Abstract

The renewal of the Criminal Procedure Code (KUHAP) through the Draft Law (RUU) KUHAP opens up space for in-depth philosophical reflection on the relationship between law, justice, and humanity. This article examines the challenges of harmonizing the principle of due process of law, which emphasizes respect for individual rights in every legal process, with the criminal justice system, which is oriented towards efficiency and the purpose of punishment. This harmony is not only a technical and normative matter, but also a matter of shared understanding of what is meant by justice in the context of a more humane and human rights-based criminal justice system. Using a philosophical legal perspective, this article explores the potential for conflict and convergence between the two principles, and seeks common ground within the framework of Pancasila legal values ​​and Islamic law that prioritize humanity, substantive justice, and a balance between individual rights and the public interest. The renewal of the RUU KUHAP, in this context, is not merely a structural change, but a journey towards a legal system that guarantees the depth of justice, which is not only seen from a procedural perspective, but also from the moral and social essence of the law itself.

Abstract

Penelitian ini membahas sinergi antara hukum dan pendidikan dalam memberikan perlindungan bagi pekerja kontrak di Indonesia. Pekerja kontrak merupakan salah satu kelompok tenaga kerja yang sering menghadapi permasalahan terkait status hukum, ketidakpastian kerja, serta keterbatasan dalam memperoleh hak-hak normatif sebagaimana diatur dalam peraturan ketenagakerjaan. Meskipun Undang-Undang Nomor 13 Tahun 2003 tentang Ketenagakerjaan dan peraturan turunannya telah memberikan kerangka hukum, implementasi di lapangan kerap menunjukkan adanya celah yang melemahkan posisi pekerja kontrak. Oleh sebab itu, diperlukan suatu pendekatan interdisipliner yang mengintegrasikan dimensi hukum dan pendidikan untuk memberikan perlindungan yang lebih komprehensif. Metode penelitian yang digunakan adalah penelitian hukum normatif dengan pendekatan kualitatif, melalui telaah terhadap peraturan perundang-undangan, doktrin, dan praktik ketenagakerjaan, serta diperkaya dengan kajian pendidikan yang menekankan pentingnya literasi hukum bagi pekerja. Hasil penelitian menunjukkan bahwa perlindungan hukum terhadap pekerja kontrak belum sepenuhnya efektif karena lemahnya pengawasan, rendahnya pemahaman pekerja mengenai hak-haknya, serta masih adanya praktik penyalahgunaan kontrak oleh pemberi kerja. Dalam konteks ini, pendidikan berperan sebagai instrumen penting untuk meningkatkan kesadaran hukum pekerja kontrak, baik melalui pendidikan formal, nonformal, maupun pelatihan berbasis keterampilan hukum dan ketenagakerjaan. Kesimpulan penelitian ini menegaskan bahwa sinergi hukum dan pendidikan merupakan strategi yang relevan untuk memperkuat perlindungan pekerja kontrak. Hukum memberikan kerangka normatif yang mengikat, sedangkan pendidikan membentuk kesadaran dan keberdayaan pekerja dalam menuntut hak-haknya. Dengan demikian, perpaduan keduanya diharapkan mampu mewujudkan keadilan sosial dan meningkatkan kesejahteraan pekerja kontrak di Indonesia.

Abstract

This study examines the synergy between law and education in providing protection for contract workers in Indonesia. Contract workers are one group of workers who often face problems related to legal status, job insecurity, and limitations in obtaining normative rights as stipulated in labor regulations. Although Law Number 13 of 2003 concerning Manpower and its derivative regulations have provided a legal framework, implementation in the field often shows gaps that weaken the position of contract workers. Therefore, an interdisciplinary approach is needed that integrates legal and educational dimensions to provide more comprehensive protection. The research method used is normative legal research with a qualitative approach, through a review of labor laws, doctrines, and practices, and enriched with educational studies that emphasize the importance of legal literacy for workers. The results of the study indicate that legal protection for contract workers is not fully effective due to weak supervision, workers' low understanding of their rights, and the ongoing practice of contract abuse by employers. In this context, education plays a crucial role in increasing legal awareness among contract workers, through formal and informal education, as well as skills-based training in legal and employment law. The conclusion of this study confirms that the synergy between law and education is a relevant strategy for strengthening the protection of contract workers. The law provides a binding normative framework, while education fosters workers' awareness and empowerment in demanding their rights. Therefore, the combination of the two is expected to achieve social justice and improve the welfare of contract workers in Indonesia.

Abstract

This study examines the practice of outsourcing in Indonesia as a form of hidden exploitation in employment relationships. Initially intended to improve company efficiency and create workforce flexibility, outsourcing often creates serious problems related to the protection of workers' rights. Many outsourced workers face status uncertainty, inadequate wages, limited access to social security, and even discrimination compared to permanent workers. These conditions demonstrate the potential for exploitation that contradicts the principles of social justice as mandated by the 1945 Constitution of the Republic of Indonesia and labor norms. The research method used is a normative juridical approach with a statutory and conceptual approach. Legal sources include primary legal materials in the form of relevant laws and regulations, particularly Law Number 13 of 2003 concerning Manpower and its amendments, Constitutional Court Decisions, and other derivative regulations. Secondary legal materials in the form of doctrine, labor law literature, and previous research findings are used to enrich the analysis. The results indicate that outsourcing regulations in Indonesia still leave room for ambiguity that companies can exploit to oppress workers. Inconsistencies between laws, government regulations, and on-the-ground practices weaken workers' bargaining power. This research confirms that outsourcing practices that fail to address worker protection principles have the potential to become a form of hidden exploitation, necessitating consistent law enforcement and the formulation of policies that better support social justice and worker welfare.
