Abstract

The 1945 Constitution of the Republic of Indonesia, as the constitution of Indonesia, contains basic rules that are arranged to be used as guidelines or guidelines for the government in carrying out its functions and duties. The Constitution has a role as a barrier to government power in such a way as not to use power arbitrarily. Based on the background of the problems above, the issues that will be discussed are: How is the extension of the President's term of office according to the laws in force in Indonesia? What is the limitation of the term of office of the President in accordance with the constitution of the Republic of Indonesia? This study uses a normative juridical method that emphasizes library research. This means that this research is carried out by paying attention to the applicable laws and regulations. The type of research is qualitative and the approach used is the Statute Approach. This approach is carried out by examining all relevant laws and regulations. Then it is also carried out with a conceptual approach and expert opinion. Limiting the term of office of the President must be carried out according to the constitution, not according to the wishes of the authorities and not also based on political agreements.Keywords: Constitution; Position of President; Indonesia AbstrakUndang-Undang Dasar Negara Republik Indonesia Tahun 1945, sebagai konstitusi Indonesia memuat aturan-aturan dasar yang disusun agar dijadikan pedoman atau pegangan bagi pemerintah dalam menjalankan fungsi dan tugasnya. Undang-Undang Dasar memiliki peranan sebagai pembatas kekuasaan pemerintah sedemikian rupa agar tidak menggunakan kekuasaan dengan sewenang-wenang. Berdasarkan latar belakang permasalahan di atas, maka permasalahan yang akan  dibahas adalah: Bagaimanakah perpanjangan masa jabatan Presiden menurut aturan hukum yang berlaku di Indonesia. Bagaimanakah pembatasan masa jabatan Presiden sesuai dengan konstitusi Negara Republik Indonesia. Penelitian ini menggunakan Metode Yuridis Normatif yang menekankan pada penelitian kepustakaan Artinya penelitian ini dilakukan dengan cara memperhatikan aturan perundang-undangan yang berlaku. Adapun jenisnya penelitian adalah kualitatif dan pendekatan yang dilakukan adalah pendekatan Perundang-Undangan (Statute Approach) Pendekatan ini dilakukan dengan menelaah semua peraturan perundang-undangan yang berkaitan. Kemudian juga dilakukan dengan pendekatan konsep dan pendapat para ahli. Pembatasan masa jabatan Presiden harus dilakukan sesuai konstitusi, bukan sesuai keinginan penguasa dan bukan juga atas kesepakatan politik.  Kata Kunci: Konstitusi; Jabatan Presiden; Indonesia

Abstract

The benefit of registering Intellectual Property of an Brand IntellectualWork is essential to protect our creative assets. The indifference in themaintenance of Intellectual Property may lead to remorse especially when theBrand Work is becoming widely known, protecting the trademark of theIntellectual Property right from the acknowledgment of others. For theimplementation of registration of Intellectual Property, process / procedure isrequired, such as applying after completion of all required requirements. Inaddition to these conditions, which is not less important is that each registration ischarged differently depending on what he enrolled. The process / procedure is setin different laws and regulations depending on the registration of what you wantdone, eg Copyright, Brand and others. Obstacles encountered in the field, noregistration, especially patents, between the costs and benefits obtained lesscomparable. The relatively large cost is spent while the economic value obtainedis still small for now.

Abstract

            Banda Aceh City Qanun Number 5 of 2016 concerning Smoking Free Areas and MPU Fatwa Number 18 of 2014 concerning Smoking in the Islamic view are two regional policies that have been issued and must be implemented optimally to limit and reduce smoking consumption, especially among adolescents and children in Aceh. This study aims to assess the perspectives of tobacco control-related stakeholders on tobacco control policies and practices in Aceh Province for children and adolescents. This study uses a qualitative study design by conducting Focus Group Discussions with twelve people as representatives of stakeholders related to tobacco control efforts in Aceh. The smoking culture of the Acehnese people which has integrated into their way of life has made teenagers and children vulnerable to exposure to cigarettes. But on the other hand, the Islamic view of smoking is in line with the principles of tobacco control where smoking can harm children and adolescents, so it is strictly prohibited in the Islamic view. Therefore, it is suggested that tobacco control interventions in Aceh for children and adolescents can focus on interventions that use a socio-cultural approach. This can guarantee the success of the tobacco control intervention program carried out in certain areas such as Aceh Province, which still has very clear socio-cultural values. In addition, a shared understanding of the dangers of smoking and making clear the law against smoking will strengthen tobacco control in Aceh, where so far the people have carried out everything based on sharia. Strict sanctions for youth and children who smoke and adequate resources are other keys to the success of the practice and implementation of tobacco control policies in Aceh Province.

Abstract

Article 168 paragraph (2) Law no. 7 of 2017 states that elections to elect members of the People's Legislative Assembly, provinces, and the People's Representative Council, district/city People's Representative Councils are carried out with an open proportional system. Each party may nominate more than one candidate so that it can result in competition between members within one party. However, in reality, problems regarding the general election system raise pros and cons regarding the implementation of the general election system. Everyone has agreed in full that viewing the Open Proportional System is a very democratic electoral system, because it involves the Indonesian people widely in selecting their representatives who will sit in the DPR, district/city and provincial DPRDs. This is related to the judicial review of Law Number 7 of 2017 concerning Elections to the Constitutional Court. This study aims to explain the Open Proportional General Election System in the constitution of the Republic of Indonesia. To explain the factors that influence the implementation of an open proportional election system in the constitution of the Republic of Indonesia.Keywords: general election, first time voters Abstrak:Pasal 168 ayat (2) UU No. 7 Tahun 2017 menyebutkan bahwa Pemilu untuk memilih anggota Dewan Perwakilan Rakyat, Provinsi, dan Dewan Perwakilan Rakyat, Dewan Perwakilan Rakyat kabupaten/kota dilaksanakan dengan sistem proporsional terbuka. Setiap  partai  boleh  mengusung  lebih  dari  satu  kandidat  sehingga  bisa mengakibatkan persaingan antar-sesama di dalam satu partai. Namun pada kenyataannya, Permasalahan mengenai sistem pemilihan umum  menimbulkan  pro dan kontra tentang penerapan sistem pemilihan umum. Semuanya telah bersepakat secara utuh bahwa memandang Sistem Proporsional Terbuka adalah sebuah sistem pemilu yang sangat demokratis, karena sangat melibatkan secara luas  masyarakat Indonesia untuk memilih wakil-wakilnya yang akan duduk di DPR, DPRD kabupaten/kota dan provinsi. Hal ini berkaitan dengan uji materi terhadap Undang-Undang Nomor 7 Tahun 2017 tentang Pemilu ke Mahkamah Konstitusi. Penelitian ini bertujuan untuk menjelaskan Sistem Pemilihan Umum Proporsional Terbuka Dalam ketatanegaraan Republik Indonesia Untuk Menjelaskan faktor-faktor yang mempengaruhi penerapan sistem proporsional terbuka dalam ketatanegaraan Republik Indonesia.    Kata Kunci: Sistem Pemilihan Umum; Pemilih Pemula
