Abstract

Law enforcement for fisheries management violations in East Flores, East Nusa Tenggara province has not been effectively implemented. It is proven in recent years, violation’s cases of fisheries management is significantly high. This study examines how local wisdom values of indigenous society overcome the ineffective law enforcement for fisheries management violations. This paper employs normative juridical approach and was carried out by identifying and collecting customary law principles which govern fishermen’s attitude. The results show that law enforcement has not been effectively implemented to solve fisheries management violations in terms of the structure, substance and culture of law. To overcome this, it requires functionalization of local wisdom values that have been proven to alleviate marine resources damage by fishermen. Functionalization of local wisdom values is conducted by establishing a partnership between law enforcement and traditional authorities to institutionalize and integrate values system, cultural traditions, and customary penalty to have formal mechanisms of law enforcement.Keywords: local wisdom, law enforcement, fisheries

Abstract

Kajian yang bersifat yuridis normatif ini dimaksudkan untuk menjelaskan dapatkah Presiden bertanggung jawab atas kebijakan menterinya yang menimbulkan korupsi. Berdasarkan sistem pemerintahan presidensial, Presiden bertang- gung jawab secara moral kepada rakyat apabila menteri mengeluarkan kebijakan yang melanggar nilai-nilai moral. Selanjutnya Presiden bertanggung jawab secara politik kepada rakyat: apabila menteri mengeluarkan kebijakan yang melanggar peraturan perundang-undangan, dan apabila kebijakan menteri telah merugikan keuangan negara. Berdasarkan teori kewenangan, Presiden adalah pemberi mandat dan menteri sebagai mandataris sehingga berlaku asas vicarious liability yaitu atasanlah yang bertanggung jawab, artinya Presiden bertanggung jawab secara hukum atas kebijakan menteri yang menimbulkan korupsi.

Abstract

This study analyzed the sub-system factors influencing the amendment of the Corruption Eradication Commission Act (KPK Law) from the Cybernetics theory and the impacts on the Constitution. According to this theory, there are various kinds of sub-systems, where one sub-system is interrelated with other sub-systems. Each of the sub-systems referred to will influence each other based on the primary function of each of these sub-systems, such as the cultural sub-system, which has the primary function of maintaining patterns, the social sub-system as a function of integrity, the political function as a function of achieving goals, and the economic sub-system as an adaptive function. This doctrinal legal research employed statutory approaches and concepts and found that changes in the KPK Law are influenced by the political sub-system factor, particularly the strong political interests of the House of Representatives and the Government. As a result, the amendment to the KPK Law is undemocratic because it does not fulfill the formal and material principles. In addition, it does not philosophically fulfill the function of law, leading to constitutional values violation.

Abstract

Adanya ketidakmurnian penerapan sistem pemerintahan presidensial sebagaimana yang ditentukan oleh UUD 1945 dimulai pada masa demokrasi liberal yakni adanya pertanggungjawaban menteri kepada badan perwakilan rakyat  dan pembentukan kabinet parlementer. Keadaan tersebut dilanjutkan pada masa Orde Baru dengan model pertangggungjawaban Presiden kepada MPR yang menunjukan pula sistem presidensial yang dilaksanakan memadukan dengan “gaya” parlementer.Selanjutnya sistem presidensial mengalami purifikasi melalui amandemen UUD 1945.Meski demikian, dalam praktek selama masa reformasi, pemerintahan presidensial masih juga dipadukan dengan “gaya” parlementer. Hal ini dibuktikan antara lain: (a) munculnya kompromi dalam pembentukan dan perombakan kabinet, sehingga sebagian besar kursi kabinet dibagi berdasarkan kehendak partai-partai politik pendukung pemerintah; (b) koalisi partai-partai politik pendukung pemerintah memiliki daya rekat rendah dan rapuh; dan (c) koalisi di tingkat kabinet tidak selamanya terjadi di tingkat parlemen karenanya sering partai-partai politik pendukung pemerintah tidak mendukung program pemerintahKata kunci: presidensial, parlementer, presiden, menteri AbstractExitance of the assembling impurities presidential government system in the same manneras be determinate by constitution 1945 be started of the unconventional the democracy period that is existence of the minister responsibility to the parliament and parliamentary the cabinet formation. Abstract

Analisis konseptual yang bersifat yuridis normatif ini dimaksudkan untuk menjelaskan bagaimanakah Mahkamah Konstitusi (MK) menggunakan teori penemuan hukum berupa: (a) penafsiran konteks, non sistematik, dan futuristik sebagai langkah progresif dalam menguji undang-undang, dan (b) penafsiran sosiologis atau teleologis dan heuristik untuk keabsahan MK menguji konstitusionalitas Peraturan Pemerintah Pengganti Undang-Undang. Abstract

AbstractThis research examines the Lamaholot customary law as an idea or unwritten customary idea but contain ethics and morals, in the form of a belief system, rituals, abstinence, and sanctions, which are then accommodated into a co-model management. This research becomes important to assist the top law enforcement fisheries management violations committed by traditional fishermen in the district East Flores and Lembata Regency, East Nusa Tenggara Province. This empirical legal research uses a statutory approach, the concept of legal anthropology with a socio-legal perspective, and cases. The results shows the number of cases of violations of fisheries management by traditional fishermen still high in the last few years. This proves that law enforcement has not been effective both from the structure, legal substance and culture. To overcome this, it is necessary to re-institutionalize customary law through a co-management model, namely the local government and law enforcement agencies forming a partnership model with customary stakeholders or functionaries to function re-belief systems, rituals, customary sanctions and mechanisms in the enforcement process law against traditional fishermen who exploit fishery resources illegally. AbstrakPenelitian ini mengkaji hukum adat Lamaholot sebagai ide atau gagasan adat yang tidak tertulis tetapi mengandung etika dan moral berupa sistem kepercayaan, ritual, pantangan, dan sanksi, yang selanjutnya diakomodir ke dalam sebuah model co-management. Penelitian ini penting dilakukan untuk membantu penegakan hukum atas pelanggaran pengelolaan perikanan yang dilakukan oleh nelayan tradisional di Kabupaten Flores Timur dan Kabupaten Lembata, Provinsi Nusa Tenggara Timur. Penelitian hukum empiris ini menggunakan pendekatan peraturan perundang-undangan, konsep antropologi hukum dengan perspektif sosio-legal, dan kasus. Hasil penelitian menunjukkan beberapa tahun terakhir jumlah kasus pelanggaran pengelolaan perikanan oleh nelayan tradisional masih tinggi. Hal ini membuktikan penegakan hukumnya belum efektif baik dari struktur, substansi dan budaya hukum. Untuk mengatasinya perlu pelembagaan kembali hukum adat melalui model co-management dimana pemerintah daerah dan lembaga penegak hukum membentuk model kemitraan dengan pemangku atau fungsionaris adat untuk memfungsikan kembali sistem kepercayaan, ritual, sanksi adat dan mekanisme dalam proses penegakan hukum terhadap nelayan tradisional yang memanfaatkan sumber daya perikanan secara ilegal
