Abstract

This study examined the implementation of the STEAM (Science, Technology, Engineering, Art, and Mathematics) approach in learning to improve the critical thinking skills of Political Science Study Program students. The interdisciplinary STEAM approach enriches students' thinking processes by integrating scientific logic, creativity, technology, and problem-solving. This research used qualitative methods with data collection techniques in the form of interviews, observations, and documentation of lecturers and students involved in the STEAM-based learning process. This research was conducted in the Politics and Technology course of the class of 2024. The selection of materials and classes was based on the research team's discussions on crucial topics and characteristics relevant to technology utilization. The results showed that applying the STEAM approach encourages students to think analytically, creatively, and reflectively in understanding contemporary political phenomena. Collaboration between science, technology, art, and political analysis elements helps students formulate logical arguments, critically evaluate information, and make decisions based on data and ethics. This research recommends the application of STEAM as an innovative pedagogical strategy in political science curriculum development in the digital era.

Abstract

The advancement of digital technology has given rise to internet-based Over The Top media services that operate outside the broadcasting regulatory framework governing conventional television as stipulated in Law Number 32 of 2002. This regulatory imbalance creates concerns of injustice, as conventional television broadcasters bear heavier legal obligations compared to digital platforms. The disparity prompted a judicial review petition before the Constitutional Court through Case Number 39/PUU-XVIII/2020. The research addresses two core issues: the legal considerations of the Constitutional Court in reviewing Article 1 point 2 of the Broadcasting Law, and the juridical basis of the Court’s decision concerning the differential treatment between conventional television broadcasting and Over The Top media services from the perspective of justice. The study aims to analyze the Constitutional Court’s decision through a philosophical-juridical approach by employing John Rawls’s theory of justice and the principles of Islamic Legal Philosophy to assess the extent to which the ruling aligns with substantive justice. This research adopts a normative legal method using primary and secondary sources collected through literature review, observation, interviews, and documentation. The data were analyzed qualitatively to elaborate on the Court’s legal reasoning, the regulatory context, and the justice implications of the decision. The findings show that the Constitutional Court rejected the judicial review petition on the grounds of fundamental technical differences between conventional broadcasting and Over The Top services, thereby excluding digital platforms from the scope of the Broadcasting Law. The analytical assessment reveals that although the ruling is formally valid, it does not fully achieve substantive justice. Rawlsian evaluation demonstrates a violation of the Difference Principle due to the creation of unequal competitive conditions disadvantaging national broadcasters. Meanwhile, Islamic Legal Philosophy, through the concepts of al-maslahah and taw?zun, emphasizes the need for balanced social and moral responsibilities that are not yet addressed within the current legal framework. The implications of this study highlight the urgency of comprehensive and adaptive media law reform to respond to digital transformation. Regulatory renewal is required to ensure distributive justice, strengthen the protection of national broadcasting industries, and uphold public welfare amid the rapidly evolving internet-based media ecosystem. [Perkembangan teknologi digital melahirkan layanan media Over The Top berbasis internet yang beroperasi tanpa berada dalam rezim pengaturan penyiaran sebagaimana televisi konvensional yang diatur melalui Undang-Undang Nomor 32 Tahun 2002. Ketidakseimbangan regulasi tersebut memunculkan persoalan keadilan karena televisi konvensional menanggung kewajiban hukum yang lebih berat dibandingkan platform digital, sehingga diajukan pengujian norma melalui perkara Mahkamah Konstitusi Nomor 39/PUU-XVIII/2020. Permasalahan penelitian ini mencakup dua hal, yaitu pertimbangan hukum Mahkamah Konstitusi dalam memutus pengujian Pasal 1 angka 2 Undang-Undang Penyiaran serta dasar yuridis putusan tersebut terhadap perbedaan perlakuan antara penyiaran televisi konvensional dan media Over The Top dalam perspektif keadilan. Penelitian ini bertujuan menganalisis putusan Mahkamah Konstitusi secara filosofis-yuridis menggunakan teori keadilan John Rawls dan prinsip-prinsip Filsafat Hukum Islam untuk menilai kesesuaian putusan dengan prinsip keadilan substantif. Penelitian menggunakan metode normatif dengan sumber data primer dan sekunder, diperoleh melalui studi pustaka, observasi, wawancara, dan dokumentasi. Analisis data dilakukan secara deskriptif kualitatif untuk menguraikan argumentasi hukum, konteks regulasi, dan implikasi keadilan dalam putusan tersebut. Hasil penelitian menunjukkan bahwa Mahkamah Konstitusi menolak permohonan uji materiil atas dasar perbedaan karakteristik teknis antara penyiaran televisi dan layanan Over The Top sehingga platform digital tidak termasuk dalam cakupan Undang-Undang Penyiaran yang berlaku. Temuan analitis menunjukkan bahwa putusan tersebut, meskipun sah secara formal, belum sepenuhnya memenuhi prinsip keadilan substantif. Telaah berdasarkan teori Rawls menegaskan adanya pelanggaran terhadap prinsip perbedaan karena terciptanya ketidakseimbangan kompetisi antara pelaku penyiaran nasional dan penyedia layanan digital. Perspektif Filsafat Hukum Islam melalui konsep al-maslahah dan taw?zun mengharuskan adanya keseimbangan tanggung jawab sosial yang belum terakomodasi dalam putusan tersebut. Implikasi penelitian ini menunjukkan perlunya reformasi hukum penyiaran yang bersifat komprehensif dan adaptif terhadap transformasi digital. Pembaruan regulasi diperlukan untuk memastikan keadilan distributif, perlindungan industri penyiaran nasional, sekaligus menjaga kemaslahatan publik di tengah perkembangan ekosistem media berbasis internet.]

Abstract

Water is a basic human need whose fulfillment is guaranteed by the constitution as part of human rights. Following the annulment of Law No. 7 of 2004 by the Constitutional Court, the enactment of Law No. 17 of 2019 concerning Water Resources marked the return of the spirit of state control over water to prevent excessive commercialization. However, in South Sumatra Province, the abundance of water resources has not fully guaranteed easy access to clean water for the community, especially with pressure from the industrial and plantation sectors. The main problems analyzed are how the local government's authority is regulated in Law No. 17 of 2019, how it is implemented in South Sumatra, what juridical and institutional constraints are faced, and what the review of Constitutional Law and Fiqh Siyasah is regarding this authority. This study aims to analyze the authority of local governments in fulfilling the right to water in South Sumatra based on the latest legal framework. This research is a juridical-normative legal study enriched with a juridical-empirical approach through a case study in South Sumatra Province. Data were collected through document studies of laws and regulations, court decisions, and related literature. The analysis was conducted using the welfare state theory, the concept of State Control Rights (HMN), and the Fiqh Siyasah perspective to evaluate the effectiveness and fairness in the implementation of regional authority. The results show that Law No. 17 of 2019 has provided a strong mandate to local governments as public trustees in water management. However, its implementation in South Sumatra still faces significant obstacles, including regulatory disharmony, limited institutional capacity, and conflicts of interest with the macro-economic sector. From the Fiqh Siyasah perspective, water management must emphasize the principle of maslahah 'ammah and the protection of life (hif? al-nafs). The recommendations of this study include the need for harmonization of regional regulations, reform of water utility governance (BUMD), and increased public participation in water resource supervision.

Abstract

Penelitian ini berjudul Analisis Fiqh Siyasah Terhadap Fungsi Badan Permusyawaratan Desa (BPD) Dalam Pengawasan Pengelolaan Dana Desa di Desa Pelangki Kecamatan Muaradua Kabupaten OKU Selatan. Badan Permusyawaratan Desa (BPD) menghadapi hambatan dalam mengawasi pengelolaan Dana Desa akibat kurangnya transparansi dari Kepala Desa. Pengalokasian dana desa yang besar rawan disalahgunakan, seringkali melibatkan kepala desa dan perangkatnya. Kondisi ini mencerminkan lemahnya pengawasan dan rendahnya integritas dalam pengelolaan dana desa. Padahal, dana desa bertujuan untuk pemerataan kesejahteraan dan pembangunan desa. Tanpa prinsip transparansi, partisipasi, dan akuntabilitas, dana desa justru berpotensi menjadi sumber korupsi di tingkat desa. Permasalahan yang diangkat, yaitu: Bagaimana Fungsi Badan Permusyawaratan Desa (BPD) dalam Pengawasan Pengelolaan Dana Desa di Desa Pelangki Kecamatan Muaradua Kabupaten OKU Selatan?; Bagaimana Upaya Yang Seharusnya Dilakukan Untuk Memaksimalkan Fungsi Badan Permusyawaratan Desa (BPD) Dalam Pengawasan Pengelolaan Dana Desa di Desa Pelangki Kecamatan Muaradua Kabupaten OKU Selatan?; dan Bagaimana Analisis Fiqh Siyasah Terhadap Fungsi Badan Permusyawaratan Desa (BPD) dalam Pengawasan Pengelolaan Dana Desa di Desa Pelangki Kecamatan Muaradua Kabupaten OKU Selatan?. Jenis penelitian ini menggunakan penelitian  penelitian normatif-empiris yaitu penelitian lapangan (Field Research) serta penelitian pustaka (Library Research) dengan dua pendekatan Peraturan Perundang-undangan (Statue Approach) dan pendekatan konseptual (Conceptual Approach). Jenis data kualitatif dengan sumber data yaitu primer, sekunder, dan tersier. Data yang dikumpulkan melalui metode wawancara, dokumentasi, lalu observasi akan dianalisis menggunakan teknik analisis deskriptif kualitatif. Penelitian ini dapat disimpulkan bahwa Fungsi Badan Permusyawaratan Desa (BPD) dalam Pengawasan Pengelolaan Dana Desa di Desa Pelangki Kecamatan Muaradua Kabupaten OKU Selatan Fungsi legislasi adalah fungsi Badan Permusyawaratan Desa (BPD)  dalam hal membahas dan menyepakati rancangan peraturan desa bersama kepala desa. Fungsi perwakilan adalah fungsi Badan Permusyawaratan Desa (BPD)  dalam menampung dan menyalurkan aspirasi masyarakat desa. Fungsi pengawasan adalah fungsi Badan Permusyawaratan Desa (BPD) dalam melakukan pengawasan kinerja kepala desa terhadap pengelolaan dana desa. Upaya yang seharusnya dilakukan dalam memaksimalkan pengawasan Badan Permusyawaratan Desa (BPD) terhadap Pengelolaan Dana Desa di Desa Pelangki Kecamatan Muaradua Kabupaten OKU Selatan yaitu melakukan pengawasan menyeluruh di semua tahap pengelolaan Dana Desa, menguatkan peran Badan Permusyawaratan Desa (BPD) secara kelembagaan, meningkatkan kemampuan Badan Permusyawaratan Desa (BPD), memperkuat partisipasi masyarakat, dan menjalankan prosedur pengawasan yang transparan dan akuntabel sesuai peraturan perundang-undangan yang berlaku. Kemudian, Analisis Fiqh Siyasah Terhadap Fungsi Badan Permusyawaratan Desa (BPD) dalam Pengawasan Pengelolaan Dana Desa di Desa Pelangki Kecamatan Muaradua Kabupaten OKU Selatan maka keterkaitan fungsi yang dimiliki oleh Badan Permusyawaratan Desa (BPD) apabila ditinjau dari ketatanegaraan Islam maka dapat disamakan ke dalam ahlul halli wal aqdi. Keterkaitan keduanya yaitu didasarkan pada kewenangan fungsi legislasi yang dimiliki oleh Badan Permusyawaratan Desa (BPD) dan fiqh siyasah maliyah yakni Baitul mal karena memiliki tugas mengawasi kekayaan Negara terutama pemasukan dan pengelolaan maupun masalah pengeluaran lainnya seperti fungsi Badan permusyawaratan Desa yakni mengawasi Pengelolaan Dana Desa.
