Abstract

This book is written by Professor Graham Greenleaf, an expert in the field of privacy law from Faculty of Law, University of New South Wales, Sydney, Australia. This book compiles his research and advocacy in Asias privacy development since 1970, as well as his writings on Asian Privacy Development in Privacy Laws & Business International Report. This book is the result of his long collaboration with many privacy law experts from many States in Asia and has been published in numerous books and journals. The book is written because the author believes that privacy in its many forms is worth protecting as one of the rights protected under human rights laws. Abstract

Within the last five years it is noted that the people of Indonesia has become more aware of their privacy on personal data since their personal data is being collected, distributed and disseminated without their prior consent both  by the government  and businesses and their co-ventures . These businesses tend to commit violations by using and disseminating customers’ data without the consent of their respective customers. This article focuses on Indonesian legal framework on the Privacy on personal data. It is argued that although there is existing laws in the privacy on personal data, however, those legal framework still developed in very sectoral nature. It is submitted that the most suitable regulatory concept for Indonesia is a combination regulatory concept, or hybrid concept., which protect Indonesian’s and foreigner parties’ interests privacy on personal data.  To investigate existing laws in personal data protection, this research examines both national as well as international and regional legal framework in personal data protection. Comparison between Indonesia and the practice of other ASEAN states is also conducted to determine the most suitable approaches in addressing the protection of personal data.

Abstract

ABSTRAKVirus COVID-19 sedang menjadi perhatian utama dunia hingga saat ini. Terkait pencegahan penyebarannya, Pemerintah Indonesia melakukan beberapa upaya, salah satunya dengan menerapkan digital contact tracing menggunakan aplikasi pelacakan. Pada pelaksanaannya, aplikasi pelacakan (contact tracing) mengumpulkan data pribadi seseorang (seperti nama lengkap, NIK, nomor telepon pribadi dan e-mail pribadi), yang sangat berpotensi akan terjadinya pelanggaran data pribadi. Selain menggunakan aplikasi pelacakan, metode digital contact tracing juga kerap dilakukan oleh pihak swasta dengan penginputan data pengunjung pada public places. Melalui tulisan dengan metode yuridis normatif ini, penulis akan membahas ketentuan hukum perihal data pribadi yang akan dihubungkan dengan penerapan digital contact tracing. Penulis juga akan melakukan kajian serupa pada negara Singapura, sebagai negara pertama yang menerapkan digital contact tracing melalui aplikasi pelacakan dan sebagai negara tetangga Indonesia.  Penulisan ini terlebih dahulu akan melihat apakah penerapan digital contact tracing di Indonesia dengan aplikasi pelacakan yang ada, telah sesuai dengan prinsip-prinsip perlindungan data pribadi. Berdasarkan hasil penelitian, penerapan digital contact tracing di Indonesia dengan aplikasi pelacakan melanggar beberapa prinsip terkait data pribadi. Peraturan data pribadi di Indonesia sendiri secara khusus masih sebatas peraturan menteri. Berbeda dengan Singapura, telah menjamin perlindungan data pribadi masyarakatnya melalui Personal Data Protection Act dan Public Sector Governance Act 2018, dan mengenai tanggung jawab pada data pribadi, di Indonesia masih sebatas sanksi administratif, sementara di Singapura, sampai pada pertanggungjawaban pidana.Kata Kunci: Data Privasi; Aplikasi Contact Tracing; Digital Contact Tracing; COVID-19

Abstract

ABSTRAKImplementasi aplikasi berbasis Internet of Things (IoT) di bidang kesehatan memudahkan para pihak baik itu pihak Pasien maupun Dokter tetapi karena data yang dihimpun merupakan data kesehatan seseorang yang termasuk ranah privasi, maka perlu dicermati sistem keamanan IoT serta perlindungan dan upaya hukum yang dapat dilakukan Pasien dalam mencari keadilan jika data yang terekam dalam sistem IoT tersebut bocor dan terjadi penyalahgunaan. Metode yang digunakan dalam penulisan artikel ini bersifat penelitian yuridis normatif dengan pendekatan perundang-undangan (Statue Approach) dan pendekatan konseptual (Conceptual Approach). Hasil pembahasan menunjukkan bahwa Pasien dapat melakukan upaya hukum dengan melihat terlebih dahulu kedudukan dan tanggung jawab masing-masing pihak yang tertuang dalam data processing contract sehingga gugatan pebuatan melawan hukum (Pasal 1365 KUHPerdata) ataupun tuntutan pidana (UU ITE j.o. UU Keterbukaan Informasi Publik j.o. UU Praktik Kedokteran) tidak menjadi salah sasaran dan tepat dalam mencari keadilan bagi Pasien sebagai konsumen jasa layanan kesehatan. Pengawasan oleh pemerintah dalam hal ini yang membidangi teknologi, informasi dan komunikasi adalah Kementerian Komunikasi dan Informatika masih belum maksimal terkait penggunaan IoT dalam sektor kesehatan dengan dibuktikan minimnya aturan-aturan terkait IoT.Kata kunci: Internet of Things, Pasien, Perlindungan Data Pribadi

Abstract

ABSTRAKPerkembangan teknologi terus mengalami perkembangan dengan sangat pesat, salah satunya yaitu dalam sistem perdagangan secara elektronik yang selanjutnya disebut e-commerce. Seiring dengan hal tersebut, muncul  kekhawatiran konsumen mengenai data pribadi yang di simpan oleh perusahaan marketplace, sehingga diperlukan perlindugan hukum bagi para konsumen daring. Kajian ini bertujuan untuk memberikan rekomendasi yang tepat bagi pemerintah dan pemangku kepentingan lainnya dalam membuat kebijakan terkait dengan perlindungan data pribadi konsumen daring di Indonesia. Kajian ini dilakukan secara kualitatif melalui studi literatur. Hasil dari kajian ini menghasilkan rekomendasi untuk kebijakan terkait dengan penerapan prinsip strict liability.  Kata Kunci: Marketplace, Perlindungan data, Privasi, Perlindungan Konsumen, Tanggung Jawab.

Abstract

The uncertain conformity between the characteristics of the condition attributable to the inability of mergers and acquisition contract performance due to COVID-19 and the characteristics of force majeure and hardship leads to the use of material adverse change (MAC) as an alternative clause for contract non-performance as a perennial consequence of COVID-19 pandemic in the post pandemic era. This study aims to analyze the implications of COVID-19 pandemic with the use of MAC according to the laws of the nations and the adherence of MAC as a clause with UNIDROIT’s six general principles of international contract during and post pandemic as issued in UNIDROIT Principles of International Commercial Contract. The method of writing used was normative juridical approach with descriptive analytical research specifications. The writing process taken in drafting this study was through a process of literature review from primary, secondary, and tertiary sources. Data analysis method used in this study was through qualitative juridical normative method. The outcome of the analysis shows that the use of MAC as an alternative clause for contract non-performance differs between one national law to another; one of the outstanding characteristics is that the basis of the use of MAC depends on the agreed definition and the burden of proof of MAC set forth in the contract. The use of MAC as an alternative clause for contract non-performance in mergers and acquisitions is compliant with UNIDROIT’s principles of international contract, with considerations of the limitations and exceptions of the international contract principles.

Abstract

The rise of exchange rates other than the official state currency in the digital world raises its own problems. The development of the digital economy that is currently developing is supported by digital economic infrastructure, one of which is the official state medium of exchange. Therefore, this is a demand for the public's need for official state exchange instruments that can apply in the digital world. This was then answered by Bank Indonesia through the concept of Digital Rupiah and its derivatives in various Bank Indonesia Regulations. However, there are problems regarding the Digital Rupiah policy and the implementation of secure use of the Digital Rupiah sistem. This research was conducted using a normative juridical method, and the writing stage was carried out through a literature search which was carried out by examining secondary data including primary legal materials, literature, articles, opinions and teachings of experts and their implementation in laws and regulations. Based on the discussion, it can be concluded that policies related to Digital Rupiah as a modernization of financial market infrastructure are still contained in various regulations, including Law Number 4 of 2023, Bank Indonesia Regulation Number 23/11/PBI/2021, and Bank Indonesia Regulation Number 23/10 /PBI/2021. Digital Rupiah security arrangements in Indonesia refer to Bank for International Settlements (BIS) guidelines and include secure technology infrastructure, cloud-based cybersecurity services, risk management and compliance sistems, as well as application and infrastructure security integration through DevSecOps. Reliability certificates are regulated in Government Regulation Number 71 of 2019.

Abstract

This article discusses the Maqāshid al-Sharī'ah approach to protecting personal data in the context of structural leadership training. Maqāshid al-Sharī'ah, as a framework of Islamic legal principles, provides a strong foundation for understanding and implementing personal data protection in leadership training. This article elucidates how the training institution can incorporate measures to safeguard participants’ personal data in leadership structural training in accordance. This study employs a normative legal approach, scrutinizing the personal data protection act and structural leadership training maintenance guidelines through qualitative prescriptive research methods. It collects data from observations and relevant reference documents and employs deductive data analysis techniques. The results of this study indicate that implementing these principles requires strict policies, sophisticated security technology, staff training, and awareness about the importance of personal data. By considering the alignment between data protection and Maqāshid al-Sharī'ah, this research aims to contribute to a more robust data governance framework within leadership development programs. To implement this protection, the contribution of an officer who can serve as a data protection officer for participants in structural leadership training is required.

Abstract

Smart contract merupakan suatu teknologi tergolong baru dalam umat manusia. Penggunaannya diharapkan lebih efesien dan murah biaya. Hal ini dikarenakan tidak adanya pihak ketiga, seperti pemerintah, pengadilan, dan broker yang dapat mengintrupsi smart contract. Dikarenakan adanya sifat kemandirian tersebut, pelaku tindak pidana dapat dengan mudah menggunakan smart contract sebagai wadah dalam melakukan hubungan kontraktual tanpa adanya yang mengawasi. Penulisan hukum ini dibuat atas dasar tujuan untuk mengetahui terkait keabsahan dalam pelaksanaan smart contract apabila ditinjau dari ketentuan dalam KUHPerdata dan UU ITE, serta menganalisis terkait tindakan hukum yang dapat dilakukan apabila terdapat perbuatan melawan hukum dalam isi smart contract ditinjau dari ketentuan dalam hukum positif di Indonesia.
