Abstract

Land in Indonesia still remains but its use is increasing and makes the value of land prices also go up, so it often causes conflict. Therefore, a complete settlement is needed that can be accepted by the litigants so that justice is created between the litigants. In this study raised two problems, namely how the legal consequences of natural disaster events that resulted in a shift in land boundaries and how the legal protection for the injured parties related to the shifting of land boundaries?. The method used is a normative juridical research method that initiates the collection of legal materials carried out by identifying and inventory of positive legal rules, researching library materials (books, scientific journals, research reports), and other sources of legal materials relevant to the legal issues under study. The results of this study suggested that the land shifted boundaries that can not be proved again because of the physical data is lost, so it is no longer in accordance with the physical data and juridical data as a strong evidence, it can solve the problem with physical evidence and non-physical in court and outside the court as UUPA and PP No. 24 of 2007 on Land Registration. However, in Article 43 of the regulation of the Minister of Agrarian Affairs and Spatial Planning / head of the National Land Agency of the Republic of Indonesia number 21 of 2020 concerning the handling and settlement of land cases is a form of legal protection against the community regarding dispute resolution that can be resolved through mediation at the initiative of the ministry, Regional Office, Land Office and so on.

Abstract

Discussion on the legal certainty of life insurance policy claims related to insurance company default in paying claims. The method used in this study is a normative juridical research type, namely library legal research or secondary data with primary, secondary and tertiary legal sources. The results of the study on the regulation and legal consequences of insurance policies related to default are that the emergence of life insurance beneficiaries results in creating a legal relationship between life insurance beneficiaries, the existence of insurance company default, so that the beneficiaries can obtain their rights. The legal certainty of life insurance policies related to insurance company default in paying claims to life insurance beneficiaries is that life insurance policies made based on the agreement of the parties and fulfilling the legal requirements of the agreement as stipulated in Article 1320 of the Civil Code have binding force as a law for the parties (pacta sunt servanda), and Article 31 of Law of the Republic of Indonesia number 40 of 2014 concerning Insurance with the addition of a paragraph for the creation of life insurance policies must be made before a public official or notary.

Abstract

Discussion on the legal certainty of underhand sales carried out by curators in the settlement of bankrupt estates. The method used in this research is a normative legal research type, namely library legal research or secondary data with primary, secondary and tertiary legal sources. The results of the research on the Legal Certainty of Underhand Sales Carried Out by Curators in the Settlement of Bankrupt Estates are valid and carried out with the permission of the Supervisory Judge as regulated in Article 185 paragraph 2 of the Bankruptcy Law "In the event that public sales as referred to in paragraph (1) are not achieved, underhand sales can be carried out with the permission of the Supervisory Judge. In addition, the advice expected is that curators must act with professional care to maintain independence and minimize legal risks.

Abstract

Penelitian ini bertujuan untuk menganalisis kepastian hukum terhadap akta jual beli yang dibuat di hadapan Camat selaku Pejabat Pembuat Akta Tanah (PPAT) sementara, khususnya apabila jual beli tersebut dilakukan oleh pihak lain dan kemudian dibatalkan oleh pengadilan. Metode penelitian yang digunakan adalah penelitian hukum normatif dengan pendekatan perundang-undangan, kasus, analitis, dan konseptual. Bahan hukum yang digunakan meliputi bahan hukum primer, sekunder, dan tersier yang dikumpulkan melalui studi kepustakaan. Dari hasil penelitian dapat diperoleh akibat hukum akta jual beli yang dibuat dihadapan PPAT camat terkait jual beli oleh pihak lain menyebabkan akta jual beli tersebut tidak memiliki kedudukan hukum, baik bagi penjual maupun pembeli dan kepastian hukum akta jual beli ini adanya peraturan yang jelas (jernih), konsisten dan semuanya harus dilaksanakan. Namun karena tidak dilaksanakan bahkan melanggar syarat subjektif dan syarat objektif suatu perjanjian sehingga akta jual beli yang dibuat dihadapan PPAT camat terkait jual beli oleh pihak lain dibatalkan oleh hakim pengadilan. Dengan pembatalan tersebut kepastian hukum itulah yang diberikan bagi akta jual beli yang dibuat dihadapan PPAT camat terkait jual beli oleh pihak lain.

Abstract

Penelitian ini bertujuan menganalisis perlindungan hukum bagi pasangan hidup yang terlama terhadap hibah wasiat dengan objek harta bersama menurut hukum perdata. Metode yang digunakan adalah penelitian hukum yuridis normatif berbasis studi kepustakaan dengan pendekatan perundang-undangan, kasus, analitis, dan konseptual. Bahan hukum meliputi bahan hukum primer berupa peraturan perundang-undangan dan putusan pengadilan, bahan hukum sekunder berupa literatur ilmiah, serta bahan hukum tersier seperti kamus dan ensiklopedia. Teknik pengumpulan data dilakukan melalui studi pustaka, sedangkan analisis menggunakan penafsiran hukum gramatikal dan sistematis serta konstruksi hukum melalui analogi dan penghalusan hukum. Hasil penelitian menunjukkan bahwa dalam pembagian waris terkait hibah wasiat atas harta bersama, terlebih dahulu harus dipisahkan bagian pasangan hidup terlama sebesar setengah dari keseluruhan harta bersama sebagai haknya, sedangkan sisanya menjadi harta peninggalan yang dibagikan kepada ahli waris sesuai legitime portie apabila terdapat tuntutan legitimaris. Perlindungan hukum bagi pasangan hidup terlama dapat ditempuh melalui gugatan di pengadilan apabila haknya tidak terpenuhi akibat tindakan pihak lain.

Abstract

A marriage agreement is a legal instrument that enables spouses to regulate the property consequences of marriage. Legal uncertainty may arise when a marriage agreement has been executed in an authentic deed but has not been registered with the competent marriage registration authority and is subsequently invoked in a claim for the division of marital property following divorce. This study examines the legal status and legal certainty of an unregistered marriage agreement deed in disputes over property division following divorce. This research employs a normative juridical method using primary, secondary, and tertiary legal materials, with statutory, case, analytical, and conceptual approaches. The legal materials were collected through library research and analyzed qualitatively using grammatical and systematic interpretation. The analysis is based on Jan Michiel Otto’s Legal Certainty Theory and Subekti’s Consensualism Theory. The findings demonstrate that an unregistered marriage agreement deed remains legally binding between the spouses if it satisfies the requirements for a valid agreement and does not violate applicable law, religion, or morality. The authentic deed provides evidentiary force concerning the property regime agreed upon by the spouses. However, failure to register the agreement affects its enforceability against third parties because registration serves a publicity function. Therefore, legal certainty between the spouses derives from the agreement’s binding force, the evidentiary value of the authentic deed, and judicial enforcement, while legal certainty for third parties requires effective and consistent registration.

Abstract

Article 37 paragraph (1) of Government Regulation Number 24 of 1997, as amended by Government Regulation Number 18 of 2021, provides that the transfer of land rights through sale and purchase may only be registered if evidenced by a deed executed by a Land Deed Official (PPAT). In practice, however, land sale and purchase transactions conducted privately without a PPAT deed are still frequently found, thereby creating legal problems for the buyer. The research questions what are the legal consequences of the sale and purchase of land rights conducted without a sale and purchase deed executed by a PPAT, and how is legal certainty achieved in the transfer of land rights through sale and purchase conducted without such a deed? This research applies Jan Michiel Otto’s theory of legal certainty and Boedi Harsono’s theory of land registration. This study employs normative juridical legal research. The approaches used are the statutory, case, analytical, and conceptual approaches. Legal materials were collected through the identification and inventory of positive legal provisions, books, journals, and other relevant legal sources. The legal materials were analyzed using grammatical and systematic interpretation, as well as the legal construction techniques of analogy and legal refinement (rechtsverfijning). The results demonstrate that a land sale and purchase transaction conducted without a PPAT deed remains valid as an agreement if it satisfies the requirements under Article 1320 of the Indonesian Civil Code and the customary law principles of terang and tunai. However, such validity is limited to an obligatory relationship between the seller and the buyer and does not effectuate the juridical transfer of land rights, which requires registration with the Land Office. Consequently, the land rights remain registered in the seller’s name. Legal certainty may be achieved through the execution of a Sale and Purchase Deed before a PPAT. If the seller refuses to sign the deed, the buyer may file a lawsuit, and a final and binding court decision may serve as the basis for executing the deed and registering the transfer of land rights.

Abstract

Article 2 of Law Number 1 of 1974 concerning Marriage provides for the circumstances under which a marriage is considered legally valid. Marriage not only gives rise to legal relationships concerning the personal status of husband and wife but also gives rise to legal consequences concerning property acquired during the marriage. In practice, however, the transfer of land rights constituting joint marital property is frequently carried out unilaterally by one spouse without the written consent of the other spouse. In principle, joint marital property acquired during the marriage constitutes jointly owned property, the transfer or encumbrance of which requires the consent of both parties. An exception applies where the property being transferred constitutes the separate property of either party acquired prior to the marriage. The research problems addressed in this study are: What are the legal consequences of the transfer of land rights constituting joint marital property without the consent of a spouse? and What forms of legal protection are afforded to a spouse who suffers losses as a result of the transfer of land rights constituting joint marital property without consent? The theories employed in this research are the Theory of Legal Protection proposed by Satjipto Rahardjo and the Theory of Legal Consequences proposed by R. Soeroso. This research employs a normative juridical method, namely legal research based on library research or secondary data, utilizing primary, secondary, and tertiary legal materials. The research approaches used include the Statutory Approach, Conceptual Approach, Analytical Approach, and Case Approach. The collection of legal materials was carried out by identifying, inventorying, and examining positive legal regulations, books, legal journals, and court decisions. The analysis of legal materials was conducted through grammatical interpretation, systematic interpretation, as well as methods of analogical construction and legal refinement construction. The results of the study indicate that the transfer of land rights constituting joint marital property without the consent of a spouse constitutes an unlawful act pursuant to Article 1365 of the Indonesian Civil Code and is contrary to Article 36 paragraph (1) of the Marriage Law. A unilateral transfer may cause losses to one of the spouses because the object subject to the dispute constitutes joint marital property. The transfer of rights over land does not require the consent of the spouse if the object constitutes the separate property acquired by either party prior to the marriage.
