Abstract

This article aims to evaluate the constitutional design of Indonesia's regulatory review system, which is administered by two institutions with judicial power. It also looks into the various obstacles that will arise when judicial review of constitutional amendments is put into practice in Indonesia. Statutory approaches are used in this article. The outcome demonstrates that the Indonesian constitution contains unchangeable provisions and that there is experience with both formal and informal, unusual constitutional amendments. These factors require the establishment of a judicial review mechanism to supervise constitutional amendments carried out in accordance with custom and as stipulated in the constitution, as well as to maintain and preserve the basic identity and structure of the constitution in order to prevent pragmatic constitutional amendments from damaging, eliminating, or undermining it. Challenges that the Constitutional Court will confront in its role as a judicial implementing actor in reviewing constitutional amendments when they are implemented in Indonesia in the future include resistance that will arise from the People's Consultative Assembly, intervention, and intimidation by other branches of power towards the Constitutional Court, as well as defiance of the decisions of the Constitutional Court, especially regarding the unconstitutionality of constitutional amendments.

Abstract

ABSTRAKPenelitian ini bertujuan untuk menemukan ide atau konsep terkait penyelesaian sengketa kawasan wilayah pesisir dan pulau-pulau kecil di Indonesia dalam sistem sentralisasi. Metode penelitian ini adalah yuridis-normatif, yaitu penelitian atas peraturan perundang-undangan baik ditinjau dari sudut hirarki perundang-undangan (vertikal), maupun hubungan harmoni di antara perundang-undangan (horizontal). Berdasarkan hasil penelitian menunjukan bahwa perubahan rezim dalam pengelolaan wilayah pesisir dari desentralisasi ke sentralisasi berdampak juga terhadap konsistensi kewenangan pemerintah daerah kabupaten/kota dalam penyelesaian sengketa wilayah pesisir dan pulau-pulau kecil. Di dalam UUCK kewenangan tersebut diambil alih oleh pemerintah pusat, sedangkan dalam Peraturan Menteri Kelautan dan Perikanan No. 28/Permen-Kp/2020 pemerintah daerah kabupaten/kota diberikan kewenangan dalam penyelesaian sengketa, hal ini tentunya menimbulkan ketidakpastian dan sifat parsial. Oleh karena itu, konsepsi kewenangan pemerintah dalam penyelesaian sengketa mengacu sistem bottom-up, artinya penyelesaian sengketa yang dilakukan melalui sistem terkecil dari pemerintahan kabupaten/kota sampai tingkat menteri dalam penyelesaian konflik kewenangan tersebut, landasan konsepsi tersebut berdasarkan kepada daerah yang memiliki yurisdiksi dan pemahaman terhadap keadaan proses dan sistematik dalam penyelesaian sengketa kewenangan. Selain itu, konsepsi penyelesaian sengketa selalu diupayakan melalui jalur diluar pengadilan non-litigasi seperti, negosiasi, mediasi, konsiliasi, arbitrase dan, adat istiadat.Kata kunci: kewenangan; sengketa; sentralisasi. ABSTRACTThis study aims to find ideas or concepts related to resolving disputes over coastal areas and small islands in Indonesia in a centralized system. This research method is juridical-normative, namely research on laws and regulations both in terms of the legislative hierarchy (vertical), as well as the harmonious relationship between laws (horizontally). Based on the results of the study, it shows that regime changes in coastal area management from decentralization to centralization also have an impact on the consistency of the authority of local governments, districts/cities in resolving disputes over coastal areas and small islands. In the UUCK, the authority is taken over by the central government, while in the Regulation of the Minister of Marine Affairs and Fisheries No. 28/Permen-Kp/2020, the district/city government is given authority in dispute resolution. This certainly creates uncertainty and partial nature. Therefore, the conception of government authority in dispute resolution refers to the bottom-up system, meaning that dispute resolution is carried out through the smallest system from the district/city government to the ministerial level in resolving conflicts of authority, the basis of this conception is based on regions that have jurisdiction and understanding of the state of the process and systematics in resolving authority disputes. In addition, the concept of settling dispute is always pursued through a track outside the non-Litigation court such as, negotiation, mediation, conciliation, arbitrase, and customs.Keywords: authority; dispute; coastal.

Abstract

Kesehatan merupakan hak fundamental seluruh warga negara Indonesia, namun implementasi kebijakan kesehatan masih menghadapi berbagai tantangan, seperti ketimpangan akses, kualitas layanan, dan kendala geografis. Penelitian ini bertujuan untuk mengevaluasi arah hukum dan kebijakan kesehatan Pemerintah Kabinet Merah Putih, khususnya dalam program pemeriksaan kesehatan gratis, penanggulangan tuberkulosis, dan pembangunan rumah sakit di daerah terpencil, serta menganalisis efektivitas implementasinya. Metode penelitian menggunakan pendekatan hukum normatif-empiris dengan kerangka reflektif-kritis, menggabungkan analisis regulasi dan studi pustaka untuk mengidentifikasi kesenjangan antara norma hukum dan realitas di lapangan. Hasil penelitian menunjukkan bahwa kebijakan kesehatan tersebut belum terwujud secara maksimal akibat kendala digitalisasi, masalah demografis, dan geografis, serta keterbatasan sarana, fasilitas, dan sumber daya manusia. Implikasi penelitian ini menekankan perlunya penguatan kerangka regulasi, integrasi sistem informasi kesehatan, dan kolaborasi lintas sektor untuk mewujudkan layanan kesehatan yang adil, merata, dan berkelanjutan bagi seluruh masyarakat Indonesia.

Abstract

This research aims to analyze the influence of the phrase 'Online' on the fulfillment of Public Participation in Law Formation through the DPR's legislative information system. This research uses a normative legal research approach which includes legislative, conceptual and historical approaches. Method: The data collection approach in this research is library research. The data obtained is then processed through three stages, namely data reduction, data presentation, and drawing conclusions. Results: Research findings show that the term 'online' in article 96 of Law Number 13 of 2022 requires the DPR to be able to assist in implementing community involvement, one of which is through sileg. Apart from that, based on the provisions of Secretary General Number 13 of 2020 and the parliamentary website guidelines that have been prepared by the IPU, improvements and developments need to be made in the implementation of Sileg. Novelty: The novelty of this research comes from the research object, namely the formation of laws through the DPR Legislative Information System in the context of the influence of the phrase 'Online' on the fulfillment of community participation. Conclusion: Adequate information in Sileg at all stages of law formation can facilitate and encourage public participation in providing input on each bill that is being discussed and/or will be discussed in the DPR. The ideal implementation of sileg is as an online medium for people to carry out more meaningful community activities.
