Abstract

Pengabdian ini dilakukan dengan judul Penyuluhan Hukum Pentingnya Kepemilikan Sertifikat Hak Milik Untuk Menjamin Kepastian Hukum Di Kelurahan Hedam Distrik Heram Kota Jayapura, kegiatan yang dilakukan kepada mitra dikarenakan adanya kasus dari mitra tentang ketidakpahaman mengenai prosedur pembuatan sertifikat hak milik atas tanah sehingga dengan keahlian yang dimiliki pengabdi dapat melakukan penyuluhan hukum tersebut guna agar mitra dapat mengetahui status kepemilikan tanah mereka dan cara pengurusan sertifikat hak milik atas tanah pada Kantor Pertanahan Kota Jayapura untuk menjamin kepastian hukum. Metode pelaksanaan pengabdian ini dilakukan dengan cara melalui ceramah dan diskusi yang dilaksanakan pada hari sabtu, tanggal 22 februari 2025 yang dilaksanakan di Kelurahan Hedam. Kegiatan ini di awali dengan persiapan dan koordinasi, kemudian pemaparan materi dengan memberikan pengetahuan kepada mitra mengenai prosedur pengurusan sertifikat hak milik atas tanah. Adapun luaran dari pengabdian ini adalah memberikan pemahaman kepada mitra tentang status kepemilikan hak-hak atas tanah, pendaftaran tanah, prosedur pengurusan sertifikat hak milik atas tanah dan juga memberikan pendampingan hukum pra ajudikasi dalam proses pengurusan sertifikat pada Kantor Pertanahan Kota Jayapura.

Abstract

Disputes over customary land still occur in every region, both in the interior and in urban areas, as well as in the customary law community in Waropen Regency, customary land is still disputed to this day, both among customary law communities or between customary law communities and the Regional Government. The approach method used is empirical, namely research conducted by observing the reality that occurs in the field. The purpose of this study was to determine the role of the Customary Council in resolving customary land disputes. The results of this study revealed that the resolution of customary land disputes of the Waropen customary law community was resolved through customary law which in the Waropen language is called "Woidama". Woidama means deliberation. The house where the deliberation is held is the sera house (the house of the tribal chief) because the one who will lead the customary deliberation is Sera. Therefore, the role of the Customary Council is very much needed in resolving disputes, the Customary Council functions as a protector of the indigenous Papuans, and as a channel for messages between Papuans and the government, especially in the Waropen Regency government area.

Abstract

This study aims to determine the kinship system and customary government of the Waropen indigenous community. The research method used is empirical by observing the reality that occurs in the field. The results of this study reveal that the Waropen indigenous community recognizes a local kinship group called "da". Almost all villages in Waropen have three to five "da" which oversee several bawa houses (large and long houses). Family members feel bound by kinship ties that are calculated through the male line. Members of the "da" believe that they come from the same ancestors, although they are often unable to explain these kinship relationships concretely. In Waropen society, larger kinship groups are formed by "ruma bawa" which has two meanings, namely: (1) patrilocal extended family and (2) house as a place to live. Waropen society also recognizes local kinship groups. Its members are bound by kinship ties that are calculated through the father's line (patrilineal). In the customary government system of the Waropen indigenous community, several positions are known in the customary structure, which also provide clues about the boundaries of social stratification. These positions are: Sera Bawa, Mosaba, (Pertuan/ruler/King), Eso (Commander), Rubasa (People's Deputy), Manobawa, Sera-Titibi (Pertuan for groups in small circles/keret) Waribo, and Ghoinino.
