Abstract

Abstract The protection of human rights is not only attached to the individual human being, but also to other human beings. This is a consequence of humans as social beings who cannot be separated from other humans. Criminal Law is then present to regulate various acts that violate human rights which will then be punished. Criminal law, of course, cannot be implemented properly if there are no other legal sciences that accompany it, including Penitentiary law, which is known as the Law of Punishment or legal science that studies punishment. Penitentiary law is not a rule of law that can immediately punish criminals arbitrarily, but needs to consider human rights. This paper focuses on whether penitentiary law violates human rights or not. The purpose of this paper is to examine penitentiary law from a human rights perspective. This writing uses normative legal research methods with literature research techniques that are analyzed qualitatively using a statutory approach and conceptual approach. The results of the study concluded that Penitentiary Law is a rule that seeks to continue to fight for the human rights of people who have been violated by the perpetrator of the crime by punishing him, but the model of punishment given still takes into account the human rights of the convicted criminal. keywords: Human Rights, Criminal Law, Penitentiary Law

Abstract

This study aims to analyze catfishing in the perspective of Indonesian positive law. This research is a type of normative juridical research with statutory and case approach methods and then uses descriptive qualitative analysis techniques. The results of this study indicate that catfishing is one of the crimes that use technology by utilizing social media where catfishing which is a form of fraud in cyberspace with its modus operandi using a fake identity then showing interest in other people so as to form an emotional or romantic relationship, and then using the victim to benefit himself by giving something in the form of goods or money. Therefore, based on Indonesian positive law the act above is a crime which fulfills the elements in Article 378 of the Criminal Code and Article 35 in conjunction with Article 51 paragraph (1) of the ITE Law. With the existence of these rules can accommodate the crime of catfishing and the catfish although there is no cyberlaw that specifically regulates crimes such as catfishing.

Abstract

Berkembangnya teknologi, di mana hampir semua interaksi sosial saat ini terjadi di dunia maya, membuat perundungan yang semula terbatas pada ruang fisik bertransformasi ke dalam bentuk yang baru yang kita kenal sebagai cyberbullying. Hal ini membutuhkan perhatian serius, khususnya di kalangan remaja sebab dapat mencederai perkembangan psikologis, sosial dan emosional mereka. Untuk itu perlu dilakukan upaya pencegahan dan penghapusan kekerasan di ruang siber ini , seperti dengan memberikan  penyuluhan hukum dan edukasi terpadu dengan mengadakan sesi penyuluhan untuk menjelaskan dampak cyberbullying dan implikasi hukumnya kepada para remaja. Kegiatan semacam ini berfungsi untuk memperluas wawasan dan pengetahuan remaja serta meningkatkan kesadaran mereka akan bahaya dan implikasi hukum perundungan cyberbullying. Oleh karena ini kegiatan penyuluhan ini dilakukan di salah satu sekolah di Kota Mataram yakni di MA Al-Intishor. Pengabdian ini dilakukan melalui penyuluhan dengan melakukan sosialisasi dan pemaparan materi secara langsung tentang bahaya cyberbullying dengan menekankan terhadap pemahaman aspek hukum cyberbullying.  Dari hasil refleksi yang dilakukan menunjukkan bahwa banyak siswa atau siswi sekolah ini menjadi korban cyberbullying.  Kurangnya pemahaman akan dampak dan aspek hukum dari cyberbullying membuat mereka  menormalisasi tindakan tersebut. Setelah dilakukan kegiatan pengabdian masyarakat dan sosialisasi dampak cyberbullying, para siswa menjadi paham dampak dan bahaya cyberbullying. Para siswa pun berkomitmen untuk lebih berhati-hati, menjaga ketikan & tulisan dan lebih bijak dalam bersosial media.

Abstract

Teluk Jukung, Lombok Timur, merupakan Kampung Budidaya Lobster yang diakui secara nasional namun menghadapi persoalan serius berupa penyelundupan benih lobster ilegal, keterbatasan akses teknologi, dan disharmoni regulasi ekspor yang membuat pembudidaya rentan secara ekonomi maupun ekologis. Untuk menanggulangi permasalahan tersebut, Indonesia menjalin kemitraan rantai pasok dengan Vietnam melalui transfer teknologi dan hilirisasi perikanan. Namun demikian, kemitraan ini menimbulkan pertanyaan mengenai kesesuaian dengan prinsip Open Access and Benefit Sharing (ABS) dalam Convention on Biological Diversity (CBD), khususnya mekanisme Prior Informed Consent (PIC) dan Mutually Agreed Terms (MAT). Penelitian ini menggunakan pendekatan sosio-legal untuk menilai implementasi ABS dalam kerja sama Indonesia–Vietnam serta dampaknya terhadap keberlanjutan ekosistem dan kesejahteraan pembudidaya lobster di Teluk Jukung. Temuan penelitian menunjukkan tiga aspek utama: pertama, masih terdapat ketidakharmonisan antara kebijakan nasional dan realitas sosial-ekonomi pembudidaya; kedua, terdapat celah implementasi PIC dan MAT yang menyebabkan ketidakadilan distribusi manfaat; ketiga, diperlukan model strategi pengelolaan lobster berbasis ABS untuk memastikan keterlibatan pembudidaya, mendorong transfer teknologi yang setara, dan memperkuat posisi tawar Indonesia dalam rantai pasok global. Penelitian ini memberikan rekomendasi kebijakan guna mewujudkan tata kelola budidaya lobster yang berkeadilan dan berkelanjutan.

Abstract

Teluk Jukung in East Lombok has been designated as a national lobster aquaculture village, yet it continues to face structural challenges, including illegal lobster seed smuggling, limited technological capacity and inconsistencies in export regulations that place cultivators in a vulnerable economic and ecological position. In response, Indonesia has pursued a lobster supply chain partnership with Vietnam focused on technology transfer and fisheries downstream development. This cooperation raises legal and governance concerns regarding its compatibility with the Access and Benefit Sharing framework under the Convention on Biological Diversity, particularly the principles of Prior Informed Consent and Mutually Agreed Terms. This study adopts a socio-legal approach to examine the implementation of Access and Benefit Sharing within the Indonesia-Vietnam partnership and to assess its implications for ecosystem sustainability and the welfare of lobster cultivators in Teluk Jukung. The findings reveal three central issues. First, there is a persistent gap between national policy objectives and the socio-economic realities experienced by local cultivators. Second, shortcomings in the application of Prior Informed Consent and Mutually Agreed Terms contribute to unequal distribution of benefits within the supply chain. Third, an Access and Benefit Sharing-based governance model is required to ensure meaningful participation of cultivators, support equitable technology transfer and strengthen Indonesia’s position within the global lobster supply chain.This study offers policy recommendations aimed at developing a fair and sustainable framework for lobster aquaculture governance.
