Abstract

The purpose of this research is to analyze E-voting arrangements in organizing elections in Indonesia in accordance with the principles of organizing elections in Indonesia. This research is normative legal research which bases its analysis on applicable laws and regulations that are relevant to the legal issues that are the focus of the research. The research data sources are primary data, secondary data and tertiary data which are then analyzed juridically-qualitatively and presented in descriptive form. The research results show that implementing E-voting can overcome various problems in conventional voting systems, but implementing E-voting in elections in Indonesia faces challenges in terms of the readiness of the government, election organizers (KPU), and community culture. Although E-voting offers efficiency and increased participation, clear regulations are still missing, hindering widespread implementation. The readiness of infrastructure and human resources is also an issue, considering the need for adequate training and technology. In addition, people's cultural tendencies that tend to be skeptical of new technology can influence the acceptance of E-voting. Therefore, a comprehensive study and gradual preparation are needed to optimize the implementation of E-voting.

Abstract

The legislative body is an institution or council that has the duty and authority to make laws and constitutions in a country. In the general explanation of Law Number 23 of 2014, it is stated that the Regional People's Representative Council, hereinafter abbreviated as DPRD, is a Regional People's Representative Institution which serves as an organizing element of the Regional Government.This research using a qualitative descriptive analysis method, namely by explaining or describing the data obtained by providing logical and correct interpretations in accordance with existing facts and or legal rules that are closely related to this research. So this research is a research that is sourced from primary and secondary data using an empirical juridical approach. Based on the research results, the use of the initiative right of Sikka DPRD members in making local regulations in 2018-2021 is still less than optimal. This can be seen based on data on the number of draft local regulations passed in 2018-2021. The number of local regulations produced by Sikka Regency is 34 (thirty-four) local regulations, including 4 (four) local regulations initiated by the DPRD and 30 local regulations initiated by the Regional Government. DPRD tends to be considered passive in contrast to the Local Government which is more pro-active because the proposal of local regulations (Perda) is more dominated by the regional legislative body than the executive body. The obstacles in the implementation of the legislative function of the DPRD of Sikka Regency are caused by internal factors such as level of education and experience, as well as external factors such as lack of political communication between the DPRD and the Local Government. Based on the results of the study, the author's suggestion is that the proposed local regulations be examined and scrutinized in depth to ensure their legal content and impact on society. The DPRD of Sikka Regency needs to improve the capacity of human resources through training and technical guidance related to the formation of initiative local regulations by involving academics and experts.

Abstract

The purpose of this research is to analyze the implementation of the duties and authorities of the Village Government in the provision of clean water in Lusilame Village and Nuba Atalojo Village, Atadei Sub-district, Lembata Regency as viewed from Law No. 6 of 2014 concerning Villages. The research method used in this research is Empirical research. The location of this research was Lusilame Village and Nuba Atalojo Village, Atadei District, Lembata Regency. The type of data used in this research is qualitative data. The data used in the research based on the relevance of the source data, namely primary data and secondary data. Data collection techniques in this study were carried out by interview, observation, and literature/documentation studies. Data processing techniques in this study include editing, coding, and tabulation. The result of this research is that the implementation of the duties and authority of the Lusilame Village government in implementing development related to the provision of clean water is still less than optimal. As for Nuba Atalojo Village, in carrying out its duties and authorities, the government has tried its best so that the community can be helped by the existence of boreholes even though it is still difficult during the dry season. In terms of Law No. 6/2014 on Villages, the governments of Lusilame Village and Nuba Atalojo Village have also been effective in planning, implementing and monitoring because they include the village community, although only some people have the willingness to be involved. There are 3 main factors that inhibit the duties and authority of the village government in providing clean water, namely, the first is the availability of funds, human resources, and community participation.

Abstract

This research aims to determine the legal awareness of village communities in administering Child Identity Cards (CIC) and the factors inhibiting village community legal awareness in administering Child Identity Cards (CIC) in Sunsea Village, Naibenu District, North Central Timor Regency. This researcher uses qualitative research methods which in legal research are called empirical research and the research aspects consist of legal knowledge, legal understanding, legal attitudes and legal behavior. Researchers used a research location in Sunsea Village, Naibenu District, North Central Timor Regency with 30 respondents (4 Village Government, 1 BPD and 25 Community), and used primary and secondary data as types and sources of data. And the collected data is then processed using coding, editing, tabulation and analyzed systematically. The research results show that the legal awareness of village communities in processing children's identity cards in Sunsea Village, Naibenu District, North Central Timor Regency is low. This is proven by the results of research on four indicators including low legal knowledge, low understanding of the law, many people's legal attitudes that do not agree and many people's legal behavior that is not in accordance with the village community's legal awareness in managing children's identity cards (CIC). One of the internal inhibiting factors is knowledge, education and economics which tend to influence the legal awareness of village communities in processing children's identity cards, while the external inhibiting factors are the distance where the community lives and there is no cooperation between the government/certain agencies and the village government to carry out socialization.

Abstract

Sebuah sistem pemerintahan suatu negara keberadaan lembaga legislatif (parlemen) memang tidak bisa ditinggalkan. Hampir semua negara di dunia saat ini memiliki lembaga legislatif tak terkecuali Indonesia. Secara umum, ada tiga jenis sistem lembaga legislatif yang diterapkan oleh negara-negara di dunia, yaitu: (1) Sistem legislatif satu kamar, (2) Sistem lembaga legislatif dua kamar, (3) Sistem lembaga legislatif tiga kamar. Pada saat ini, sistem lembaga legislatif di Indonesia masih menjadi perdebatan. Rumusan Masalah dalam penelitian ini adalah: (1) Bagaimanakah struktur parlement di Indonesia berdasarkan Undang-Undang Dasar Negara Republik Indonesia tahun 1945? (2) Apa kelebihan dan kekurangan struktur parlemen di Indonesia? Penelitian ini merupakan penelitian hukum normatif yaitu dengan menggunakan Pendekan perundang-undangan, Pendekatan historis, Pendekatan konstitusional dan Pendekatan konseptual. Hasil penelitian ini menunjukan bahwa: (1) Pertama, Struktur parlemen di indonesia berdasarkan Undang-undang Dasar Negara Republik Indonesia tahun 1945 hasil amandemen, parlemen di Indonesia terdiri atas MPR, DPR dan DPD. Indonesia saat ini dianggap sebagai salah satu model negara yang merangkap model tiga kamar atau yang di sebut sistem trikameral. (2) Kedua, kelebihan sistem trikameral di Indonesia adalah: (1) Dianggap bisa menjamin pekerjaan yang bijaksana, tertib, teliti, hati-hati, serta dapat menghindarkan dari keputusan yang tergesa-gesa dan berat sebelah (2) Dianggap lebih bisa memberikan jaminan perlindungan terhadap kemungkinan timbulnya kesewenang-wenangan dalam perundang-undangan (3) Dianggap lebih demokratis karena adanya tiga lembaga parlemen negara yang terlibat secara adil dan mewakili seluruh kepentingan rakyat Indonesia. Sedangkan kekurangan sistem trikameral di Indonesia adalah: (1) Dari segi pendanaan, pengeluaran negara menjadi lebih besar karena adanya tiga lembaga parlemen di Indonesia dalam sistem trikameral ini. Berdasarkan hasil penelitian tersebut, maka saran peneliti adalah menyarankan untuk kelemahan sistem trikameral di Indonesia yang masih belum sempurnah dapat di evaluasi bagian-bagian yang belum sempurnah seperti adanya ketimpangan kewenangan antara tiga kamar parlemen di Indonesia sehingga kedepannya Indonesia dapat memiliki struktur parlemen yang sempurna untuk kepentingan negara Indonesia yang lebih baik.

Abstract

Penelitian ini bertujuan untuk mengetahui penyelesaian sengketa pemilu oleh Badan Pengawasan Pemilihan Umum Kabupaten Flores Timur. Teknik pengumpulan data pada penelitian ini menggunakan wawancara dan studi kepustakaan. Teknik analisis data yang digunakan adalah deskriptif kualitatif. Metode deskriptif adalah suatu metode yang digunakan untuk meneliti status sekelompok manusia, suatu objek, suatu set kondisi, suatu sistem pemikiran, ataupun suatu kelas peristiwa pada masa sekarang Pada pemilihan calon legislatif Tahun 2019 terdapat dua sengketa yang diselesaikan oleh Badan Pengawasan Pemilihan Umum Kabupaten Flores Timur. Sengketa yang diselesaikan termasuk dalam sengketa administrasi pemilu. Penyelesaian sengketa dilaksanakan melalui dua proses penyelesaian yaitu proses mediasi dan adjufikasi. Proses mediasi adalah tahapan menerima dan mengkaji permohonan penyelesaian sengketa pemilu serta mempertemukan pelapor dan terlapor dan mengambil keputusan melalui mediasi atau musyawarah. Sedangkan proses adjufikasi adalah proses yang dilakukan apabila mediasi belum mendapatkan kesepakatan dari kedua belah pihak. Proses penyelesaian sengketa dilaksanakan melalui prosedur penyelesaian sesuai dengan aturan yang berlaku. Adapun terdapat kendala dalam penyelesaian tersebut adalah kurangnya waktu dalam penyelesaian sengketa dan kurangnya staf untuk membantu proses penyelesaian sengketa.

Abstract

Pajak Bumi Dan Bangunan merupakan salah satu sumber pendapatn daerah yang sangat penting. Pengaturan Kewenangan Pengelolaan Pajak Bumi dan Bangunan telah mengalami beberapa perubahan dari sebelumnya dikelolah oleh Pemerintah Pusat menjadi Kewenangan Pemerintah Daerah. Sehingga perubahan ini memberikan implikasi terhadap pendapatan daerah. Pentingnya pajak bumi dan bangunan sebagai salah satu sumber pendapatan daerah yang signifikan, namun realisasinya belum optimal. Tujuan penelitian ini adalah untuk mengetahui Pengaturan Kewenangan Peneglolaan Pajak Bumi Dan Bangunan Di Kota Kupang Dan Implikasinya Terhadap Pendapatan Asli Daerah Kota Kupang. Metode penelitian yang digunakan adalah penelitian normatif yang ditunjang penelitian hukum empiris dengan data yang diperoleh melalui studi literatur dan wawancara dengan pihak yang terkait. Hasil penelitian menunjukan bahwa Pengaturan Kewenangan Pengelolaan Pajak Bumi Dan Bangunan Di Kota Kupang telah diatur dalam Peraturan Daerah Kota Kupang Nomor 1 Tahun 2011 Tentang Pajak Daerah Dan Peraturan Daerah Nomor 5 Tahun 2012 Tentang Pajak Bumi Dan Bangunan Pedesaan Dan Perkotaan. Hasil analisis menunjukan bahwa perubahan kewenangan pengelolaan PBB memberikan tantangan tersendiri bagi pemerintah daerah dalam meningkatkan penerimaan PBB. Pemerintah Daerah perlu melakukan berbagai upayah seperti peningkatan kapasitas pemungutan perbaikan basis data dan intesifikasi pemungutan untuk mengoptimalkan penerimaan PBB.

Abstract

The Village Head and the Village Consultative Body are two parties who are referred to as working partners in the process of implementing development programs in the village, this is because the BPD together with the Village Head determines the Village work program. In addition, the Village Head has the authority to lead the implementation of village government programs, while the BPD institutionally represents the village population and acts as a supervisor for the implementation of government programs in the village. Another function of the BPD is to accommodate and channel the aspirations of the village community. The village head and BPD must have the same thoughts in implementing village government, so that village government can be implemented in accordance with community expectations and demands. The problem formulation in this research is: (1) What is the working relationship between the Village Government and the Village Consultative Body? (2) What are the inhibiting factors in implementing development programs in Tribur village, South Abad District?The results of this research used empirical juridical research methods and the data was analyzed descriptively qualitatively where the focus of the research was planning, implementation, supervision and evaluation; namely research where the data was directly obtained from the research location for 15 people.

Abstract

The Akle Health Center of Kupang Regency always strives to serve the community well.well in all care needs including curative services(treatment), preventive (prevention efforts), promotive (health improvement)and rehabilitation (health restoration) with the hope that patients who obtain health services feel satisfied with the services provided.The purpose of this study is to determine the effectiveness of health services at the Akle Health Center, Kupang Regency, and to find out the inhibiting factors for the effectiveness of health services at the Akle Health Center, Kupang Regency. The type of research conducted is empirical juridical research. The types and sources of data used are primary and secondary data. Primary data is data obtained directly from the research location through direct interviews with respondents and based on researcher observations.Secondary data is data obtained from literature studies.Data analyzed descriptively qualitative. The results of this study indicate that: (1) The Effectiveness of Health Services at Puskesmas Akle Kupang Regency are: (a) Implementation of Health Services at Puskesmas Akle Kupang Regency, (b) Implementation of Preventive Health Services, (c) Implementation of Promotive Health Services, (d) Implementation of Curative Health Services, (e) Implementation of Rehabilitative Health Services. (2) Factors inhibiting the effectiveness of health services at the Akle Health Center, Kupang Regency are: (a) Human Resources, (b) Infrastructure Facilities, (c) System factors, Procedures and Regulations, (d) Skills.

Abstract

The purpose of this study is to analyze the implementation of the Regulation of the Minister of Education and Culture Number 64 of 2015 concerning Smokefree Areas in the School Environment as an Effort to Prevent Smoking in Students at Atambua Christian High School, Belu Regency. This type of research shows empirical juridical research. The results of this study indicate that the implementation of the Regulation of the Minister of Education and Culture Number 64 of 2015 concerning Smokefree Areas in the School Environment is not / or has not been effective. There are several factors that influence the successful implementation of this regulation including legal structure, legal substance, and legal culture. These three factors certainly have an interest that always hinders or influences the implementation of rules regarding Smokefree Areas so as to make these rules ineffective. Based on the results of the study, the authors have several suggestions, namely increasing supervision of the implementation of the no smoking area policy in the school environment, ensuring law enforcement against violations of regulations consistently and firmly to create discipline in the school environment and conducting regular counseling and education programs to all students, teachers, and staff including school guards about smoking and the importance of a smoke-free environment.
