Abstract

ABSTRAKSI Masyarakat hukum adat mempunyai hubungan yang sangat erat dengan tanah wilayahnya. Hal ini dapat dipahami, bahwa masyarakat hukum adat sangat menggantungkan sumber pencahariannya pada tanahnya. Kewenangan untuk menguasai, mengatur dan mengurus semua tanah, secara struktus kemasyarakatan adat lebih diserahkan pada Ketua Adat dan pengurusnya. Oleh karena ini dalam tatanan kehidupan masyakat hukum adat, Ketua maupun pengurus adat mempunyai kewenangan, seperti melakukan perbuatan hukum perjanjian sewa menyewa tanah adat. Penulisan ini membahas masalah mengenai prosedur perjanjian sewa menyewa tanah adat, dan model penyelesaian jika terjadi perselisihan dalam perjanjian sewa menyewa tersebut. Prosedur pelaksanaan perjanjian sewa menyewa tanah adat di dilakukan melalui lembaga adat. Setelah terjadi kesepakatan antara lembaga adat dengan pihak penyewa mengenai harga sewa dan jangka waktu sewa serta hak dan kewajiban dari para pihak, penyerahan hak seketika terjadi setelah dilunasinya uang sewa. Apabila timbul sengketa pada perjanjian sewa menyewa tanah adat, dapat diselesaikan dengan pola negosiasi. Pemindah tanganan dalam hal perjanjian sewa menyewa tanah adat dilakukan secara tunai dan nyata karena dilakukan dihadapan Kepala Adat dan terjadi setelah dilunasinya uang sewa. Apabila timbul perselisihan akibat perjanjian tersebut dapat diselesaikan dengan pola musyawarah.  Kata kunci: Penyelesaian sengketa, Perjanjian sewa menyewa, tanah adat. ABSTRACT Indigenous peoples have a very close relationship with their territorial land. It can be understood, that the customary law community is very relying on its resources on its soil. The authority to control, regulate and manage all the land, the customary community in structure is more submitted to the Chairman of Adat and its successor. Therefore, in the order of life of Adat Law, the chairman and the customary officers have the authority, such as doing legal action lease agreement of the customary land. This writing addresses the matter regarding the procedure of renting lease agreements on customs, and the model of settlement in case of disputes in the lease agreement. The procedure of implementing lease agreements on customary land Charter is carried out through customary institutions. After the agreement between the Adat institution and the renter regarding the rental price and lease period as well as the rights and obligations of the parties, the right to surrender immediately after the lease. If disputes arise on the lease agreement of customary land, can be solved by a pattern of negotiation. The alienation in terms of lease agreements on the customary land Charter is done in cash and real because it is done before the head of Adat and occurs after the rent. In the event of disputes arising from such agreements can be resolved by deliberation pattern. Keyword: dispute resolution, lease agreement, customary land.

Abstract

ABSTRACTThe majority of the public still considers the descendant (son) is a very essential element for a family that wishes to remain intact. So the importance of the descendants in the family, it can be potentially polygamous or occurrence of a divorce. Therefore, adoption is an alternative that can be done, in order that the purpose of marriage is to form a happy and eternal family come true. The implementation of the adoption on the basis of custom or customary law still do in order the life of indigenous peoples, since the custom is an expression of the belief that so long embedded, hereditary, thus leading adherence to customary law on any of their citizens. With regard to the recognition of adoption is done based on customary law in the Government Regulation Number 54 of the year 2007, there are clauses that are not singkron associated with recognition of the adoption is carried out on the basis of customary law . I.e. in article 1 point 1 asserted that the adopted child is recognized when it is done on the basis of a decision or determination of the Court. However, in article 8, there is a recognition of how adoption in customs. Next up in article 9 paragraph (1), still contains provisions related to the recognition of the institution of adoption is done based on custom.

Abstract

Sebagai makhluk sosial, manusia akan membutuhkan manusia lainnya dalam kehidupan sehari-hari. Interaksi antar manusia perlu adanya aturan agar tidak terjadi sengketa, yakni dengan cara membuat suatu perjanjian. Sehinggga para pihak yang terikat perjanjian tersebut mengetahui akan adanya hak dan kewajibannya. Perjanjian merupakan suatu perbuatan dengan mana satu orang atau lebih mengikatkan dirinya terhadap satu orang lain. Di kalangan petani tradisional juga mengenal adanya perjanjian untuk melakukan kegiatan pertaniannya sehari-hari. Yakni terutama dikalangan Petani pemilik dan Petani penggarap. Sedangkan pada umumnya perjanjian yang mereka biasa lakukan  tersebut bentuknya tidak tertulis. Hal ini dilakukan secara turun-temurun mengikuti kebiasaan yang berlaku. Perjanjian dalam perundang-undangan diatur dalam ketentuan Pasal 1320 Kitab Undang Undang Hukum Perdata, yang merupakan suatu aturan hukum warisan kolonial Hindia Belanda. Perjanjian dikatakan sah harus memenuhi: kesepakatan, kecakapan, suatu hal tertentu, dan suatu sebab yang halal. Perjanjian tidak tertulis atau lisan yang dilakukan oleh para petani tradisional adalah perjanjian yang sah dan memenuhi ketentuan perundang-undangan yang berlaku. Kalangan petani tradisioanl mempunyai cara sendiri pelaksanaan perjanjian tidak terjadinya wanprestasi. Yakni dengan menciptakan rasa saling percaya, melakukan pengawasan sosial berupa budaya malu, mendatangi rumah pihak yang diperkirakan wanprestasi, dan didukung dengan keadaan para pihak yang yang mempunyai hubungan kekeluargaan, saling tolong menolong, dan solidaritas yang tinggi antar anggota masyarakat

Abstract

The national land law does not stipulate that the company's usufructuary rights can be cultivated on management rights land and customary law community land becomes management rights. This study aims to identify and analyze the process of ulayat land concession agreements by companies and the status of ulayat lands if the agreement between the company and customary law communities related to ulayat land concessions has ended and uses a normative juridical method, namely the data source used is secondary data, obtained from official documents, books and written reports. The results begin with a land use agreement, the status of communal land changes after the agreement expires with management rights to which the company's usufructuary rights apply for customary law communities.

Abstract

The practice of money politics is one type of electoral and regional election crime. In practice, not all money politics cases can proceed to the Courts. For example,based on data from the Bawaslu of Central Java Province, the number of alleged money politics in the 2019 election was 66 cases. Of the 66 cases that can be processed to court, only 5 cases. This can be stated that so far law enforcement against cases of money political practices in elections has not been optimal. Therefore, repressive and preventive efforts are needed. One of the preventive efforts as carried out by the Sedulur Sikep community living in Baturejo Village, Sukolilo District, Pati Regency. This community applies the concept of "ngugemi ajaran leluhur" which contains ancestral principles and teachings to reject money politics. This study is interesting because currently the values of local wisdom are starting to fade but the people of Sedulur Sikep are still implementing and maintaining the values of local wisdom. The urgency of this research is as a reference or input for the government or related institutions in the context of conceptualizing the prevention of money politics in elections. The results of this study concluded that the concept of "ngugemi ajaran leluhur" containing ancestral principles and teachings is still applied and used as a guideline for life by the Sedulur Sikep community until now. The Sedulur Sikep community's rejection of money politics in elections is based on its adherence to ancestral principles and teachings.
