Abstract

Abstrak:Pada masyarakat Madura terdapat lokal wisdom yang menjadikan masyarakat wanitanya mempunyai semangat emansipasi yang tinggi. Bahkan dalam situasi tertentu dia menjadi leader dalam kehidupan keluarga, yang tentunya terdapat anggota keluarga yang laki-laki. Penelitian ini menggunakan metode penelitian kualitatif untuk menemukan memahami model relasi antara penerapan waris adat Madura dengan emansipasi pada pekerja imigran wanita Pamekasan Madura. Penelitian ini menunjukkan bahwa terdapat relasi yang kuat antara semangat emansipasi pada pekerja imigran wanita Madura dengan sistem waris adat yang diterapkannya. Persamaan hak dalam penerapan waris adat Madura melahirkan persamaan kewajiban untuk berperan aktif dalam keberlangsungan kehidupan keluarga, termasuk di dalamnya usaha pemenuhan perekonomian keluarga. Kata kunci: Emansipasi, Imigran, Waris Abstract:In the Madurese community there is local wisdom which makes the female community have a high spirit of emancipation. Even in certain situations he became a leader in family life, which of course there are male family members. This study uses qualitative research methods to find understanding the relationship model between the application of Madura adat inheritance and emancipation in Pamekasan Madura female immigrant workers. This research shows that there is a strong relationship between the spirit of emancipation in Madurese female immigrant workers and the customary inheritance system that it applies. Equality of rights in the application of Madurese custom inheritance gives birth to an equal obligation to play an active role in the survival of family life, including efforts to fulfill the family economy. Abstract

Sertifikasi halal merupakan suatu proses untuk memperoleh label halal oleh lembaga berwenang. Penelitian ini dilatarbelakangi oleh masih adanya beberapa pelaku UMKM di Kecamatan Burneh Kabupaten Bangkalan yang belum melakukan sertifikasi halal. Penelitian ini secara umum mengangkat masalah terkait implementasi sertifikasi halal, faktor pendukung dan penghambat pensertifikasian halal di Kecamatan Burneh Kabupaten Bangkalan. Penelitian ini bertujuan menganalisa implementasi dari sertifikasi halal pada UMKM di Kecamatan Burneh, mengidentifikasi faktor yang mendukung dan menghambat, dan mengkaji peran LPPOM MUI Provinsi Jawa Timur. Jenis penelitian yang peneliti gunakan adalah penelitian lapangan dengan mengandalkan pendekatan secara yuridis sosiologis dengan membandingkan dengan hukum yang berlaku serta kenyataan yang terjadi pada lapangan. Pengumpulan data dilakukan melalui wawancara dan studi pustaka. Teknik analisa data yang digunakan pada penelitian ini adalah deskriptif kualitatif melalui interpretasi, triangulasi dan analisis isi. Dari hasil penelitian diperoleh bahwa pertama, implementasi sertifikasi halal sudah berjalan dengan baik tetapi masih terdapat pelaku UMKM yang belum melakukan sertifikasi. Kedua, faktor yang mendukung sertifikasi halal di Kecamatan Burneh Kabupaten Bangkalan adalah adanya peraturan yang mengatur sertifikasi halal, konsumen makanan yang mayoritas Islam, dan produsen makanan mayoritas Islam. Adapun faktor penghambatnya adalah kurangnya sosialisasi dan kurangnya kesadaran produsen terhadap hukum. Ketiga, peran LPPOM MUI Provinsi Jawa Timur dalam membangun kesadaran pelaku UMKM di Kecamatan Burneh adalah memberikan sosialisasi tentang sertifikasi halal, dan pembinaan penggiat UMKM terkait sertifikasi halal.

Abstract

Artikel ini akan membahas penerapan sertifikasi halal produk UMKM dalam perspektif budaya hukum di Madura. Masyarakat Madura memiliki budaya yang unik dan kuat dalam memegang teguh prinsip. Masyarakat Madura merupakan masyarakat yang religius, patuh dan tunduk dalam menjalankan perintah agama, dalam hal ini adalah Islam. Wujud ketaatan terhadap ajaran Islam ini terangkum dalam ungkapan populer, yaitu: “bhuppa’, bhabhu’, ghuru dan rato” (ayah, ibu, guru dan pemimpin pemerintahan). Penelitian ini merupakan penelitian lapangan yang bersifat deskriptif kualitatif. Hasil penelitian ini menunjukkan bahwa nilai-nilai yang dianut oleh masyarakat Madura berupa taat dan patuh “bhuppa’, bhabhu’, ghuru, dan rato” (bapak, ibu, guru dan pimpinan pemerintahan) sangat berpengaruh terhadap budaya hukum pelaksanaan atau penegakan sertifikasi halal. Pemerintah yang dalam budaya Madura dikenal dengan sebutan rato dan ghuru atau ulama membuat pelaku usaha mikro, kecil, dan menengah di kecamatan Pademawu kabupaten Pamekasan patuh mendaftarkan sertifikasi halal untuk produknya. (This article will discuss the application of halal certification for MSME products in the perspective of legal culture in Madura. Madurese people have a unique and strong culture in upholding principles. The Madurese community is a religious society, obedient and submissive in carrying out religious orders, in this case Islam. This form of obedience to Islamic teachings is summarized in a popular expression, namely: "bhuppa', bhabhu', ghuru dan rato" (father, mother, teacher and government leader). This research is a field research that is descriptive qualitative. The results of this study indicate that the values adhered to by the Madurese community in the form of obedience and obedience to "bhuppa', bhabhu', ghuru, and rato" (fathers, mothers, teachers and government leaders) greatly influence the legal culture of implementing or enforcing halal certification. The government, which in Madurese culture is known as rato and ghuru or ulemas, makes micro, small and medium enterprises in the Pademawu sub-district, Pamekasan district comply with registering halal certification for their products.)

Abstract

Internet of Things (IoT) currently become one of the most developing systems in the world. Private to government used it for their intelligence tools. It will support them to complete mission, such as investigations, security, and recruitment. In international intelligence, IoT concept has already used cause of its effectivity. These conditions are also supported by modern cyber era that can stored our data throughout the world digital form. Currently, China is one of the countries that is making breakthroughs in domestic law to advance its national interests. This research tries to find new points of view and compare data in the form of papers, news, research topic articles, books, and journals. It is hoped that this research can help understand the correlation between law and intelligence regarding the use of IoT in the current era of modern intelligence.

Abstract

The preparation of statutory regulations should follow established principles and norms. However, sometimes the government tends to ignore these principles, especially for reasons of development and community welfare. This article examines the conformity of Government Regulation Number 49 of 2022 with the principles and norms for the formation of statutory regulations. One of the contents of this regulation is to provide facilities for non-collection of taxes owed on imports and deliveries of gold bullion which are not for the purposes of foreign exchange reserves. Basically, these facilities aim to support the availability of certain goods and services that are strategic for national development, especially basic needs for the community. Based on normative legal research using a statutory and conceptual approach, it can be concluded that Government Regulation Number 49 of 2022 is considered to violate the authority mandated by Article 16B of the VAT Cluster Law on Harmonization of Tax Regulations.

Abstract

Halal certification is a business ethic that must be adhered to by MSMEs (producers) as a guarantee of halal food for consumers. The aim of this community service activity is to provide standard information that must be met by entrepreneurs; provide knowledge, benefits and awareness of the importance of Halal Certification for micro business actors' products as well as providing information and assistance on procedures for applying for Halal Certification for micro business actors in Burneh District, Bangkalan Regency to help and promote partners (MSMEs) in business development. The implementation method is by conducting outreach, education and mentoring on Halal Certification through the Sihalal Digital Platform to MSME actors. As a result of this community service activity, 30 business actors were assisted in applying for halal certification. Sihalal is one of the applications launched by the government to accelerate the halal certification application process in assisting partners (MSMEs) to apply for halal certification to support product competitiveness until MSME products obtain halal certificates. Assistance activities to obtain halal certificates are very important for the development of MSMEs, especially halal products that guarantee their production and distribution.

Abstract

Tindak pidana penyalahgunaan identitas diatur dalam Pasal 35 ayat (1) Jo. Pasal 51 ayat (1) Undang-Undang Nomor 19 Tahun 2016 berkaitan dengan perubahan atas Undang-Undang Nomor 11 Tahun 2008 tentang Informasi dan Teknologi. Meski demikian, pada kenyataannya masih banyak individu yang memanfaatkan identitas orang lain untuk kepentingan dan tujuan pribadi atau kolektif. Tujuan dari tesis ini adalah untuk menjelaskan faktorfaktor yang berkontribusi terhadap eksploitasi kriminal identitas orang lain melalui pemalsuan data dalam pinjaman online. Di dalamnya juga akan dikaji pertimbangan-pertimbangan hakim dalam mengambil keputusan dan dampak yang mungkin timbul jika melakukan tindak pidana tersebut. Tesis ini disusun dengan menggunakan pendekatan penelitian yuridis normatif dengan menggunakan analisis kualitatif. Temuan penelitian menunjukkan bahwa tindak pidana pencurian identitas dan pemalsuan data pada pinjaman online disebabkan oleh dua unsur yaitu variabel internal dan variabel eksternal. Selain permasalahan pendukung seperti terbatasnya pengetahuan hukum dan penyalahgunaan ilmu pengetahuan dan teknologi. Keputusan hakim ditentukan oleh faktor yuridis, khususnya terpenuhinya unsur pasal yang didakwakan dan terpenuhinya unsur pembuktian. Selain faktor non hukum seperti kesanggupan terdakwa untuk bertanggung jawab dan adanya keadaan yang memberatkan dan meringankan. Tindak pidana penyalahgunaan identitas orang lain seperti pemalsuan data dalam pinjaman online mempunyai dampak yang cukup besar baik bagi korban maupun terdakwa sehingga menimbulkan kerugian finansial.Kata Kunci: Identitas, Pemalsuan Data, Pinjaman Daring

Abstract

The large Muslim population in Indonesia has led to an increasing demand for halal meat. To ensure that the meat is slaughtered in accordance with Islamic law, JULEHA certification is essential. The importance of JULEHA certification lies in its ability to provide consumers with a guarantee that the meat they consume has been processed according to halal standards. This certification in poultry slaughtering aims to ensure that the slaughtering process complies with Islamic law, supports business sustainability, and guarantees that the raw materials used for halal meat processing are met. With the presence of JULEHA certification, the quality of products can be improved, halal integrity maintained, and consumer trust in poultry slaughtering facilities can be enhanced. This research is expected to contribute to the understanding of the importance of JULEHA certification in the culinary industry and among poultry slaughtering entrepreneurs. The method employed in this study is field research, utilizing a qualitative approach aimed at deeply understanding the significance of JULEHA in TPU Bebek Beton. The data sources used in this research include both primary and secondary data. Data collection techniques involved interviews, observations, and documentation. The results of this study indicate that JULEHA at TPU Bebek Beton possesses competency certification and has fulfilled the 13 competencies outlined in the SKNI. JULEHA has participated in training and education programs organized by Universitas Airlangga Surabaya.

Abstract

Halal certification has an important role in micro, small and medium enterprises, especially in poultry slaughtering businesses. This certification refers to the recognition that the product meets Islamic sharia standards, which is very important for Muslim consumers. A poultry slaughterhouse is a place where the process of slaughtering animals such as chickens, ducks, geese, and others that are processed for meat occurs. This poultry slaughterhouse is usually equipped with various facilities to ensure that the slaughtering is carried out hygienically and in accordance with food safety standards. In this case, halal certification is very important, because it can be used as a reference in ensuring that all meat production processes are in accordance with Islamic sharia principles. The purpose of this study was to determine how the implementation of halal certification and mandatory halal certification for Poultry Slaughtering businesses, this study is expected to make poultry slaughtering business actors aware of the importance of halal certification in micro, small and medium enterprises in the poultry slaughtering business. One of the poultry slaughterhouse s in Poter Village, Tanah Merah District, which is the main place for slaughtering poultry to be studied. The research methodology used is qualitative with a field research approach, involving interviews and direct observation at the research location.

Abstract

This study aims to analyze the potential and problems of the Mandangin Islands as a Tourism Village in Supporting the Dewi Cemara Program (Tourism Village whose Communities are Intelligent, Independent and Prosperous). The purpose of this program is to encourage rural-based economic growth centers, where activities are supported by the motivation and enthusiasm of the community and various facilities, the existence of objects and attractions, having physical access and market access, having the potential for partnerships, and the availability of public facilities. Researchers will conduct a research as a step to find out the potential and problems on Mandangin Island in supporting the Dewi Cemara Program, by determining Mandangin Village as the object of research. The approach used in this study uses a descriptive qualitative approach with a case study method, additional data collection is carried out by studying literature from various sources, both printed and statistical databases, with data collection methods in the form of interviews, observation, and documentation. The theory of identification of potentials and problems to dissect the supporting instruments of the Dewi Cemara Program on Mandangin Island. Technically, the researcher will mapping the informants consist of Head of DISPORABUDPAR Sampang, Head of POKDARWIS Sampang, Head of Mandangin Village, Tourists and the local community at Mandangin. In this case the researcher wants to absorb their aspirations. The mandatory achievement target in this research is one article published in a national scientific journal accredited at least SINTA 4.
