Abstract

ABSTRAKWaralaba merupakan pola kemitraan usaha sekaligus sarana untuk memperluas pemasaran barang dan/atau jasa juga sarana pemberdayaan UMKM. Perkembangan waralaba tidak hanya yang bersifat konvensional namun berkembang pula waralaba berdasarkan system syariah (waralaba syariah). Perjanjian waralaba pun terbagi dalam dua katagori yaitu perjanjian waralaba konvensional dan perjanjian waralaba syariah. Perjanjian (akad) waralaba bersifat standard, namun bagaimana penerapan prinsip keseimbangan (taswiyah) berdasarkan Kompilasi Hukum Ekonomi Syariah pada akad waralaba syariah. Hasil analisis menunjukan bahwa prinsip keseimbangan (taswiyah) dalam Kompilasi Hukum Ekonomi Syariah diterapkan dalam Perjanjian (akad) waralaba berdasarkan sistem syariah dengan pembuktian bahwa pada akad waralaba syariah mengutamakan taawun (tolong menolong), menghilangkan franchisee fee dan royalty fee, adanya kedudukan yang setara antara pemberi waralaba dan penerima waralaba, adanya keseimbangan hak dan kewajiban baik dari sisi kuantitas maupun kualitas, serta pembagian keuntungan dan risiko (profit and risk sharing) antara pemberi waralaba dengan penerima waralaba sehingga menjadi sarana sesungguhnya dalam pemberdayaan UMKM. Guna lebih memastikan diterapkannya prinsip keseimbangan (taswiyah) maka sebaiknya dalam perancangan akad waralaba syariah memperhatikan masukan dari penerima waralaba (UMKM), dipublikasi melalui media sebelum diberlakukan, mengingat stigma masyarakat UMKM bahwa perjanjian waralaba bersifat standar dan lebih dominannya kepentingan pemberi waralaba dibandingkan penerima waralaba.Kata Kunci: akad, keseimbangan, risiko, syariah, waralaba. ABSTRACTFranchise is a pattern of business partnership as well as means to add goods and/or facilities for the empowerment of UMKM. The growth of franchise is not only conventional but also developing a franchise system based on sharia (sharia franchise). Meet the franchise was divided into two categories namely conventional franchise agreement and sharia franchise agreement. Agreement (akad) franchise is standard, but how to do the principle of balance (taswiyah) based on Compilation of Economic Law on sharia franchise contract. The results show that the principle of equilibrium (taswiyah) in the Compilation of Islamic Economic Law is given in the agreement (akad) based on the syariah system by proving in the shariah franchise contract prioritizing taawun (please help), eliminating the franchise’s fee and royalty fee, including the position given between the franchisor and recipients of franchises, guarantees and responsibilities both in terms of quantity and quality, as well as profit and risk sharing (profit sharing and risk) between franchisor and franchisor become an important tool in the empowerment of MSMEs. To further emphasize the application of the principle of balance (taswiyah), in the sharia franchise agreement, consider the input of the franchise recipients (UMKM), published through the media before it is enacted, given the stigma of UMKM community that the franchise agreement is the standard and franchisor is more dominant than franchisee.Keywords: akad, balance, risk, franchise, sharia.DOI :  https://doi.org/10.23920/jbmh.v2n2.13

Abstract

Haji pada hakikatnya  merupakan rukun Islam yang kelima dan suatu perjalanan dengan menyerahkan diri sepenuhnya kepada Allah Swt serta mengharapkan ridho Allah Swt. Antusiasme masyarakat sangat tinggi, yang menimbulkan banyaknya dana yang terhimpun dan berakibat pada lamanya masa keberangkatan haji hingga belasan tahun. Dana haji yang terhimpun dikelola dan dipergunakan oleh Badan Pengelola Keuangan Haji (BPKH) di beberapa sektor yaitu, produk perbankan, surat berharga, emas, Investasi langsung, dan investasi lainnya. Penggunaan dana haji oleh BPKH di sektor infrastruktur bertolak belakang dengan tujuan penggunaan pada Pasal 3 UU No. 34 Tahun 2014, untuk meningkatkan pelayanan penyelenggaraan ibadah haji dan demi kemaslahatan umat Islam. Penelitian ini dilakukan dengan pendekatan yuridis normatif, bersifat deskriptif analitis. Teknik pengumpulan data yaitu penelitian kepustakaan dan penelitian lapangan. Hasil penelitian yang dilakukan menunjukkan bahwa penggunaan dana haji dalam membiayai pembangunan infrastuktur menjadi tanggung jawab penuh BPKH apabila terjadi kerusakan yang mengakibatkan kerugian, BPKH bertanggungjawab secara tanggung renteng. Apabila menimbulkan atau melahirkan profit (benefit), keuntungan yang diperoleh  harus dibagi dengan calon jamaah haji waiting list selaku pemilik modal, dengan sistem bagi hasil mudharabah. Hal ini sebagai pelaksanaan nilai manfaat oleh BPKH.Kata kunci : Bagi Hasil, Dana Haji, Haji, Tanggung Jawab.

Abstract

Talent Pool on the appointment of BUMN Directors that has been implemented at this time still leaves problems. This research aims to know how the application of the Talent Pool on the appointment of Directors of PLN (Persero) viewed from Good Corporate Governance and the implications for compliance and performance aspects. The research method used in this study is a normative juridical approach which is done analytically descriptive. The results showed there were still mismatches in the application of the Talent Pool on the appointment of the Directors of PLN (Persero) to several GCG principles that are transparency principle related to the need for an information system to appoint Directors of BUMN which is transparent and accountable, accountability principle is relating to the need for the development of a performance appraisal system for Directors, BoC and Shareholders and the accountability arrangements for professional institutions or teams formed by the Minister of BUMN in conducting due diligence and propriety tests for candidates for the BoD and independence principle is relating to the process of appointing BUMN Directors which must be done in stages by involving the final assessment by Tim Penilai Akhir. The implications of the application of the Talent Pool that applies GCG principles have a significant impact on compliance and performance aspects, this is evidenced by increased compliance with applicable laws and regulations through prevention of acts against the law and increased performance through company profitability.

Abstract

ABSTRAKPerkembangan teknologi terus mengalami perkembangan dengan sangat pesat, salah satunya yaitu dalam sistem perdagangan secara elektronik yang selanjutnya disebut e-commerce. Seiring dengan hal tersebut, muncul  kekhawatiran konsumen mengenai data pribadi yang di simpan oleh perusahaan marketplace, sehingga diperlukan perlindugan hukum bagi para konsumen daring. Kajian ini bertujuan untuk memberikan rekomendasi yang tepat bagi pemerintah dan pemangku kepentingan lainnya dalam membuat kebijakan terkait dengan perlindungan data pribadi konsumen daring di Indonesia. Kajian ini dilakukan secara kualitatif melalui studi literatur. Hasil dari kajian ini menghasilkan rekomendasi untuk kebijakan terkait dengan penerapan prinsip strict liability.  Kata Kunci: Marketplace, Perlindungan data, Privasi, Perlindungan Konsumen, Tanggung Jawab.

Abstract

This study aims to compare and analyze macro health policies in Indonesia with those in Taiwan and Singapore. The results of the comparison and analysis will be used as lessons learned and input for improving health policies in Indonesia in the future. Health policies in the form of the BPJS Kesehatan program have not optimally improved the health of the Indonesian people in terms of services, medicines, medical personnel, and health facilities. Taiwan is the country with the most superior health services in the world in 2024 and Singapore is the country with the best health system in the world in 2023. Through a normative legal research method with qualitative legal data analysis, it is known that the health policies implemented by the Taiwanese and Indonesian governments are almost the same, namely using an insurance mechanism with contributions from participants, the government and the private sector, but the differences in the reach and standardization of health services in Taiwan are wider in scope compared to Indonesia, while the Singaporean government in its health policy implements four programs, namely medisave, medishield, medifund, eldershield with control over increasing health financing from the government. Health policies in Taiwan are easier for the Indonesian government to apply in perfecting the BPJS Kesehatan program than those implemented by Singapore because both have implemented health policies through mandatory insurance programs. BPJS Kesehatan must improve its service management and the government needs to increase the number of health facilities and standardization of health facilities by adjusting its characteristics as an archipelagic country. Formulate fair premi for participants so that participants get optimal health services. Health promotion must be encouraged to increase public health awareness. The health omnibus law as a national legal strategy can be used as a trigger to harmonize overlapping health policies so that health programs can be implemented optimally which has an impact on improving the health of the Indonesian people.

Abstract

This research aims to find out and see the connection between operational patterns in mineral and coal mining activities in Indonesia, downstream policies, as well as reclamation and post-mining implementation. Mining activities cause negative impacts in the form of serious environmental damage which occurs in almost all mining areas in Indonesia. From a regulatory perspective, mining companies and mining service companies are obliged to implement good mining principles with administrative sanctions for those who violate them, mining companies are obliged to carry out downstream within the country so as to provide added value and expand employment opportunities, mining companies are also obliged to carry out reclamation and post-mining at a high level. higher. 100% success. Using normative juridical research methods and qualitative juridical analysis, it is known that the operational cooperation pattern is not appropriate to apply because, in the operational cooperation agreement, the position of the mining company and the mining service company is equal so that the mining service company does not carry out good mining activities, the mining company does not have control over this and In fact, 70% of environmental damage in Indonesia is due to mining operations, mineral, and coal downstream policies are carried out inconsistently so that it is less than optimal in increasing the added value of minerals and coal and there are legal loopholes in opening up reclamation in other forms, making the success rate of reclamation and post-mining of ex-mining excavated flat. the average is less than achieved 100% success.

Abstract

Abuse of a dominant position is one type of violation that can provide an opportunity to change behavior. The mechanism for providing behavioral change in the abuse of a dominant position has implications for the KPPU, the reported party, and competing business actors. In terms of providing an opportunity to change behavior, the Commission Council considers the type of violation, the time of the violation and the losses caused by the violation. There is no further explanation regarding the criteria for providing an opportunity to change behavior, so legal construction is needed. This research was carried out using a normative juridical approach. Specifications: This research is descriptive analytical in nature, namely the data obtained will be described in this research by providing an overview of legal problems, the legal system and reviewing or analyzing them according to the needs of the research. The results of the research show the implications that arise in providing behavioral changes for violations of abuse of a dominant position which are contrary to the principle of legal certainty. Changes in behavior in the abuse of a dominant position will open up opportunities for the reporter to design abuse strategies in the future with different strategies. Per se approach indicators are needed to perfect the legal construction of providing behavioral changes for abuse of a dominant position. The KPPU can apply an alternative approach by carrying out analysis if the perpetrator abuses a dominant position at the same time committing a violation that meets the elements in another article, behavior change can be rejected.

Abstract

The application of the going concern principle within Indonesia's bankruptcy law system is a crucial legal protection mechanism for debtors facing financial difficulties. This study aims to analyze the implementation of the going concern principle as a form of legal protection for debtors in the bankruptcy process in Indonesia. This research employs a normative juridical method with a statutory approach and case study analysis. The results indicate that the going concern principle is implemented through the Suspension of Debt Payment Obligations (PKPU) mechanism, as regulated in Law No. 37 of 2004 concerning Bankruptcy and PKPU. The findings show that although the going concern principle provides significant protection for debtors by offering an alternative to liquidation, its implementation faces several challenges, including creditor resistance, resource limitations, and regulatory gaps. The study concludes that the going concern principle is effective in balancing the interests of debtors and creditors, though improvements in the regulatory framework and implementation capacity are needed to enhance its effectiveness in protecting debtors' rights while maintaining creditor confidence.

Abstract

Penelitian ini mengkaji konsep dan praktik yudisial terkait pembuktian sederhana dalam perkara kepailitan dan Penundaan Kewajiban Pembayaran Utang (PKPU) berdasarkan Undang-Undang Nomor 37 Tahun 2004 tentang Kepailitan dan Penundaan Kewajiban Pembayaran Utang di Indonesia. Pembuktian sederhana merupakan syarat formil untuk dikabulkannya permohonan pailit atau PKPU, yang dapat dipenuhi dengan membuktikan adanya sedikitnya dua kreditur dan satu utang yang telah jatuh tempo dan dapat ditagih. Namun, dalam praktiknya, interpretasi dan penerapan syarat ini sangat bervariasi antar pengadilan niaga, sehingga menimbulkan ketidakpastian hukum dan inkonsistensi putusan. Dengan menggunakan pendekatan hukum normatif yang dikombinasikan dengan studi kasus khususnya putusan dari Pengadilan Niaga Jakarta dan Surabayatulisan ini menganalisis apakah prinsip pembuktian sederhana diterapkan secara konsisten dan adil. Temuan menunjukkan bahwa ketiadaan parameter hukum yang jelas telah menciptakan kekosongan hukum yang membuka peluang bagi interpretasi yang tidak seragam dan potensi penyalahgunaan proses oleh kreditur yang bertindak dengan itikad buruk. Oleh karena itu, penelitian ini menekankan perlunya reformulasi konsep pembuktian sederhana, termasuk definisi normatif yang lebih tegas serta pedoman teknis dari Mahkamah Agung guna menjamin kepastian hukum, mencegah penyalahgunaan prosedur, dan menegakkan keadilan bagi semua pihak yang terlibat.

Abstract

This study examines the global impact of health law reforms on patient rights and the accountability of medical professionals through a qualitative methodology based on comprehensive library research and literature review. By analyzing legal frameworks, policy changes, and scholarly discussions from diverse international contexts, this research explores how recent reforms have shaped the protection of patient autonomy, informed consent, privacy, and access to quality healthcare. Additionally, the study investigates the evolving mechanisms of medical professional accountability, including regulatory oversight, disciplinary actions, and ethical standards. The literature reveals that health law reforms play a pivotal role in strengthening patient empowerment and ensuring that healthcare providers adhere to heightened standards of professional conduct. While the reforms have led to improved transparency and patient-centered care in many regions, challenges persist related to enforcement disparities, cultural differences, and resource limitations. Moreover, the study highlights the tension between protecting patient rights and supporting medical professionals in clinical decision-making, emphasizing the need for balanced legal frameworks. This qualitative synthesis provides insights into the effectiveness of various reform strategies, underscoring the importance of harmonizing legal provisions with healthcare realities. The findings contribute to policy discourse by identifying best practices and gaps in implementation that influence both patient outcomes and medical accountability. This research offers valuable guidance for lawmakers, healthcare administrators, and advocates aiming to enhance the legal foundations of health systems worldwide. Future research is encouraged to conduct empirical evaluations of reform impacts at national and local levels to deepen understanding of their practical implications.
