Abstract

This article examines the legal integration of customary law into Indonesia’s national land law system, with specific reference to the constitutional framework and the Basic Agrarian Law. The purpose of this study is to analyze the status of customary law, identify its impacts on land tenure and use, and formulate legal strategies to harmonize customary and national law toward equitable and sustainable land governance. Employing a normative juridical method, the research draws on primary legal materials, including statutory regulations, constitutional provisions, and jurisprudence, supported by secondary academic sources. The findings indicate that although customary law is constitutionally recognized, its implementation remains inconsistent due to legal fragmentation, administrative constraints, and sectoral regulatory conflicts. To address this, the study proposes a pluralistic legal model based on codification, procedural innovation, institutional reform, and participatory law-making to ensure the effective and just integration of customary land systems within the national legal order.

Abstract

Penelitian ini bertujuan untuk menganalisis penerapan uang paksa (dwangsom) sebagai strategi alternatif dalam upaya pengembalian kerugian keuangan negara akibat tindak pidana korupsi. Praktik korupsi di Indonesia telah menyebabkan kerugian negara dalam jumlah besar, sementara mekanisme pemulihan yang tersedia seperti pidana penjara dan pembayaran uang penggantibelum sepenuhnya efektif dalam menjamin pengembalian aset negara secara maksimal. Dwangsom, sebagai sanksi yang bersifat accessoir dan subsidair, dapat digunakan sebagai alat tekanan hukum terhadap terpidana yang tidak mematuhi putusan pengadilan, khususnya dalam perkara perdata yang berkaitan dengan pengembalian aset. Penelitian ini menggunakan metode yuridis normatif melalui pendekatan peraturan perundang-undangan dan putusan pengadilan. Hasil kajian menunjukkan bahwa dwangsom dapat berfungsi sebagai tekanan psikologis yang mendorong pelaksanaan putusan secara sukarela melalui ancaman kewajiban membayar sejumlah uang setiap hari keterlambatan. Dengan sifatnya yang fleksibel dan efisien, dwangsom berpotensi menjadi solusi dalam mempercepat pemulihan aset tanpa melalui proses eksekusi yang panjang.

Abstract

This study aims to examine strategies for eradicating land mafia practices through a normative legal approach supported by a digital land administration system and agrarian law education. The method used is a normative legal approach, based on an analysis of primary, secondary, and tertiary legal materials in Indonesia's national land law system. The novelty of this research lies in its multidimensional legal approach, which combines positive legal regulations, digital land governance, and legal education as interconnected pillars. These three elements are analyzed not as separate initiatives, but as complementary efforts in which legal frameworks such as the Basic Agrarian Law (UUPA) serve as the foundation, the digital land system increases transparency and reduces manipulation, and legal education strengthens public legal awareness to prevent land-related crimes. The results of the study show that although each component has its advantages, challenges remain, especially in the implementation of inconsistent legal regulations such as the UUPA. However, if coordinated effectively, these elements can reinforce each other in the national legal system. In conclusion the integrated application of these components can promote a fair, transparent, and socially just land governance structure.

Abstract

This paper examines the dynamics of anti-terrorism regulations in Indonesia, Malaysia and the United States by comparing the legal frameworks and law enforcement mechanisms in each country. legal frameworks and law enforcement mechanisms that apply in each country.
