Abstract

Abstract

Prior to the 1961 Vienna Statute, only state actors were allowed to engage in diplomatic activities; however, non-state actors, including private citizens, are now included as well. This is, of course, based on several factors, starting from the flow of globalization to the role of the state, which is still unable to resolve certain issues, especially in the realm of peace advocacy. Of the many non-state actors involved in the practice of modern diplomacy, one of them is the individual actor, namely santri. Santri, in this case, has great potential and opportunities to become an actor in the world of diplomacy, especially in spreading peace advocacy. This condition can be seen through the historical record of santri, which has produced many peace-oriented movements. The dissemination of advocacy values also does not forget to highlight the characteristics of the Islam Nusantara identity, which is tolerant, friendly, and inclusive. In this regard, this research aims to explain the role of santri as diplomatic actor, especially in multi-track diplomacy to promote the Islamic values of Nusantara. The results of this research also prove that the role of santri in the realm of diplomacy is very broad and can be carried out through various multi-track diplomatic activities, ranging from inter-religious dialogue and santri exchange programs to the use of media platforms for da'wah media, which have become part of the form of novel diplomacy. In addition, to support this research, the author utilizes a qualitative research framework through the use of descriptive analysis methods and historical methods to obtain secondary data, based on internet-based research technique.

Abstract

The issue of Israel and Palestine has been going on for almost 70 years, and there is still no sign of lasting reconciliation. However, since 1948, several countries have taken part in the peace process between the two countries. Apart from state actors, non-state actors also contribute to Israeli-Palestinian reconciliation, one of which is the institution of the Catholic Church, the Holy See. With its unique status, the Holy See has a slightly different style of diplomacy. This difference can be seen in the presence of dual status, where the Holy See is both a state and a world religious institution. With the presence of this double-status, the Holy See has a wider diplomatic space than state actors, especially in conducting diplomacy related to the peacebuilding process. Therefore, this research aims to analyze the Holy See's diplomatic efforts in Israeli-Palestinian reconciliation. This research uses a qualitative approach by utilizing data sources from the internet and official documents. It finds that The Holy See plays a very important role in peace process in the Holy Land through religious institutions. It plays roles not only in bridging political friction between Israel and Palestine through normalizing relations, but also in undertaking humanitarian cases through social assistance.

Abstract

The problems stemming from ISIS does not only come during the pinnacle of its campaign of terror, rather it is also available following its downfall. One prominent example would be the many former ISIS members who now wish to return home. Indonesia, having some of its citizens joining ISIS back then, made the stern call to deny their return. To this day, debates and discussions over it still remain to this day. Against that backdrop, the article seeks to explain why the aforementioned decision was made by taking into account the security dimension of the matter. In carrying out this undertaking, the writers made use of both primary and secondary data procured from the internet under the qualitative research method. The forthcoming analysis is also supported by relevant concepts and theories like national security and rational choice theory. The paper begins with an overview of the issue at hand that entails ISIS's downfall along with the fate of Indonesia citizens who partook in ISIS's campaign of terror. Additional discussion is also provided as to how such a decision stands amidst Indonesia's commitment to the global human rights regime and why it still pales in importance to said security considerations.

Abstract

This research is motivated by the importance of Pancasila values, particularly the second principle just and civilized humanity in the development and application of civil law in Indonesia. The aim of this study is to analyze the extent to which the humanitarian values embodied in the second principle of Pancasila are integrated into the practice of the wakalah contract in murabahah transactions at Islamic banks. This study employs a normative juridical approach with qualitative analysis of legislation, DSN-MUI fatwas, and Islamic banking practices. The findings indicate that the wakalah contract reflects humanitarian values through the principles of trust, responsibility, and contractual justice, which align with the core principles of national civil law. This integration demonstrates that the national legal system is capable of accommodating Pancasila values within the framework of Islamic economic law.
