Abstract

This The Ministry of Religion has issued Circular Letter No. 6 of 2020 concerning Ramadhan and Eid Al-Fitr 1 Guide Syawal 1441 H in the midst of the Covid-19 pandemic. One thing that is interesting from this Circular Letter is that in pawns 11 sub a, whose contents appeal to all Muslims to hasten the payment of zakat. From this background the question arises as follows: first how is the problem of ta'jil az-zakah in the pandemic Covid-19 seen from the proposition of the Qur'an? Secondly, how is the view of the ulama related to ta'jil az-zakah during the pandemic Covid-19? To answer this question, normative juridical approach or doctrinal law research is analytical descriptive. The results of the study note that, firstly the Qur'anic argument was not found in the verse specifically discussing ta'jil az-zakah, but permissibility of ta'jil az-zakah was included in the generality of the verse about advice to hurry the good. Secondly, there is a difference of opinion among scholars regarding ta'jil law az-zakah. The majority of scholars allow ta'jil az-zakah both zakat mal and zakat fitrah with several provisions.

Abstract

Among Muslims, there is no denying the existence of Islamic law with the character of universality existence. This is supported by the passages of the Qur’an al-Anbiya> ‘ (21) 107. Universality enforceability of Islamic law necessitates submission of all followers of Islam on the teachings of Islam, wherever and whenever they are in, and also necessitates the existence of universal values embodied in the laws of branches that may differ from one place and other places. That’s why Muslims in Islamic countries and countries relative Muslim majority found no obstacles in relation to the application of Islamic law in their daily lives. Reality in the Islamic law is different if grown among the Muslims who are a minority in a secular country, namely the state with the government system separating religion as a matter private. In this paper will be discussed how a position and application of Islamic family law in the country with a minority Muslim population, especially those in England.[Di kalangan umat Islam, tidak ada yang memungkiri eksistensi hukum Islam dengan karakter universalitas keberlakuannya. Hal ini didukung oleh nas} al-Qur’an surat al-Anbiya>’ (21) ayat 107. Universilitas keberlakuan hukum Islam meniscayakan ketundukan semua pemeluk Islam pada ajaranajaran Islam, dimanapun dan kapan pun mereka berada, dan juga meniscayakan adanya nilai-nilai universal yang terkandung di dalam hukum-hukum cabang yang mungkin berbeda antara satu tempat dan tempat lainnya. Karena itulah umat Islam di negara-negara Islam dan negara yang mayoritas penduduknya beragama Islam relatif tidak menemukan kendala dalam hubungannya dengan aplikasi hukum Islam dalam kehidupan keseharian mereka. Kenyataan di atas tentu berbeda jika hukum Islam berkembang di kalangan muslim yang merupakan minoritas di negara sekuler, yaitu negara dengan sistem pemerintahan yang memisahkan agama sebagai masalah privat. Abstract

The pattern of harmonization of the age limit for marriage in Indonesia between living law and positive law is described in this study. The purpose of this descriptive-analytic study is to provide a comprehensive explanation of the age limit for marriage from a variety of perspectives. The method of seeking to harmonize Islamic and positive law was then used to analyze and interpret the obtained data. Harmonization in limiting the age of marriage can be seen in three ways, according to the findings of this study: First, the philosophical differences between the two regarding how to interpret marriage's purpose. According to both positive and Islamic law, marriage is intended to benefit both parties. Second, Epistemological Considerations Islamic law provides an epistemological foundation for the government's age limit for marriage, siyasah syar'iyyah. Third, the legal aspect: despite the fact that positive law stipulates that a person must be 19 years old to get married, the state provides a marriage dispensation mechanism as an emergency exit for marriages performed before that age

Abstract

Artikel ini mengkaji tentang sewa menyewa pohon durian di Desa Rogoselo. Kajian ini difokuskan pada bagaimana mekanisme sewa menyewa pohon durian di Desa Rogoselo dan bagaimana tinjauan fiqh muamalah terhadap pelaksanaan sewa menyewa pohon durian di Desa Rogoselo. Penelitian ini masuk ke dalam jenis penelitian field research (penelitian lapangan) dengan teknik purposive sampling dalam mencari informan di lapangan dan menggunakan pendekatan Kualitatif. Hasil penelitian ini menunjukkan bahwa mekanisme sewa menyewa pohon durian sudah sesuai dengan fiqh muamalah, dimana dari awal sampai akhir prosedurnya sudah tepat dan tidak ada yang melanggar aturan fiqh muamalah. Dan Tinjauan Fiqh Muamalah terhadap praktik sewa menyewa pohon durian di Desa Rogoselo akadnya fasid/rusak karena tidak memenuhi rukun dan syarat sewa menyewa yaitu pertama, dalam sewa menyewa pohon durian Objek akad/Manfaatnya belum ada (ma’dum), Kedua, adanya ketidakpastian (gharar), Ketiga, buah yang menjadi objek sewa belum jelas kualitasnya, Keempat, manfaat tidak dapat dimanfaatkan secara langsung oleh penyewa Kelima, terdapat pendapat Ulama yang tidak memperbolehkan akad sewa pohon berbuah karena buah itu termasuk materi bukan manfaat. Keenam, terdapat resiko dalam sewa menyewa pohon durian yaitu produktivitas belum jelas dan buah bisa saja tidak manis karena pengaruh curah hujan dan cuaca di Desa Rogoselo.

Abstract

Peran Pendidikan Diniyah (keagamaan) untuk membangun karakater anak sejak dini sangan fundamental, karena pada fase pendidikan inilah anak-anak kita bentuk agar memiliki perilaku sikap yang baik. Semestinya tanggung jawab untuk mendidik anak bukan hanya menjadi tanggung jawab guru di Madrasah atau majelis taklim. Namun juga menjadi tanggung jawab para orang tua untuk memastikan mereka memiliki kesamaan visi dalam mencetak anak yang berbudi luhur. Sedangkan pada kenyataannya banyak orang tua yang merasa telah selesai memberikan pendidikan kepada anak ketika mereka mendaftarkan anak-anaknya ke Madrasah Dinyah. Inilah yang menjadi dasar pentingnya program pengabdian ini untuk dilaksanakan di MDT Al Islah Karangjompo Pekalongan. Metode program pengabdian ini berupa Service Learning, dimana tim pengabdi dari kalangan akademisi memberikan stimulus kepada sasaran program agar dapat melaksanakan dan mengembangkan program yang sesuai, dimulai dari tahapan pra implementasi, implementasi dan pasca implementasi.Hasil program pengabdian ini adalah terfomulasikannya kerangka kurikuler gagasan Al Ghazali dalam kitab Ayyuha al Walad dan model pendidikan Islam K.H. Abdurrahman Wahid dalam bidang penguatan akhlak yang siap pakai, modul silabi pendidikan kitab Ayyuha al Walad yang dapat digunakan dan dikembangkan oleh Guru pada pelajaran lainnya, serta disepakatinya program pengajian wali santri MDT Al Islah setiap bulan untuk memberikan penguatan dan kesadaran mereka tentang tanggung jawab para orang tua dalam mendidik anak.

Abstract

The purpose of this research is to determine whether or not cryptocurrencies are legitimate in Islam as both a currency and a commodity. This is research done in a library. The research is descriptive-analytical and uses Jasser Auda's Islamic legal philosophy approach to try to explain cryptocurrency law. The findings demonstrate that, from the standpoint of Islamic legal philosophy, the law governing cryptocurrency as a currency is comprehensive (tafsil). Whether it is halal or not by looking at how the goal was achieved, specifically (benefit). If the cryptocurrency has clear benefits, such as the existence of underlying assets and the government's role in realizing the general benefit (maslahah ammah), it can be considered halal. Similarly, cryptocurrencies that lack clear regulations and are not backed by assets will be haram due to the possibility of mafsadat. Despite the fact that cryptocurrencies are regarded as al-Ma'l al-ma'nawiyyah because they do not conform to the objectives of sharia in assets (maqashid as-shari'ah fi al- mal), the law of cryptocurrencies as assets (crypto assets) is not valid. This research certainly has limitations, especially related to field data, namely interviews with cryptocurrency business actors. Therefore, to develop further research, not only juridical research but also juridical-empirical research.

Abstract

Goods delivery service (jastip) is a service assistance service to buy certain goods that are presented through web-based media, and for this assistance the perpetrators of the delivery service will receive fees or wages. The owner of the Instagram account @azkaestu provides this web-based buying and selling service by applying the price of goods and estimates combined with the cost or wage rate for the service if the customer does not ask directly, and does not explain what the cost of the store is. Based on the above background, the formulation of the problem in this study are: 1. How is the practice of goods deposit services on the @azkaestu Instagram account owner?, 2. What is the perspective of Islamic law on goods deposit services?, 3. What is the positive legal perspective on goods deposit services? ? The conclusion that can be drawn is the mechanism for determining ujrah on the @azkaestu Instagram account by entering administrative wages which are combined into the product cost price called include. The wage rate for administration usually ranges from 10-50% of the product cost and this depends on the operational services of the goods or the needs of the custodians. Meanwhile, the positive legal view on online application-based transactions involving online deposit services is essentially an engagement.

Abstract

This study aims to analyze the inheritance distribution system within the Dayak community in Indramayu using a juridical-socio-cultural approach. The research employs a qualitative-descriptive method, integrating the analysis of positive law and customary law with local socio-cultural values specific to the community’s unique context. Data were collected through field observations, document studies, and semi-structured interviews with customary leaders and members of the Dayak community. The data analysis technique is based on the interactive model of Miles and Huberman and utilizes a normative-juridical and cultural-interpretive approach to explore the ongoing dynamics. The findings reveal that the bilateral kinship structure and customary principles such as Sejarah Alam Ngaji Rasa (the natural history of internal reflection), Menyatu dengan Alam (oneness with nature), and Ngaula Ning Anak Rabi (dedication to one's offspring and their spouses) influence an egalitarian inheritance system, although variations exist among subgroups. However, within the framework of legal pluralism and distributive justice, the system still reflects disparities, particularly concerning the rights of women and adopted children in matters of inheritance. The study recommends reformulating customary law to be more responsive to contemporary social justice values and to ensure the principles of non-discrimination and equality in the inheritance distribution process.
