Abstract

ABSTRAK Perkawinan sebagai ikatan lahir batin antara pria dengan wanita dengan tujuan membangun sebuah hubungan keluarga yang bahagia dan kekal berdasarkan ketuhanan yang maha Esa. Namun demikian, setiap orang memiliki pandangan, pola pikir dan pendapat yang berbeda dalam memaknai suatu perkawinan. Hal ini dikarenakan terdapat bebagai hal yang mempengaruhi seseorang atau suatu kelompok dalam pola pikir terhadap suatu hal termasuk agama, tradisi, lingkungan, usia, hingga status sosial yang dimiliki. Seperti halnya masyarakat suku Tengger di desa Pakel yang memiliki perbedaan dan tradisi yang berbeda dalam melangsungkan prosesi perkawinan. Jurnal ini memiliki tujuan mengetahui tradisi perkawinan masyarakat suku Tengger yang tidak mempermasalahkan adanya pernikahan beda agama karena menganggap hal tersebut sebagai salah satu bentuk nyata dari toleransi beragama. Selain itu untuk mengetahui makna perkawinan bagi masyarakat suku Tengger yang sering kali mendapatkan pasangan berbeda agama dalam pandangan Islam khususnya di Desa Pakel, Kecamatan Sukapura, Kabupaten Probolinggo. Penelitian ini adalah penelitian kulitatif dengan metode pendekatan Empiris Sosiologis dengan teknik pengumpulan data berupa field research, yaitu observasi langsung ke lapangan guna mengetahui langsung data dan fakta di lapangan menggunakan metode observasi, wawancara dan juga dokumentasi. Abstract

PERMA NO. 1 Tahun 2016 merupakan panduan bagi hakim dan non-hakim dalam upaya mediasi terhadap penyelesaian sengketa gugat cerai di Pengadilan Agama. Sengketa yang terjadi tentu melibatkan dua pihak, yaitu suami dan istri karena sebab-sebab tertentu. Pada titik sengketa inilah perlu adanya mediator yang berfungsi sebagai penengah agar ikatan pernikahan tidak putus dan fungsinya tercapai yaitu membentuk keluarga sakinah, mawaddah, warahmah. Pada pelaksanaannya, mediasi memerlukan regulasi dan metode yang bisa dilakukan baik oleh hakim sendiri dalam Pengadilan Agama maupun oleh non-hakim. Tentunya mediasi bertujuan sebagai langkah baik dalam mencegah terjadinya perceraian, demikian juga yang terjadi dalam Pengadilan Agama Probolinggo Kelas I B. Metode yang digunakan adalah penelitian kualitatif. Penelitian ilmiah model umum ini untuk menganalisis tanggapan berdasarkan peristiwa sosial yang berlaku. Secara logis menerapkan beberapa metode yang sudah di telaah untuk merespon persoalan yang tercantum, memobilisasi fakta, membentuk kreasi yang tanpa ditetapkan lebih dahulu, membentuk kreasi yang diperoleh menggunakan di luar garis-garis kontan dari penelitian. Obyek penelitian ini dengan mengambil jumlah data pada tahun 2022 terhadap pelaksanaan mediasi dalam kasus gugat cerai Pengadilan Agama Probolinggo Kelas I B. Dari data tersebut, peneliti bisa menemukan 2,56% jumlah perkara yang berhasil di mediasi, sementara 9,58% jumlah upaya mediasi yang tidak berhasil. Kata kunci: Mediasi; Kasus Gugat Cerai; Pengadilan Agama Probolinggo Kelas IB.

Abstract

This study examines children's rights from the perspective of Islamic law and positive law in Indonesia. Utilizing a deskriptif qualitative methodology, this study aims to analyze the legal rights of children in conflict as well as the differences between Islamic and positive Indonesian law on the custody of children. The deskriptif method of quantitative analysis is used to provide a comprehensive picture of the differences between Islamic and positive Indonesian law concerning the rights of minors. This study provides a more comprehensive understanding of the application of law concerning the guardianship of adopted children, which can serve as a foundation for longer-term legislative development in Indonesia. Abstract

Marriage at an early age has become a serious social concern in various societies. The purpose of this research is to evaluate the impact of early marriage on the dynamics of family life in that village. The research methodology involves surveys and structured interviews with several couples who got married at a young age. The research findings indicate that early marriage has complex effects on family life. While it can contribute to the formation of a strong family, early marriage also brings negative impacts such as family economic limitations, emotional immaturity of the partners, and higher health risks for both the mother and child. Factors such as education, employment, and social support play a key role in mitigating the negative impacts of early marriage. This study also proposes policy recommendations and intervention programs to enhance community understanding of the risks associated with early marriage and improve the quality of family life. Abstract

Marriage is crucial for fulfilling human biological needs. Often, couples opt for early marriage, which unfortunately may end in early divorce. In Indonesia, these cases are not uncommon, with an increase observed in 2023 compared to previous years. The quality of children, family, family harmony, and divorce are all influenced by these issues, leading to school dropout rates. In Desa Rowogempol, Kecamatan Lekok, Kabupaten Pasuruan, early marriages are prevalent despite the enactment of Law No. 16 of 2019, which sets the minimum marriage age at 19 for both genders. This context sets the basis for this study, aiming to understand the intensity, factors, and impacts of early marriage and divorce in Desa Rowogempol. The research employs qualitative methods (field research). Quantitative data on early marriages are collected from the Office of Religious Affairs (KUA) in Kecamatan Lekok, while data on divorces resulting from early marriage are obtained from the Religious Court (PA) in Kabupaten Pasuruan. Qualitative data are gathered through face-to-face interviews and online media with relevant parties. The study reveals an increase in early marriage intensity from 2022-2023, while early divorce shows a decline. Generally, early marriages occur due to arranged marriages or inappropriate social interactions, often leading to early divorces due to frequent conflicts stemming from the arranged nature of the marriage. keywords: Early Marriage, Early Divorce, Intensity of Marriage and Divorce

Abstract

This article aims to examine the concept of the impact of polygamy on household harmony which is currently, widespread in people’s lives today. The family, as a unit formed from marriage, creates a relationship that is Sakinah, Mawadah, Warahmah. Polygamy, is a process in which a man has more than one wife at the same time, Islam allows it with certain conditions.       However, the psychological impact on wives and children includes family conflict, competition between wives, as well as negative impacts on children’s development, including lack of love and trauma. Abstract

Marital relationships are the most important thing in fulfilling human biological needs. However, domestic life after marriage is not as easy as imagined In Indonesia, divorce cases are still widespread. Especially in Pasuruan Regency in 2022 the intensity of cases found was 2,428 and in 2023 at the beginning of January there were 299 divorce cases. Most of these divorce cases are lawsuit divorces. The reason given by the plaintiff was the economic crisis. This context serves as the basis for the study conducted. The aim is to determine the intensity of divorce in Pasuruan Regency. The research uses the library research method. The data obtained by researchers uses a quantitative approach, namely quantitative data collecting divorce data at the Pasuruan Regency Religious Court (PA) through online media, namely through news reports from the Pasuruan Regency Religious Court. Abstract

Quality is an effort that is carried out seriously with the aim of achieving a value that can provide maximum satisfaction to the user. A product is considered to have quality if the product meets the expectations of various parties, especially producers and consumers. One thing that is a common thread in the quality concept is satisfaction.  This research was carried out because the researcher wanted to know whether the Prabulinggih written batik UKM had implemented quality management in its business or not. At this research site, quality management has been implemented in its production, Prabulinggih handwritten batik is unique, how can the Prabulinggih Handwritten Batik UKM receive a positive response and appreciation from the Head of the Cooperatives and Small and Medium Enterprises Department of Probolinggo Regency. In fact, if you look at the production location, it is not very strategic, namely it is located in Janten Hamlet, Bulujaran Lor Village, Tegalsiwalan District, Probolinggo. This is what attracted researchers to conduct research on Production Quality Management in Probolinggo Written Batik UKM, Bulujaran Lor Village, Tegalsiwalan District, Probolinggo.

Abstract

This study examines the implementation of sharia economic principles in the development of superior products of the Darul Mukhlashin Tegalsiwakan Islamic Boarding School through the One Islamic Boarding School One Product (OPOP) program. Pesantren not only advises as a religious educational institution, but also as an agent of community-based economic empowerment. With a qualitative approach through interviews, observations and analysis of this research document, it is revealed that sharia principles such as justice, transparency, and hatred have been applied in the management of cooperatives and the production of banana chips. This implementation increases the economic independence of Islamic boarding schools. Creating jobs and empowering the surrounding community, especially local farmers and artisans. Challenges such as varied sharia literacy and technological limitations still need to be overcome. The OPOP program emphasizes that the collaboration of students, pesantren, and the community can create a competitive economic ecosystem that is in line with Islamic values, supporting local socio-economic welfare in Probolinggo, especially the Tegalsiwalan area.

Abstract

This study aims to explore the basic concept of humanism education as education so that children consciously have religious characteristics with an Islamic perspective and have an implementation in the learning process. Then a library research approach is needed by collecting information from relevant reading materials, magazines, books, seminars, and others, after that it is carefully studied and researched, then the data is generalized and sorted based on the suitability of the research theme, then the data obtained from the results of further sorting analyzed in depth with analytical methods. Based on the results of the researcher's analysis that the concept of humanism education is an educational concept originating from the assumption that human beings have almost the same potential, which must be developed intensively and continuously so that religious humanist education has relevance to the era of the industrial revolution 4.0. Humanism education invites students to find solutions to problems encountered with guidance and direction from educators. Implementing this concept emphasizes educators so that they can create a learning environment that is far from elements of coercion, oppression, the hegemony of thought, and attitudes that are far from the universal values of monotheism and humanity.
