely: Rule of law; Participation and Representation; Access to information; Transparency and accountability; Decentralization; Institutions and institutions; and access to justice. Data analysis was performed with qualitative analysis and described in a descriptive analytical form. The results of the study show that: 1) Legal regulations consisting of two Regional Regulations and one Sintang Regent Regulation have provided legal certainty for the Sintang Regency regional government in good environmental management, highly determined and designed by the government related to the environmental sector (environment which good) government); 2) Participation and Representation in Environmental Protection and Management that are carried out properly based on community interests; 3) Access to information through the principle of providing information to the public that is transparent and complete is given to before the EIA activities are carried out; 4) Transparency and accountability by providing information for communities and communities to access information about development planning and implementation; 5) Decentralization of government affairs in the field of Environment; 6) Institutions and implementing institutions for regional autonomy in the field of Environment are the Sintang District Environmental Agency; and 7) Access to justice, that is, all Sintang District people without exception can feel the same justice in the use of the environment. Undeniably at this time. These seven principles have been applied by the Sintang District Government in accordance with what is mandated in Law Number 32 of 2009 concerning Environmental Protection and Management. However, at the implementation level there is still a lot to be done which is the principle of good environmental management that has not been able to run optimally regulated in regional regulations and regent regulations. Abstract

Village Original Income (PADes) for Sungai Seria Village is obtained from village assets. Village assets owned by the Sungai Seria Village Government are in the form of Village Treasury Land handed over by the Village Government to PT. Dhanista Surya Nusantara for oil palm plantations. On this land, the village government through village regulations no. 1 of 2020 concerning Management of Sungai Village Cash Land, stipulates a rental price for 200 hectares of land, resulting in PADes since 2020. Management of village assets is an important concern for the village government, because good management of village assets has an impact on increasing PADes. This study aims to find out how the Village Original Income is managed which is sourced from the results of village treasury land rental fees by the Sungai Seria Village Government. This study uses an empirical juridical approach, with descriptive data analysis, to determine the sample used purposive sampling technique. Data collection techniques through interviews, observation and documentation.The results showed that the Sungai Seria Village Government was able to take advantage of village assets in the form of village assets, namely village treasury land that had been handedover by the Village Government together with the community to be turned into oil palm plantations by PT. Dhanista Surya Nusantara. For this land, the village government sets a rental price, the payment of which is from the remaining results of the company’s operations through the Aboh Kitai oil palm smallholders cooperative from 2020 until now. The management of PADes from the rental price of the village treasury land has been carried out by the village government based on Minister of Home Affairs Regulation Number 20 of 2018 and Sintang Regent Regulation Number 22 of 2017, but the management has not been entirely to optimize the development and development of village communities.

Abstract

Analyze the authority of local governments in maintaining forest cover in forest areas that are not owned by the state or APL as life support from deforestation due to forest conversion into business areas. Looking at the considerations for determining the 10 areas with the Decree of the Sintang Regent in the APL, shows that APL has an essential function as a community environment. Therefore, forests and biodiversity in APL must be managed by prioritizing the function of environmental protection. This research is normative, with data collection techniques carried out by library researchers. The results of the study show that the Sintang Regency Government is given the authority to manage APL in its administrative area based on the Decree of the Minister of Forestry Number SK.733/Menhut-II/2014 concerning Forest Areas and Marine Conservation in West Kalimantan Province. Abstract

The border area is the front porch for a country that represents the development of the country. This study aims to identify the potential of local village agriculture that supports family economic strengthening, analyze the economic value of local village potential, formulate a strategy development of Nanga Bayan village. This research was conducted in Nanga Bayan Village, Ketungau Hulu District, Sintang Regency, West Kalimantan Province, in April-September 2023. This research used triangulation method and data are collected through semi-structured interviews, FGDs, and observations. The data were analyzed using descriptive qualitative analysis. SWOT analysis used to formulate the development strategy of Indonesia-Malaysia’s border area. The results showed that the local potential in Nanga Bayan Village as a border area are local agricultural products based on traditional fields, local fruit; traditional weaving and clean water sources. The economic commodities of the people in Nanga Bayan Village are attracting Malaysian. However, transactions that occur are not through official cross-border. The development strategy of the Indonesia-Malaysia Border Village is to develop commodities that are attract Malaysian market. In addition, it is hoped that the plan to build cross-border posts in this area can increase the official buying and selling of goods at the border.
