Abstract

Drinking and uncommendable behavior are two intertwined things. Recently, an event that has disturbed the community has become more frequent. Some sexual crimes against children occur after the perpetrator drinks alcohol, where people will be encouraged to commit heinous acts, when their intellect has been influenced by alcohol. The Sikka Regency Government together with the Sikka Regency Regional People's Representative Council made Sikka Regency Regional Regulation Number 11 of 2012 concerning the Supervision and Control of Alcoholic Beverages, as a preventive effort to overcome social problems in the community, namely, the high number of traffic accidents, Domestic Violence (KDRT) and vandalism triggered by alcoholic beverages. This research is an empirical juridical law research. This study is descriptive and analyzes primary data to find out the Implementation of Sikka Regency Regional Regulation Number 11 of 2012 concerning Supervision and Control of Alcoholic Beverages. Data collection uses observation, documentation and interview techniques. The results of the study show that: (1) The implementation of Sikka Regency Regional Regulation Number 11 of 2012 concerning Supervision and Control of Alcoholic Beverages needs to be followed up because there are still obstacles faced (2) The impact of the Implementation of Sikka Regency Regional Regulation Number 11 of 2012 concerning Supervision and Control of Alcoholic Beverages, one of which is a decrease in revenue.

Abstract

The purpose of this study is to analyze the implementation of the Regulation of the Minister of Education and Culture Number 64 of 2015 concerning Smokefree Areas in the School Environment as an Effort to Prevent Smoking in Students at Atambua Christian High School, Belu Regency. This type of research shows empirical juridical research. The results of this study indicate that the implementation of the Regulation of the Minister of Education and Culture Number 64 of 2015 concerning Smokefree Areas in the School Environment is not / or has not been effective. There are several factors that influence the successful implementation of this regulation including legal structure, legal substance, and legal culture. These three factors certainly have an interest that always hinders or influences the implementation of rules regarding Smokefree Areas so as to make these rules ineffective. Based on the results of the study, the authors have several suggestions, namely increasing supervision of the implementation of the no smoking area policy in the school environment, ensuring law enforcement against violations of regulations consistently and firmly to create discipline in the school environment and conducting regular counseling and education programs to all students, teachers, and staff including school guards about smoking and the importance of a smoke-free environment.

Abstract

This research aims to find out and analyze freedom of opinion in social media in Indonesia. This research is a normative research supported by empirical juridical research methods. In this study, the research approach used by the researcher is the Statute Approach, the Comparative Approach, and the Case Approach. The data of this research is sourced from primary data in the form of observations and secondary data in the form of primary, secondary and tertiary legal materials collected using literature studies and observations and this research is analyzed in a qualitative descriptive manner. The results of the study show that (1) Freedom of opinion in social media in Indonesia is an independence in expressing feelings, thoughts, ideas, and expressions in virtual form that is accommodated by digital platforms such as social media but limited by the responsibility to maintain ethics, not harm others, and follow the applicable laws and regulations in Indonesia. (2) The implementation of freedom of opinion in social media in Indonesia still faces problems due to a lack of understanding of the limits of freedom of opinion, especially in social media, such as the spread of misinformation and defamation that can trigger chaos.

Abstract

This study aims to find out and analyze the regulation of environmental health management in Oeba Fish Market, Fatubesi Village, Kota Lama District, Kupang City, reviewed from Government Regulation Number 66 of 2014 concerning Environmental Health. This study is an empirical legal research that uses primary data and secondary data collected using observation techniques, interviews and document studies that are analyzed in a qualitative descriptive jurificial manner where the data obtained is selected and arranged systematically, interpreted and presented in the form of descriptions. The results of the study show (1) The Regulation of Environmental Health Management by the Oeba Fishery Port at Oeba Fish Market, Fatubesi Village, Kota Lama District, Kupang City based on government regulation number 66 of 2014 concerning environmental health as found in the field has been running but is not optimal. (2) Inhibitory Factors in the Regulation of Environmental Health Management in Oeba Fish Market, Fatubesi Village, Kota Lama District, Kupang City, namely law enforcement factors, facilities and infrastructure factors, human resource factors and community knowledge factors that are still very low regarding Government Regulation Number 66 of 2014 concerning Environmental Health.

Abstract

The principle of democracy and justice in general election (electoral justice) is that community involvement is absolute. General elections are a means of people’s sovereignty which is carried out directly, generally, freely, secretly, honestly and fairly and must meet the principles as referred to in Law Number 7 of 2017 concerning elections. The main problemsin the results of this research are: (1) How to realize clean, democratic and digfinified legislative elections, from the perspective of Constitutional Law? (2) Will there be money politics in the implementation of the 2024 elections, and what is the role of Bawaslu in handling these problems?. This research is a normative legal research, supported by empirical legal research, so that the data sources used are secondary data sources, primary data sources. Secondary data sources are obtained through literature, laws, and other literature, and supported by primary data obtained from findings in the field. Data are analyzed descriptively-qualitatively. The results of this study indicate that: (1) The implementation of clean and democratic general elections according to Constitutional Law in East Nusa Tenggara uses independent independence, functional independence, personal independence, and the principle of equality. (2) The role of Bawaslu in handling political money actions in East Nusa Tenggara seems to be still very minimal due to the welfare factor of the community which is still far from good standards so that it is still very difficult to report perpetrators of political money. Suggestions: (1) The public should be more vigilant against prospective leaders who do not have a sense of responsibility by buying votes. (2) The government should be more assertive in its level of supervision so that prospective leaders who engage in political corruption (money politics) should be crossed off the list of prospective political participants.

Abstract

This study aims to find out and analyze the legal basis for considering the regulation of fine sanctions of Kupang Mayor Regulation Number 7 of 2013 concerning the health of mothers, infants and children under five and to find out and assess the effectiveness of the enforcement of Kupang Mayor Regulation Number 7 of 2013 concerning the Health of Mother, Infants and Children under five through the regulation of fine sanctions. This type of research is empirical normative research using interviews and data analysis methods that are carried out qualitatively. In this study, the author uses a type of empirical normative research or legal research that examines written law from the aspects of theory, history, philosophy, comparison, structure and composition, scope and material, general explanation of article by article, formality and binding force of a law but not binding aspects of its application or implementation. The results of the study show the legal basis for considering the regulation of fine sanctions in Kupang Mayor Regulation Number 7 of 2013 concerning the health of mothers, infants and children under five, because there are still incidents of childbirth outside health facilities in the working area of the Bakunase Health Center which can be at risk of maternal and infant mortality rates. This happens because there are still pregnant women who give birth at home because of impromptu childbirth so that childbirth does not occur in health facilities but outside health facilities or at home and childbirth is still helped by birth attendants. The risk of maternal and infant mortality can still occur. The effectiveness of the enforcement of Kupang Mayor Regulation Number 7 of 2013 concerning the Health of Mothers, Infants and Children Under Five through the regulation of fine sanctions in the working area of the Bakunase Health Center has been effective for health workers. For the public, there are still many who do not know about the Regulation of the Mayor of Kupang Number 7 of 2013 concerning the Health of Mothers, Babies and Children under five so that there are still incidents of childbirth outside health facilities and childbirth assisted by shamans. Knowledge about childbirth, attitudes and family support in this study also has an important role in determining mothers to have a safe delivery. It is suggested that new regional regulations need to be socialized to the community so that existing regulations can run effectively. An obedient society is also a basic thing so that regulations can run effectively.

Abstract

The implementation of the efficiency policy of affirmation policy in Indonesia provides room for 30% of the number of women legislative candidates who are advancing at the regional and central levels. The policy is realized in the regulation of political contestation in Law No. 7 of 2017 concerning elections. The KPU and political parties must be able to ensure that the fulfillment of this regulation takes place for the sake of fair elections. However, the existence of this Law does not necessarily make women's representation pass the Legislative general election. This research is an empirical research, namely field research in this case using primary data and secondary data. Primary data was obtained from the results of interviews with respondents. Secondary data is obtained from books, laws and regulations, and the internet. The results of this study show that 1) Women's representation in the legislative general election in East Manggarai district in 2019 has met the 30% quota, but only 1 person from 157 female legislative candidates has qualified to become a legislative member. 2) Factors that inhibit women's representation in the legislature are legal structure, legal substance and legal culture.

Abstract

The implementation of the Subdistrict Head's duties in fostering and overseeing village development activities in Sulamu Subdistrict, Kupang Regency, can be categorized as uneven and not well-realized. The village development programs in Sulamu Subdistrict can be said to have not been well-implemented, as evidenced by several issues, including insufficient progress in physical infrastructure such as roads and bridges being in poor condition. The aim of this research is to identify the factors hindering the execution of the Subdistrict Head's duties. This study is based on empirical juridical research, employing an approach that utilizes primary data collected directly from the research site. Based on the findings, the inhibiting factors of the Subdistrict Head's duties include human resources factors, infrastructure factors, and coordination factors.

Abstract

The granting of clemency is a constitutional authority vested in the president, allowing the reduction of sentences or the release of convicts. This study aims to examine the authority of the Indonesian president in granting clemency to foreign convicts, with a case study on President Susilo Bambang Yudhoyono's clemency granted to Schapelle Corby, an Australian citizen involved in a marijuana smuggling case. This study uses a normative juridical approach with an analysis of the laws and regulations governing clemency, as well as a review of the political, legal, and diplomatic aspects influencing the president's decision. The research also utilizes secondary data such as legal documents, journal articles, and relevant media reports. The findings indicate that the president's authority to grant clemency, including to foreign nationals, is regulated by the constitution and clemency laws. The clemency granted to Schapelle Corby was influenced by various considerations, including diplomatic pressure from the Australian government, the convict's health condition, and humanitarian factors. This decision elicited various public reactions, both supportive and opposing, with arguments encompassing legal, ethical, and national interest aspects. The study concludes that although the president has full authority to grant clemency, the exercise of this power should take into account broader factors, including its impact on international relations and public perception of the judicial system. This case study provides important insights into the dynamics between law and politics in the practice of granting clemency in Indonesia.

Abstract

The purpose of this research is to analyze the effectiveness of the implementation of Lembata Regency Regional Regulation Number 9 of 2015 concerning the protection and management of community-based mangrove areas (study in Merdeka Village, Lebatukan District, Lembata Regency). This research is empirical legal research, namely directly observing the research location to find out the facts that occur in the field. The research data sources are primary data and secondary data which are then analyzed descriptively qualitatively. The results showed that the implementation of Lembata Regency Regional Regulation Number 9 of 2015 concerning Protection and Management of Community-Based Mangrove Areas has not run effectively and efficiently, due to the lack of serious attention from the government to the protection and management of mangrove areas. The inhibiting factor in the implementation of Regional Regulation Number 9 of 2015 concerning Protection and Management of Community-Based Mangrove Areas is the lack of socialization carried out by the government and the lack of government roles and responsibilities in protecting and managing mangrove areas.
