Abstract

Pelayanan perizinan menggunakan sistem manual dikhawatirkan dapat membuat data yang tersimpan pada perangkat komputer menjadi lebih beresiko atau hilang, dan juga membuat masyarakat harus datang ke kantor untuk mengetahui persyaratan apa saja yang harus dibawa ketika akan mengajukan permohonan, menghabiskan biaya yang cukup besar, dan waktu penyelesaian yang kurang jelas. Sehingga Dinas Penanaman Modal dan Pelayanan Terpadu Satu Pintu (DPMPTSP) Kota Pekalongan pada bulan Desember 2017 meluncurkan sebuah sistem perizinan berbasis online yaitu Sistem Perizinan Online, Ringkas dan Ekonomis (SAKPORE) agar masyarakat Kota Pekalongan dapat mengurus perizinan usahanya secara online. Melihat permasalah tersebut tujuan penelitian ini adalah untuk mengetahui kemudahan pelayanan perizinan dengan menggunakan sistem SAKPORE. Metode analisis data yang penulis lakukan yaitu menggunakan teknik analisis data yang dikemukakan oleh Miles dan Huberman mencakup reduksi data, penyajian data, dan menarik kesimpulan. Hasil penelitian penulis, kemudahan pemohan dalam menggurus perizinan secara online dengan menggunakan sistem SAKPORE di Dinas Penanaman Modal dan Pelayanan Terpadu Satu Pintu (DPMPTSP) Kota Pekalongan dapat meringkas prosedur pelayanan, waktu penyelesaian pelayanan, dan biaya penyelesaian pelayanan.

Abstract

This study aims to describe the mechanism for administering Financial Institution Pension Funds at Bank Muamalat Pekalongan and analyze the compliance of its management with Fatwa MUI No. 88/DSN-MUI/XI/2013. This research employs an empirical juridical method with a qualitative approach to gain an in-depth understanding of the implementation of sharia principles in pension fund management at Bank Muamalat Pekalongan. The findings indicate that Bank Muamalat Pekalongan has implemented the Financial Institution Pension Fund (DPLK) program in accordance with the regulations set forth in Fatwa DSN-MUI No. 88/DSN-MUI/XI/2013 general guidelines for implementing pension programs based on sharia principles , covering fund collection from participants, investment management following sharia principles, and pension benefit distribution to eligible participants. Bank Muamalat also applies the DPLK mechanism in compliance with Fatwa DSN-MUI provisions, including the use of sharia contracts such as Wakalah Bil Ujrah in fund management. Additionally, investments are made solely in halal financial instruments and are supervised by the Sharia Supervisory Board (DPS) to ensure adherence to sharia principles.

Abstract

Kurangnya pengetahuan masyarakat mengenai program bantuan hukum menjadi salah satu penghambat dalam pelaksanaan Undang-Undang Nomor 16 Tahun 2011 Tentang Bantuan Hukum, walaupun pemerintah telah berupaya untuk melakukan sosialisasi dan penyebarluasan informasi, namun masih dirasakan kurang. Masih banyak masyarakat Kabupaten Pekalongan yang belum mengetahui program pemberian bantuan hukum gratis bagi masyarakat miskin didalam hal menghadapi masalah hukum. Berdasarkan latar belakang diatas menarik dan penting untuk diteliti tentang pemenuhan hak konstitusional fakir miskin di Kabupaten Pekalongan dalam mendapat bantuan hukum secara cuma-cuma atau gratis. Pendekatan yang digunakan adalah pendekatan kualitatif, pendekatan perundang-undangan dan konseptual. Teknik pengumpulan dilakukan melalui observasi, wawancara dan dokumentasi. Hasil menunjukkan bahwa pelaksanaan layanan bantuan hukum gratis dilakukan sesuai dengan Peraturan Bupati Pekalongan Nomor 39 Tahun 2018 Tentang Perubahan Atas Peraturan Bupati Pekalongan Nomor 12 Tahun 2016 Tentang Petunjuk Pelaksanaan Peraturan Daerah Kabupaten Pekalongan Nomor 2 Tahun 2015 Tentang Bantuan Hukum Untuk Masyarakat. Akan tetapi dilihat dilihat dari realitas Pemenuhan Hak Konstitusional Fakir Miskin di Kabupeten Pekalongan masih ditemukan kendala-kedala yang berasal dari kalangan masyarakat di Kabupaten Pekalongan.

Abstract

Post-pandemic COVID-19 still leaves Non-Performing Financing (NPF), especially financing with fiduciary guarantees in Sharia finance companies. The Otoritas Jasa Keuangan's Relaxation Policy, which ended in April 2023, has not been effective and has fulfilled a sense of justice for debtors. This research discusses the causes of the ineffective implementation of the Relaxation policy in Sharia Financing Companies so that there is still NPF post the Covid-19 pandemic. Furthermore, it discusses the settlement model of NPF as an offer so that is more effective and fulfils a sense of justice for the parties. This empirical juridical research uses a qualitative approach in collaboration with statutory and conceptual approaches. The research locations were nineteen financing companies in Pekalongan ex-Residency with fiduciary financing objects. Data collection uses focus group discussions, interviews and document studies. The results show that inconsistent norms, negative legal culture, misperceptions of restructuring diction as the write-off of debt and the debtor's objection in the settlement of NPF are the causes of the ineffective implementation of the Relaxation policy. The settlement of NPF should be carried out based on sharia principles, the principle of prudence and good faith which prioritizes the needs of the debtor. Determining the rescheduling period should be carried out using a tri-semester tiered model so that effectivity, justice and benefits (reciprocal benefits) will be realized between the two parties.

Abstract

Islamic financial inclusion in Indonesia remains relatively low among the unbanked and underbanked populations, who have limited access to formal banking services. This condition necessitated Bank Syariah Indonesia to introduce a branchless banking initiative, known as BSI Smart, which is integrated with mosques to expand equitable access to Islamic financial services. Therefore, this study aimed to analyze the effectiveness of implementing a branchless banking policy integrated with mosques to increase Islamic financial inclusion. The analysis adopted qualitative methods, collecting data through interviews and questionnaires. Interviews were conducted with 10 informants selected purposively. Questionnaires were further administered to 100 respondents in rural areas and 100 in urban areas who were randomly selected. Correlating with the theories of Edwards and Metter-Horn, this study showed that implementing branchless banking policy through mosques remained ineffective due to inaccurate targeting, limited facilities and infrastructure, suboptimal communication, and the community's socio-economic conditions, which tended to favor informal financial institutions. The novelty of the analysis lay in the integration of mosques as centers for Islamic financial literacy and education, directly connected to BSI Smart agents. This allowed mosques to serve as places of worship and centers of economic empower­ment for the community. Additionally, the model had the potential to become a new strategy in expanding the reach of Islamic banking that was more inclusive, sustainable, and in accordance with Islamic principles.

Abstract

This study explores the dilemmas faced by undocumented Indonesian migrant workers in deciding whether to comply with the law and examines the characteristics of their legal compliance and non-compliance through a multidisciplinary approach. Using a sociolegal method, interviews were conducted with purposively selected undocumented Indonesian migrant workers. Furthermore, a survey was conducted by administering questionnaires to 50 undocumented Indonesian migrant workers using online media channels. The findings reveal that undocumented Indonesian migrant workers who chose to disobey the law did so mainly because of their distrust in the legal system, rather than as a result of conscious or reflective reasoning.  This is illustrated by the reasons for doubt, lack of funds, cost, fear of deportation, fear of punishment, fear of being blackmailed by officers, fear of being blocked, and fear of being unable to work abroad. Collaborative strategies and approaches based on the principles of justice, benefit, and trust are key to resolving the challenges facing undocumented Indonesian migrant workers. Fair implementation of laws and policies that provide tangible benefits to the community fosters trust in the legal system. This trust ultimately eliminates migrant workers' hesitation to comply with the law. These findings contribute to the efforts of policymakers, international organizations, and non-state actors to strengthen the governance of cross-border migration, particularly for migrant workers.

Abstract

This study analyzed the strategic policies for preventing early marriage in Rembang Regency. This evaluative study used interviews, questionnaires, and document studies methods for data collection. The result of the study showed that the gender-integrated early marriage prevention policy in Rembang district can be seen in regulations, budgets, the strengthening of child groups, institutions, and cooperation. Sufficient budget and human resources and the openness of information systems, were the strengths of the policy on preventing early marriage in this area. Otherwise, the partial activities, lacked of monitoring and evaluation, a commitment to gender mainstreaming was not yet optimal, a gender-biased organizational culture, the politics of budget that often changed, and the children's forum less active were the weaknesses in this policy. The national and international policies; discipline by the population administration; gender and child disaggregated data; the technology of information; collaboration with NGO and the private sector were the opportunities that must be considered for the success of this policy. On the other hand, we must watchful to policy threats, such as: lack of education, high poverty level, patriarchy, early marriage traditions, “ngemblok” tradition, the technology of information, the age limit for marriage has changed, the community involvement was very minimal, unbalanced of gender insight, and lack of understanding on children’s rights. The early marriage prevention policy has impacted the target groups, non-target groups, and direct and indirect costs. Optimization of early marriage prevention policies should be done by using Scheme 1, maximizing strengths to minimize the threats; Scheme 2, optimizing gender equality in regional apparatus organizations; and Scheme 3, monitoring and evaluation periodically and structurally. These schemes must pay attention to the five "rights". These five righst were choose the right policy and program, the right implementation, the right target, the right environment, and the last was the right process.
