Abstract

This study aims to analyze catfishing in the perspective of Indonesian positive law. This research is a type of normative juridical research with statutory and case approach methods and then uses descriptive qualitative analysis techniques. The results of this study indicate that catfishing is one of the crimes that use technology by utilizing social media where catfishing which is a form of fraud in cyberspace with its modus operandi using a fake identity then showing interest in other people so as to form an emotional or romantic relationship, and then using the victim to benefit himself by giving something in the form of goods or money. Therefore, based on Indonesian positive law the act above is a crime which fulfills the elements in Article 378 of the Criminal Code and Article 35 in conjunction with Article 51 paragraph (1) of the ITE Law. With the existence of these rules can accommodate the crime of catfishing and the catfish although there is no cyberlaw that specifically regulates crimes such as catfishing.

Abstract

Crime is a social phenomenon that is always inherent in every human life so that every development of the times will have an influence on social change in society. One of the crime phenomena that occurs due to social change is the misuse of sharp weapons by children in Dompu Regency in the jurisdiction of the Dompu Resort Police. The purpose of this study is to determine the application of sanctions against children who misuse sharp weapons in the Dompu Police Department. The research method used is a type of empirical research that examines the facts that occur in the field with a statute approach and case approach. The results showed that the application of criminal sanctions against children who misuse sharp weapons in the Dompu Resort Police was resolved by diversion through restorative justice with the result that the child was returned to the parents to be given guidance and supervision by the parents so as not to repeat their actions. In addition to diversion, children who misuse sharp weapons that are declared P21 (complete file) are forwarded to the Public Prosecutor for further processing, namely the trial stage. The Dompu Police Department, especially the Women and Children Protection Unit, has carried out its duties properly

Abstract

Pelecehan seksual merupakan isu serius yang terus memengaruhi berbagai aspek kehidupan masyarakat, dan dapat terjadi di mana saja serta dilakukan oleh siapa saja baik dalam ruang fisik maupun dunia maya. Hal ini sebagaimana terlihat dari meningkatnya kasus pelecehan seksual yang memanfaatkan teknologi kecerdasan buatan (AI), artinya bentuk pelecehan seksual telah mengalami transformasi. Penelitian ini merupakan penelitian normatif dengan pendekatan perundang-undangan dan pendekatan kasus, kemudian bahan hukum dianalisis dengan menggunakan teknik deskriptif kualitatif. Hasi penelitian menunjukkan perkembangan teknologi kecerdasan buatan (AI) telah mengubah bentuk pelecehan seksual dari tindakan fisik menjadi pelecehan dalam ruang digital yang sulit terdeteksi, namun berdampak serius terhadap korban. Bentuk-bentuk pelecehan tersebut antara lain deepfake pornografi, chatbot AI cabul, voice cloning, serta pelecehan terhadap avatar di metaverse. Meskipun di Indonesia sudah terdapat kerangka hukum seperti Undang-Undang Nomor 12 Tahun 2022 tentang Tindak Pidana Kekerasan Seksual (UU TPKS) dan UU Informasi dan Transaksi Elektronik (ITE) yang dapat digunakan untuk menjerat pelaku, namun regulasi yang ada masih belum secara spesifik dan komprehensif dalam mengatur pelecehan seksual berbasis AI.

Abstract

Human Trafficking is an iceberg phenomenon that is growing all over the world including in Indonesia. Indonesia is a tier 2 surveillance country because human trafficking cases are still high and one of the regions contributing to human trafficking cases is East Lombok Regency, West Nusa Tenggara. The purpose of this study is to analyze and find out how pattern of human trafficking in East Lombok and the role of the East Lombok Regency government in preventing human trafficking. The results showed that first, pattern human trafficking in East Lombok Regency which starts from the recruitment process carried out by neighbors, family, friends, and people who first go abroad, document forgery and manipulation of victims' data are made outside the East Lombok Regency area, and the departure process is relay and departure is not from East Lombok Regency but from the area where the documents are made. Second, the role of the East Lombok Regency Government for prevent human trafficking by conducting scheduled socialization in villages/villages that are vulnerable to human trafficking victims, forming Productive Migrant Villages, and providing training to retired migrant workers/families by forming novice business heroes. However, the Government's efforts to prevent human trafficking have not been maximized and effective due to the lack of coordination between related institutions and public awareness of the dangers of trafficking in persons.

Abstract

The development of digital technology has changed the pattern of trafficking in persons crimes from conventional forms to new forms of digital-based exploitation, one of which is through the phenomenon of scam centers. This phenomenon raises legal issues regarding the status of victims who are in a dual position as victims of trafficking in persons as well as perpetrators of criminal acts. This study aims to analyze the dilemma of criminal liability in the case of scam centers as a form of modern trafficking in persons as perpetrators or victims that occurs in Cambodia, Myanmar, and Laos. This research method is a normative research with a statute approach and a victimization approach. The results of the study showed that the practice of scam centers met the elements of trafficking in persons crimes based on Articles 4 and 12 of the Anti-Trafficking Law. From a victimology perspective, the victim is in  a position of victim-offender overlap because in addition to being a victim of exploitation, the victim is also forced to commit the crime of online fraud so that based on the criminal responsibility theory and Article 36 paragraph (1) of the National Criminal Code, the theory of coercion (overmacht theory) and Article 42 of the National Criminal Code,  the principle of non-punishment of victims/non-criminalization and Article 18 of the Anti-Trafficking Law, the theory of no culpability without freedom, and the Palermo Protocol, victims who commit criminal acts due to coercion and exploitation cannot be fully held criminally responsible because the crime is committed on the basis of coercion without full freedom of will, then the victim  of the scam center It is more appropriate to position as victims of trafficking who are entitled to protection to prevent criminalization of victims.
