Abstract

This research aims to understand problems regarding pre-prosecution and prosecution as well as problems regarding the authorities in pre-prosecution and prosecution and the authority of the public prosecutor. Pre-prosecution and prosecution are two important stages in the criminal justice process which determine the smoothness of a court proceeding to achieve peace and a decision from the court. Pre-prosecution is the initial stage carried out before carrying out a prosecution by an investigator. After the investigation is complete, the investigator gives the case files to the public prosecutor to re-examine the case submitted. The prosecution stage is where the public prosecutor submits the case to court after carrying out an examination which is declared complete and at this stage the public prosecutor draws up an indictment against the suspect based on the evidence that has been submitted by the prosecutor.

Abstract

E-commerce berfungsi sebagai platform untuk penjual online, namun meskipun konsep keamanannya sudah memadai, masih terdapat celah yang memungkinkan terjadinya kecurangan, seperti penjualan barang yang tidak sesuai dengan gambar yang ditampilkan. Hal ini mencerminkan ketidakamanan posisi konsumen dalam transaksi e-commerce. Penelitian ini bertujuan untuk mengkaji perlindungan konsumen terhadap barang yang tidak sesuai dalam transaksi e-commerce di Indonesia. Seiring dengan pesatnya perkembangan e-commerce, banyak konsumen yang menghadapi masalah terkait pesanan yang berbeda dari informasi yang dijanjikan oleh penjual, sehingga isu perlindungan konsumen menjadi semakin penting. Pemahaman yang jelas mengenai hak dan kewajiban konsumen serta penjual dalam transaksi online menjadi sangat krusial. Penelitian ini menggunakan pendekatan kualitatif dengan metode studi literatur dan wawancara mendalam dengan konsumen serta pelaku e-commerce untuk mendapatkan perspektif yang lebih komprehensif. Hasil penelitian menunjukkan bahwa konsumen berhak menerima barang yang sesuai dengan gambar yang ditampilkan, dan pelaku usaha e-commerce wajib bertanggung jawab atas ketidaksesuaian tersebut sesuai dengan ketentuan dalam Undang-Undang Perlindungan Konsumen. E-commerce juga memiliki peran penting dalam memberikan saran kepada produsen untuk memastikan gambar produk yang dipasarkan menggambarkan kondisi barang secara akurat, serta mendorong penggunaan foto asli produk yang dijual guna meningkatkan transparansi dan kepercayaan konsumen. Selain itu, diperlukan peningkatan pengawasan terhadap praktik jual beli yang merugikan pembeli.

Abstract

This article examines the challenges and solutions in trademark dispute resolution in Indonesia, with a particular focus on the effectiveness of existing regulations and the implementation of alternative dispute resolution (ADR) methods, such as mediation and arbitration. While Law No. 20 of 2016 provides legal protection for registered trademarks, law enforcement in the digital era faces numerous challenges, including trademark infringements occurring on e-commerce platforms. The article demonstrates that ADR can offer a more efficient and cost-effective alternative to litigation; however, a key challenge lies in the limited awareness among business actors about the benefits of ADR. Consequently, this article recommends enhancing education for business owners, strengthening regulations related to ADR, and improving the quality of mediators and arbitrators in the field of intellectual property law. Furthermore, the article emphasizes the need for integrating technology into the dispute resolution process to improve efficiency and accessibility.

Abstract

This research aims to explore the implementation, response, and economic impact of halal certification on culinary Small and Medium-sized Enterprises (SMEs) in Burneh District, Bangkalan Regency, Indonesia. Employing a quantitative, field-based research design with a causal approach, data were collected through surveys and interviews with 12 SME owners across various business categories. The findings reveal that while awareness of halal certification and government support is relatively high, significant challenges remain in the certification process—particularly due to the lack of certified halal slaughterhouses and the complexity of procedural requirements. Despite these efforts, halal certification has not yet led to a significant increase in SMEs’ revenue, as most consumers—particularly in Muslim-majority Madura—do not actively verify the halal status of products, assuming all local culinary offerings are inherently halal. This study contributes to the global discourse on halal assurance by emphasizing the cultural, regulatory, and practical barriers to certification uptake in local economies. It recommends future research to investigate consumer behavior toward halal labeling and to assess long-term income impacts in regions with mandatory halal certification enforcement. Moreover, international comparative studies may further illuminate how halal certification contributes to economic empowerment across diverse Muslim communities.

Abstract

Penelitian ini bertujuan untuk menggali dan menganalisis peran yang dimainkan oleh Halal Center UTM dalam mengembangkan literasi halal bagi Usaha Mikro, Kecil, dan Menengah (UMKM) di Bangkalan. Penelitian ini menggunakan pendekatan kualitatif untuk memahami pengalaman dan perspektif stakeholder terkait, termasuk pelaku UMKM, perwakilan Halal Center UTM, dan konsumen. Metode penelitian yang digunakan adalah wawancara mendalam dengan responden yang dipilih secara purposif, pengamatan partisipatif, dan analisis dokumen terkait kegiatan yang dilakukan oleh Halal Center UTM. Hasil penelitian ini diharapkan dapat memberikan wawasan tentang peran yang dimainkan oleh Halal Center UTM dalam mengembangkan literasi halal bagi UMKM di Bangkalan. Dalam konteks ini, literasi halal mencakup pemahaman tentang sertifikasi halal, praktik-produksi yang halal, pemasaran halal, dan kepatuhan terhadap prinsip-prinsip halal. Temuan penelitian ini dapat memberikan kontribusi bagi pengembangan strategi dan program pendidikan yang lebih efektif untuk memperkuat literasi halal di kalangan pelaku UMKM di Bangkalan. Selain itu, penelitian ini juga berpotensi memberikan masukan bagi pemerintah dan institusi terkait dalam merancang kebijakan dan program yang berfokus pada pengembangan sektor UMKM yang berbasis halal.

Abstract

Budaya adalah hasil karya manusia dalam rangka kehidupan masyarakat untuk menciptakan cara hidup yang cocok dengan lingkungan. Atraksi budaya Sapi Sonok merupakan tradisi budaya masyarakat Madura yang menampilkan keindahan dan keangguhan sapi betina yang dihiasi dengan pernak pernik perhiasan kebesaran. Sapi Sonok bukan hanya sebagai atraksi budaya, tetapi juga menjaga kelestarian lingkungan dan kesejahteraan hewan. Ekologi Islam merupakan konsep keyakinan agama yang berkaitan dengan persoalan lingkungan yang berdasarkan ajaran Islam.  Dalam Ekologi Islam manusia di ciptakan sebagi khalifah di bumi untuk penguasa dan pengatur, seperti tumbuhan, hewan, air, gunung yang harus dijaga agar bisa memanfaatkan untuk kehidupan. Penelitian ini dilakukan di Desa Bira Timur Kecamatan Sokobanah Kabupaten Sampang, serta kunjungan kepada pihak Dinas Peternakan, Dinas Pariwisata dan Kebudayaan dengan tujuan untuk mengetahui bagaimana atraksi budaya Sapi Sonok di Sampang Madura terhadap perspketif ekologi Islam. Metode pendekatan penelitian yang digunakan adalah kualitatif deskriptif. Atraksi Budaya Sapi Sonok bukan hanya tradisi lokal, tetapi bisa menjadi media silaturahmi, memperarat persaudaraan dan nilai keindahan, hewan dipelihara dengan baik, merawat alam,dan membangun harmoni antar manusia dengan hewan dan lingkungan. Penelitian ini menunjukkan bahwa dalam atraksi budaya Sapi Sonok sudah menerapkan perspektif ekologi Islam karena budaya ini menjaga kesejateraan terhadap hewan dan lingkungan.

Abstract

At this time, technological developments have a major impact on human life in various fields, one of which has an impact on the economic sector, the purpose of this study aims to determine the effect of e-payment on consumer behavior through purchases in the marketplace. The method used in this research is quantitative, relying on the distribution of questionnaires with several questions contained in geogle form media and supporting articles related to the research theme. The results of the study prove that the existence of one of the products in the current economic field, namely e-payment, greatly affects the consumptive behavior of consumers. Because in its application e-payment is very effective and makes it easier for buyers and sellers to make a transaction.

Abstract

This Community Service Program (Pengabdian kepada Masyarakat/PKM) focuses on strengthening the regulatory framework and management capacity of Village-Owned Enterprises (BUMDes) as a strategic instrument for local economic development. The program aims to optimize BUMDes management in fostering a creative, tourism-based village in Pademawu Timur Village, Pamekasan Regency. The main challenges faced by the community partner include limited understanding among BUMDes managers and village stakeholders regarding the roles, governance mechanisms, and regulatory foundations of BUMDes in supporting social services and sustainable village economic development. The program employed a participatory and sustainable community development approach involving 28 participants, consisting of BUMDes managers, village officials, local MSME actors, and community representatives. The activities were implemented through three sequential stages: (1) socialization of BUMDes roles and regulatory frameworks; (2) educational sessions on BUMDes governance, collaborative governance, and the entrepreneurial ecosystem; and (3) training and mentoring on optimizing BUMDes management through the integration of village tourism potential and local MSMEs. The results indicate a significant improvement in participants’ awareness and understanding of BUMDes as a village economic institution oriented not only toward profit generation but also toward community empowerment, professional governance, and business sustainability. This program is expected to strengthen BUMDes institutional capacity, promote the development of competitive village-based tourism, and contribute to inclusive and sustainable improvements in community welfare and the local village economy.

Abstract

International trade law is part of international law. Therefore, various imperfections or weaknesses of international law are also affected in the field of international trade law. This article will explain why the state in conducting international trade needs to comply with international trade law. This article argues that the reason for the states to obey international trade law is due to the belief that obedience will benefit the interests of the country itself. The next reason is that there are fundamental principles within the scope of international treaties, which are the source of law from international trade law, namely the principle of good faith. A state that is bound in the international trade agreement shall implement the provisions of the treaty by contents, soul, purpose, and purpose of the treaty itself, respecting the rights and obligations of each party.

Abstract

The difficulties in preparing accountable financial reports, planning business development strategies, and managing business operations effectively remain major challenges faced by the managers of the Village-Owned Enterprise (BUMDes) in Poter Village, Tanah Merah District, Bangkalan Regency. These limitations have hindered the optimal growth of several business units, with some experiencing stagnation and limited contribution to local economic development. The condition indicates that strengthening managerial and financial management capacities is essential to improve the performance and sustainability of BUMDes. This community service activity aims to enhance the capacity of BUMDes managers through a structured training program. The implementation methods include preliminary observation, training sessions, mentoring, and evaluation through interviews and documentation. The training materials focus on business management, basic accounting, and financial reporting preparation. This activity is also aligned with the Sustainable Development Goals initiated by the United Nations, particularly Goal 1 (No Poverty), Goal 8 (Decent Work and Economic Growth), and Goal 9 (Industry, Innovation, and Infrastructure). By strengthening managerial and financial capacities, this program contributes to improving income-generating activities, fostering local entrepreneurship, and supporting sustainable rural economic development. The results show an improvement in participants’ understanding and skills in business management, as well as increased awareness of the importance of proper administration and financial reporting. Participants also demonstrated positive responses to the program. Furthermore, the outcomes of this program indicate its contribution to achieving SDGs targets at the village level, especially in enhancing economic resilience and institutional capacity of community-based enterprises. Therefore, this training and mentoring activity is effective in strengthening the capacity of BUMDes managers and contributes to improving performance and sustainability of village enterprises. Similar programs should be conducted continuously to ensure optimal development of BUMDes and to enhance rural community welfare.
