Abstract

Indonesia is a country that upholds people's sovereignty which is carried out based on law, this is confirmed constitutionally in Article 1 paragraph (2) of the 1945 Constitution. In electing leaders, the people are allowed to determine them directly, namely through an election process. At the regional level, there are Regional Head Elections (Pilkada). Initially, the Supreme Court had the authority to resolve regional election disputes as emphasized in Article 106 paragraph (1) of Law Number 32 of 2004 concerning Regional Government. In its development, this authority was transferred to the Constitutional Court with the passing of Law Number 12 of 2008 concerning the Second Amendment to Law Number 32 of 2004 concerning Regional Government. Then, the authority of the Constitutional Court in deciding disputes over regional head election results was declared unconstitutional through Constitutional Court Decision Number 97/PUU-XI/2013. However, in the end, the Constitutional Court again took over the authority to resolve regional election disputes through Constitutional Court Decision Number 85/PUU-XX/2022. In this study, we will discuss the authority to resolve regional election disputes while still at the Supreme Court. Then, the following discussion examines the discourse on forming a particular judicial body in resolving regional election disputes. The final debate will examine the authority to resolve regional election disputes of the Constitutional Court from when it was still a temporary authority until it became a permanent authority after Constitutional Court Decision Number 85/PUU-XX/2022.

Abstract

This study focuses on analyzing the role and challenges faced by the Constitutional Court in upholding political and civil rights in Indonesia and Austria. This research explores various conceptual and comparative aspects of law through normative research methods and delves deeper into how these institutions operate in practice. Analysis shows that the Constitutional Courts in both countries serve as the primary guardians of justice and human rights. However, it must also operate in a complex environment, dealing with social, political, and international challenges. The study found that changes in laws and regulations have significant potential to strengthen the authority and effectiveness of the Constitutional Court. This is reflected in the constitutional evolution in both countries, where legal and regulatory reforms have played an important role in shaping and defining the authority of the Constitutional Court. This study confirms the importance of increasing the capacity and legal knowledge of members of the Constitutional Court, as well as the need for greater understanding and appreciation from the public of this institution's vital role and function. This research contributes to understanding how constitutional institutions can adapt and evolve to meet challenges in enforcing political and civil rights.

Abstract

In Indonesia, the Constitutional Court has the power to decide the dispute over the result of the national election, including that of the regional head election. In practice, the Constitutional Court exercises power with the so-called pseudo-judicial review for the result of the regional election dispute. This study aims to analyse the rationale of the Constitutional Court to implement a pseudo-judicial review over the regional head election result, given the judicial activism that also is limited to checks and balances. It also links the theoretical basis for rule-breaking and judicial activism by the Constitutional Court, the transition of the Constitutional Court's power in deciding regional election disputes from temporary to permanent, as well as further analysis of why the Constitutional Court needs to file a lawsuit for review. This study used legal research that examined legal principles and regulations with a theoretical approach analysed qualitatively. The results of this study indicate that pseudo-judicial review affirms the legal breakthrough beyond ordinary decisions as this was made on the ground of the public interest. While the Constitutional Court is essential in maintaining and overseeing democracy in Indonesia, the rationale of the Constitutional Court under the public interest is justified as it is constitutionally correct that has led to judicial activism. A pseudo-judicial review is for substantial justice and can influence time efficiency.Keywords: Constitutional Court, Judicial Review, Local Election Disputes.

Abstract

Judges, deemed God's agents for law enforcement globally, are the focus of this study, which analyzes their pivotal role in establishing justice within society. This examination adopts Oliver Wendell Holmes' Sociological Jurisprudence theory, advocating the perception of law as a mirror reflecting societal values and norms. Holmes emphasizes that judges must comprehend the social and economic context to apply the law effectively. Their interpretation should align with societal objectives, ensuring legal decisions resonate with contemporary societal realities. Judges must possess the acumen to adapt to societal shifts and discern the social implications of their rulings. This research delves into how Holmes' ideologies influence law enforcement, human rights protection, and the prevention of legal transgressions. Additionally, it traces Holmes' theories in the context of the Indonesian Judicial Power Act. Employing a juridical normative approach with a philosophical foundation, this study demonstrates the vital role of judges in upholding societal values of justice, corroborating Holmes' Sociological Jurisprudence theory. By considering the societal context, judges contribute to the development of a legal system that is equitable and responsive to societal transformations. This investigation also validates Holmes' theories' integration within the Indonesian Judicial Power Act.

Abstract

Indonesia is a country that is famous for its multiculturalism, one of which is religion. Consequently, in living their lives, Indonesian people are faced with differences in various things, ranging from culture, way of life and interactions between individuals. The concern of the government and other components of the nation is the issue of inter-religious relations. One of the problems in inter-religious relations is the issue of mixed marriages (inter-religious marriages), which in this article are referred to as “interfaith marriages”. The condition of the pluralistic Indonesian society makes the association in society wider and more diverse. This has resulted in a more dynamic shift in religious values ​​than what happened in the past. In fact, interfaith marriages in Indonesia are not justified based on positive national law that applies in the territory of Indonesia. It can be concluded that if the State legalizes interfaith marriages in Indonesia, the State is tantamount to violating the existing religious laws in Indonesia, and violating Article 29 of the 1945 Constitution which guarantees every citizen to embrace religion and worship according to their religion and belief, while Each religion has different procedures for marriage or worship. The view of human rights in Indonesia should refer more to the human rights arrangements contained in the 1945 Constitution, not to the UDHR which we ourselves do not know who made it and even what the agenda is for a country that is still very religious. Human rights in Indonesia, not secular human rights, which separate religion from the state, which legalize all means in the name of "human rights", this clearly contradicts the first principle of Pancasila, and this does not enter into the identity of the Indonesian nation. In this article, interfaith marriage will also be studied from the perspective of criminal law regarding its legality.

Abstract

This research aims to answer problems related to the regulation of the concept of punishment in environmental aspects in the Indonesian criminal justice system. Secondly, this research aims to answer the juridical implementation of the concept of Straight Liability and Liability Based On Fault in environmentally sound economic development in Indonesia. This research uses normative legal research that focuses on primary, secondary, and tertiary legal materials. This research obtained several important points including legal arrangements related to the concept of environmental crime regulated in Law Number 32 of 2009 concerning Protection and Management of the Indonesian Environment. Second, the implementation of the concept of Straight Liability and Liability Based On Fault in environmentally sound economic development in Indonesia so far has not been maximised. This is due to the lack of mentality and consistency of law enforcement officials to enforce environmental law in a complex manner. So that this research proposes to strengthen the essence and existence of law enforcement officials in enforcing environmental law in order to preserve Indonesia's environmental ecosystem.

Abstract

Beragama di Indonesia merupakan hak yang diakui dan dilindungi oleh hukum, namun juga muncul perdebatan mengenai apakah beragama merupakan suatu hak atau suatu keharusan. Penelitian ini berangkat dari perkara yang teregister dengan nomor 146/PUU-XXII/2024 mengajukan gugatan terhadap aturan yang membatasi kebebasan untuk hidup tanpa beragama di Mahkamah Konstitusi. Muncul permasalahan utama, apakah memeluk agama dan kepercayaan di Indonesia hanya sebatas hak atau merupakan suatu keharusan. Penelitian ini menggunakan metode hukum normatif dengan pendekatan studi undang-undang dan analisis putusan Mahkamah Konstitusi (MK). Hasil penelitian menegaskan bahwa memeluk agama di Indonesia merupakan suatu keharusan yang berakar pada amanat filosofis dari Pancasila, khususnya dalam sila pertama "Ketuhanan Yang Maha Esa," dan secara normatif tercantum dalam dasar hukum tertinggi, yaitu Undang-Undang Dasar 1945. Putusan MK Nomor 140/PUU-VII/2009 dan Nomor 97/PUU-XI/2013 juga memperkuat pandangan ini dengan menegaskan pentingnya pengakuan dan perlindungan terhadap hak beragama serta tanggung jawab negara untuk menjamin kebebasan beragama. Maka, kajian ini berkontribusi pada pemahaman mengenai posisi kewajiban beragama dalam konteks hak asasi manusia di Indonesia.

Abstract

Pembentukan Mahkamah Konstitusi (MK) secara global sering kali menandai transisi dari pemerintahan otoriter ke pemerintahan demokratis, dengan constitutional review sebagai kewenangan utamanya. Studi tentang pembentukan MK di Eropa, Amerika, Afrika, dan Asia menyoroti perannya dalam menegakkan demokrasi. Judicial activism muncul sebagai pendekatan progresif dalam constitutional review, memperkuat konstitusi dan prinsip checks and balances. Namun, dalam praktiknya, beberapa putusan MK tidak diindahkan oleh para adresatnya, meskipun putusan tersebut memiliki makna filosofis dalam kerangka ketatanegaraan Indonesia. Penelitian normatif ini menggunakan studi kasus dan studi perbandingan hukum untuk menekankan kekuatan filosofis dalam putusan MK, terutama dalam kewenangan constitutional review. Judicial activism dipandang penting untuk menegakkan konstitusi dan menjaga nilai-nilai filosofis Pancasila yang terkandung dalam UUD 1945.

Abstract

Perselisihan antara masyarakat hukum adat dan masyarakat umum, negara, maupun pihak swasta banyak terjadi di Indonesia. Penelitian ini bertujuan untuk menganalisis penyelesaian sengketa kepemilikan tanah ulayat dalam sistem hukum pertanahan Indonesia dan menjelaskan mengenai kepastian hukum kepemilikan tanah ulayat mayarakat hukum Adat Muara Sakal. Metode penelitian yang digunakan dalam penelitian ini adalah yuridis empiris. Hasil penelitian menunjukkan bahwa pengakuan terhadap hak ulayat masyarakat hukum adat di Indonesia masih lemah, yang terlihat dari sering terjadinya perselisihan terkait tanah ulayat. Perselisihan semacam ini mencerminkan kurangnya kepastian hukum dalam penyelesaian sengketa tanah adat. Perselisihan ini dapat diselesaikan jika peraturan tentang masyarakat hukum adat yang mengatur syarat-syarat pengakuan masyarakat adat dan hak tradisionalnya diterbitkan oleh pemerintah.

Abstract

Hakim adalah wakil Tuhan dalam menegakkan hukum di dunia. Salah satu kajian utama dalam penelitian ini adalah menganalisis peranan hakim dalam menggali keadilan dalam masyarakat, dengan menggunakan perspektif teori Sociological Jurisprudence yang dikemukakan oleh Oliver Wendell Holmes. Dalam pandangan Holmes, hukum harus dipahami sebagai refleksi dari nilai-nilai dan realitas sosial yang ada dalam masyarakat. Penelitian ini mengeksplorasi bagaimana teori Sociological Jurisprudence memengaruhi cara hakim memandang dan menginterpretasikan hukum untuk mencapai keadilan. Holmes menekankan bahwa hakim harus memahami konteks sosial dan ekonomi di mana hukum diterapkan. Hakim harus melihat hukum sebagai alat untuk mencapai tujuan sosial yang lebih besar dan memastikan bahwa keputusan hukum mereka mencerminkan realitas sosial saat ini. Ini memerlukan kemampuan hakim untuk beradaptasi dengan perubahan dalam masyarakat dan memahami implikasi sosial dari keputusan hukum mereka. Penerapan teori Holmes tersebut dikaitkan dengan Studi Putusan Nomor 119/Pid.Sus-TPK/2018/PN/Bdg dalam penelitian ini, dimana dalam putusan tersebut hakim telah melakukan suatu penggalian nilai-nilai keadilan dalam masyarakat. Penelitian ini menguraikan bagaimana pandangan Holmes tentang hukum dan keadilan memiliki dampak pada penegakan hukum. Penelitian ini juga akan menelusuri pemikiran holmes dalam Undang-Undang Kekuasaan Kehakiman di Indonesia. Metode penelitian yang digunakan dalam penelitian ini adalah normatif yuridis dengan menggunakan pendekatan filosofis. Hasil dari penelitian ini akan memperlihatkan bahwa peran hakim dalam menggali nilai-nilai keadilan dalam masyarakat, sebagaimana yang ditegaskan di dalam teori Sociological Jurisprudence oleh Holmes telah direalisasikan di dalam Putusan Nomor 119/Pid.Sus-TPK/2018/PN/Bdg. Hal ini dianggap penting dalam memastikan bahwa hukum mencerminkan dan mendukung keadilan sosial.
