Abstract

Hukum perdata Islam di Indonesia terus mengalami dinamika seiring dengan perkembangan sosial, ekonomi, dan politik. Salah satu tantangan utama yang dihadapi adalah bagaimana hukum perdata Islam dapat berkontribusi dalam mencapai kemandirian pangan sebagai bagian dari visi Indonesia Emas 2045. Studi ini mengkaji rekonstruksi hukum perdata Islam dalam bingkai Fiqh Siyasah, dengan fokus pada peran hukum Islam dalam mendukung kebijakan ketahanan pangan berbasis Maqashid Syari’ah. Penelitian ini menggunakan pendekatan yuridis-normatif dengan analisis konseptual terhadap Fiqh Siyasah, Istihsan, dan Istishab sebagai metode ijtihad dalam merespons dinamika hukum perdata Islam, khususnya dalam aspek agraria, wakaf produktif, dan transaksi bisnis halal. Selain itu, studi ini juga menelaah kebijakan hukum yang selaras dengan Sustainable Development Goals (SDG’s), terutama pada aspek pengentasan kemiskinan (SDG 1), ketahanan pangan (SDG 2), dan kesetaraan gender (SDG 5) dalam akses terhadap sumber daya agraria. Hasil penelitian menunjukkan bahwa rekonstruksi hukum perdata Islam melalui pendekatan Fiqh Siyasah dapat memperkuat regulasi terkait pemanfaatan tanah pertanian, wakaf produktif, dan distribusi hasil pertanian berbasis keadilan sosial dan kesejahteraan umat. Implikasi dari kajian ini diharapkan dapat memberikan rekomendasi kebijakan hukum bagi pemerintah dan lembaga Islam dalam mengoptimalkan peran hukum Islam dalam mewujudkan kemandirian pangan yang berkeadilan dan berkelanjutan di Indonesia.

Abstract

This study examines the role of judicial review in safeguarding constitutional rights within modern democracies, using a literature review approach. Judicial review serves as a critical mechanism for ensuring that laws and government actions comply with constitutional principles. By empowering courts to evaluate the constitutionality of legislation, judicial review protects individual rights and prevents the abuse of governmental power. The research explores the evolution of judicial review, its various models, and its impact on the balance of power between different branches of government. The findings highlight the significance of judicial review in upholding democratic values, such as the rule of law, separation of powers, and the protection of minority rights. Through case studies from different democratic systems, the study analyzes the strengths and limitations of judicial review in addressing constitutional challenges. While judicial review has proven essential in safeguarding rights, it also faces criticisms related to judicial activism and its potential to undermine legislative authority. This research concludes that, despite these challenges, judicial review remains a fundamental pillar in the defense of constitutional rights in modern democracies, providing a necessary check on legislative and executive actions to preserve democratic integrity.

Abstract

This article explores the critical role of constitutional law in environmental protection, emphasizing the obligations of governments and the legal frameworks necessary for sustainable development. Utilizing a qualitative approach through extensive literature review, the study examines various constitutional provisions across different jurisdictions that enshrine environmental rights and responsibilities. It highlights how these legal frameworks serve as foundational instruments for promoting environmental sustainability and ensuring government accountability in environmental governance. The findings reveal that constitutional law not only provides a basis for environmental protection but also empowers citizens to hold their governments accountable for environmental degradation. Furthermore, the article discusses the interplay between constitutional law and international environmental agreements, illustrating how domestic legal frameworks can align with global sustainability goals. By analyzing case studies and existing literature, this research underscores the importance of integrating environmental considerations into constitutional law to foster a more sustainable future. The study concludes with recommendations for policymakers to enhance constitutional provisions related to environmental protection, ensuring that governments fulfill their obligations towards sustainable development. This research contributes to the ongoing discourse on the intersection of law and environmental sustainability, advocating for stronger legal frameworks that prioritize ecological integrity within constitutional mandates.
