Abstract

Kompleksitas produk dan layanan jasa keuangan dalam financial tecnology (fintech) berpotensi menimbulkan sengketa antara penyelenggara dengan pengguna atau konsumen. YLKI mencatat, pada tahun 2020, sektor jasa keuangan (perbankan, asuransi, leasing, fintech peer to peer lending) adalah sektor yang paling bermasalah. Oleh karenanya, sebagai rangkaian upaya perlindungan konsumen, OJK melalui POJK No. 61/POJK.07/2020 membentuk Lembaga Alternatif Penyelesaian Sengketa (LAPS) Sektor Jasa Keuangan. Namun, diperlukan identifikasi akan potensi berbagai tantangan dan kendala yang dihadapi LAPS Sektor Jasa Keuangan agar fungsi dan tugasnya dapat dijalankan secara optimal. Jenis pendekatan dalam penelitian ini adalah pendekatan perundang-undangan (statute approach). Pengumpulan data dilakukan dengan studi kepustakaan (library research). Hasil penelitian menunjukkan bahwa LAPS Sektor Jasa Keuangan memiliki berbagai tantangan, diantaranya: dualisme alternatif penyelesaian sengketa konsumen jasa keuangan antara Badan Penyelesaian Sengketa Konsumen (BPSK) dengan LAPS Sektor Jasa Keuangan, terbatasnya infrastruktur hukum, dan ketersediaan jumlah mediator dan arbiter. Mengatasi berbagai tantangan tersebut, strategi hukum yang dapat dilakukan diantaranya: (1) rekonstruksi dan harmonisasi LAPS dalam peraturan perundang-undangan; (2) penyediaan infrastruktur hukum LAPS Sektor Jasa Keuangan di seluruh wilayah Indonesia; dan (3) memformulasikan rasio potensi sengketa di setiap wilayah dengan ketersediaan jumlah mediator dan arbiter.The The complexity of financial products and services in financial technology (fintech) has the potential to cause disputes between providers and users or consumers. YLKI noted that in 2020, the financial services sector (banking, insurance, leasing, fintech peer to peer lending) was the most problematic sector. Therefore, as a series of consumer protection efforts, OJK through POJK No. 61/POJK.07/2020 established an Alternative Dispute Resolution Institution (LAPS) for the Financial Services Sector. However, it is necessary to identify the potential challenges and obstacles faced by the Financial Services Sector LAPS so that its functions and duties can be carried out optimally. The type of approach in this research is the statute approach. Data collection is done by literature study (library research). The results show that the Financial Services Sector LAPS has various challenges, including: the dualism of alternative consumer dispute resolution for financial services between the Consumer Dispute Resolution Agency (BPSK) and the Financial Services Sector LAPS, limited legal infrastructure, and the availability of a number of mediators and arbitrators. Overcoming these challenges, legal strategies that can be carried out include: (1) reconstruction and harmonization of LAPS in laws and regulations; (2) provision of legal infrastructure for the Financial Services Sector LAPS throughout Indonesia; and (3) formulate the ratio of potential disputes in each region with the availability of the number of mediators and arbitrators.

Abstract

This article aims to find out and assess the forms of binary option supervision in Indonesia contained in statutory regulations. This article discusses the legal problems of the weakness of binary option supervision in Indonesia. This research uses normative research methods using primary and secondary legal materials collected using literature studies with a statutory approach. This study found that although supervision of commodity futures trading in Indonesia has been carried out by Bappebti, there are still problematic weaknesses in supervising binary option trading which is currently a new trend in Indonesian society. Futures trading in Indonesia is regulated in Law No. 10 of 2011 concerning Commodity Futures Trading. Bappebti's supervision has legal problems, namely in the form of the absence of a special regulation on binary option trading, lack of education for the public, imposition of sanctions that are less strict, and the existence of legal vagueness. Bappebti is expected to have a legal strategy in optimizing binary option supervision in Indonesia in the form of: making strict regulations, socializing to the public about the dangers of illegal investment, increasing financial and investment literacy, and can cooperate with foreign regulators to improve binary option supervision in Indonesia.

Abstract

Bad loans are a serious problem in the banking sector, not only harming financial institutions but also impacting the economic conditions of debtors. This study aims to evaluate the implementation of the Collateral Takeover mechanism in resolving bad loans at Rural banks. The method used is empirical, based on field observations and regulatory analysis, as well as legal literature. The results of the study indicate that the Collateral Takeover mechanism includes several stages, starting from identifying problem loans, taking over assets, assessing, selling, to recording in financial statements with settlement within an uncertain deadline. Existing regulations including Financial Services Authority Regulation Number 1 of 2024 concerning the Asset Quality of Rural banks have not provided legal certainty to debtors, especially regarding the time period for resolving Collateral Takeover. Challenges in implementing Collateral Takeover include unclear regulations, lack of creditor participation in auctions, high legal costs, and minimal education and access to legal assistance for debtors. These obstacles hinder debtors from obtaining legal certainty.

Abstract

This study discusses consumer legal protection against developer defaults in the binding agreement for the sale and purchase of flats (PPJB). The increase in housing development, especially through the pre-project selling system, often harms consumers due to uncertainty and default from developers. The research method used is a literature study, with a legal approach and a case approach. Analysis was carried out on Decision Number 91/PDT/2018/PT. Jakarta to assess the legal protection provided to consumers. The results of the study show that regulations, including Law Number 11 of 2011 concerning Flats, provide a strong legal basis for consumers to demand their rights. Consistent law enforcement in default cases creates a precedent that strengthens the position of consumers, increases public trust in the legal system, and creates a conducive environment for flats buying and selling transactions.

Abstract

Introduction to the Problem: The development of information technology has given rise to various types of electronic contracts in the form of adhesion contracts. Unfair legal issues surround the contract formation process and the content of new electronic contract models, such as browser wrap agreements and sign-in wrap agreements. In several cases that have been decided by the Court, the panel of judges has its own standards for deciding disputes based on a fair electronic contract. Purpose/Study Objectives: This paper aims to elaborate on the nature of contractual fairness from an electronic contract perspective. Design/Methodology/Approach: This study employed the statute approach and the case approach. This research examines various regulations relating to agreements, electronic contracts, the doctrine of unconscionability and examizing a number of decisions pertaining to electronic contracts from courts in Indonesia as well as various other nations. Findings: The research results can be concluded that nature of fairness in electronic contracts can be tested through two indicators, the process of forming the contract and clauses in the agreement. Electronic contracts are considered procedurally unfair if the weak party does not know and realizes that they are bound by a contract. An electronic contract is considered substantively unfair if a clause in the contract places an unreasonable burden on the weaker party. In addition to the doctrine of unconscionability, the principles of transparency, duty to read, and reasonable expectation must also be used to ensure fairness in electronic contracts. These principles need to be formulated into the norms of the Indonesian Information Transaction Act to protect consumers from unfair contracts. Paper Type: Research Article

Abstract

Kompleksitas permasalahan dalam penanganan perubahan iklim telah menuntut adanya inovasi dalam sistem penurunan emisi gas rumah kaca. Kesadaran untuk menyelesaikan permasalahan tersebut ditandai dengan Paris Agreement yang menjadi seruan bagi seluruh negara agar dapat berkontribusi dalam menjaga batas pencemaran lingkungan dan menunjukkan komitmennya untuk  memperbaiki kualitas lingkungan hidup. Implementasi Undang-Undang Nomor 4 Tahun 2023 tentang Pengembangan dan Penguatan Sektor Keuangan menjadi landasan bagi pemberlakuan bursa karbon sebagai salah satu sarana untuk mencapai Net Zero Emision di Indonesia. Permasalahan muncul ketika aktivitas ini belum sepenuhnya dapat berjalan dengan optimal karena minimnya jumlah korporasi yang terlibat langsung dalam perdagangan karbon di Bursa Efek Indonesia. Pengabdian ini dilaksanakan dengan menggunakan pendekatan preskriptif, pragmatis, persuasif dan evaluatif untuk memperkuat peran Galeri Investasi dalam mensosialisasikan bursa karbon kepada pelaku Industri yang ada di wilayah Solo Raya. Pengabdian ini dilakukan dengan memberikan sosialisasi kepada perwakilan PT. Konimex serta menganalisis potensi keuntungan dari aktivitas industri tersebut dalam bursa karbon. Hasil observasi dalam proses pengabdian menunjukkan bahwa PT. Konimex telah memiliki pedoman komitmen pencapaian PROPER Biru dalam proses produksi yang dilakukan dengan menggunakan teknologi ramah lingkungan. Kendati demikian, belum ada agenda untuk terjun dalam bursa karbon. Dari hasil sosialisasi yang dilakukan oleh IDX Carbon, telah terlihat peluang dan strategi yang perlu dipertimbangkan oleh PT. Konimex untuk dapat ikut serta dalam perdagangan karbon di Indonesia. Pendekatan dan agenda serupa perlu terus dilakukan terhadap industri-industri skala nasional yang ada di Solo Raya.

Abstract

The rise in GHG emissions has driven countries, including Indonesia, to commit to Net Zero Emissions through the 2015 Paris Agreement. One of Indonesia’s efforts is limiting carbon emissions via carbon trading. The traded object, carbon units, are categorized as securities with economic value, presenting an opportunity to use them as collateral. However, theres is no clear regulation governing this. This normative legal research uses statute and conceptual approaches, with primary and secondary legalmaterials on collateral law. The study aims to propose regulatory recommendations to enable the use of carbon units as collateral in Indonesia. The findings suggest that fiduciary is the most suitable binding meyhod, as it does not require physical delivery and allows execution through private sale under Article 31 of Indonesia Fiduciary Law. The lack of a valuation institution can be addressed by optimizing collaboration between public appraisers, like KJPP and GHG Validation and Verification instituions (LV/V GRK).

Abstract

The increasing issue of the global environmental crisis has prompted the UN to launch 17 Sustainable Development Goals (SDGs). Although Indonesia has a strong commitment to achieving the SDGs, its implementation is still lagging behind, one of the reasons being the suboptimal application of Environmental, Social, and Governance (ESG) at the company level, especially in the banking sector. This creates uncertainty, implementation obstacles for companies, and opens up loopholes for ESG-washing practices. This study aims to formulate a regulatory formulation for the ESG concept in the banking sector as a strategy to accelerate sustainable development in Indonesia. The research method used is normative legal research that is prescriptive with a statutory approach and a conceptual approach. The types and sources of legal materials use primary legal materials and secondary legal materials. The results of the study conclude that an effective regulatory formulation is needed including a revision of POJK 51/POJK.03/2017 to require integrated reporting and adoption of the double materiality concept. In addition, it is recommended to strengthen the role of Good Corporate Governance (GCG), establish standard and measurable ESG reporting standards, require independent assurance (verification) of sustainability reports, and enforce legal sanctions against ESG-washing practices.

Abstract

This legal research aims to analyze arrangements regarding communal legal protection of traditional cultural expressions based on Government Regulation Number 56 of 2022 concerning Communal Intellectual Property, and it also seeks to identify legal problems in the practice of protecting Communal Intellectual Property in Indonesia where various cases of unilateral claims against the inheritance of Traditional Cultural Expressions by other countries, such as Malaysia's claim for Pendet Dance, Wayang Art, and Reog; Germany’s claim for Distinctive Ornamental Frame from Jepara; and China’s claim for Batik Pesisir’s motif. There find legal problems. First, the intellectual property legal protection regime in Indonesia is still individualistic. Second, Insufficient communal intellectual property legal instruments. Last, a low legal culture in Indonesian society. Based on these findings, that the government need to amendment the protection of Traditional Cultural Expressions of Communal Intellectual Property through substance reform in Act No. 28 of 2014 about Copyright and develop one database of Communal Intelectual Property.
