Abstract

This study aims to reveal the development of children as perpetrators of crimes in the West Java region, and also to analyze the legal protection for children who are involved in criminal acts, both from the perspective of Islamic law and positive law. In addition, this study identifies obstacles in educating children who are involved in criminal behavior. In this study, a combined approach method of normative and empirical research was used. The normative approach is carried out by investigating data and facts through literature studies and comparisons of legal literature, including derivative legal products, as well as analysis of the relevance of legal views to the object of research. On the other hand, the empirical approach involves public testing and direct data search (field research) from related parties, including Center for Integrated Service for the Empowerment of Women and Children “Pusat Pelayanan Terpadu Pemberdayaan Perempuan dan Anak” (P2TP2A) and Legal Aid Institutions. The results of the research show that in the case of children as perpetrators of criminal acts, the restorative justice approach is a relevant concept. Limitations of thinking and careful consideration in children are the main factors that support the choice of this approach. Thus, in providing criminal responsibility for children, it is important to consider their development and best interests for their future. Incorrect handling can have a damaging impact on future generations. This is because children are assets as well as successors to the nation and the ideals of the state. Meanwhile, the obstacles faced in educating children who commit criminal acts include, first, sometimes the perpetrator's parents completely surrender to the Social Service, so this is what then becomes an obstacle in providing assistance. The second is the budgetary aspect, in some cases such as harassment, regarding the post-mortem fee, parents sometimes hand it over in full, not to mention if there are additional costs, the Social Service will automatically bear it. The third obstacle is the cooperation that is established with Legal Aid Institutions “Lembaga Bantuan Hukum” (LBH) which demand payment, while social services are government agencies whose allocation has been determined.

Abstract

The Indonesian Ulema Council should maintain professionalism and independence when providing halal certification to ensure that the needs of Muslim consumers are met in accordance with religious teachings. Objectivity should be prioritized to avoid any subjective evaluations. The purpose of this research was to investigate the mechanism for issuing halal guarantee certification in the Processed Food Industry in West Java. Additionally, the study aimed to examine the application of the principles of independence and professionalism of the Indonesian Ulema Council in issuing Halal Guarantee Certification. The methodology employed in this research involved a qualitative approach through field research. The process for obtaining halal assurance certification starts when the Company provides written confirmation that it intends to implement SJH in accordance with the rules outlined by LPPOM MUI. Independence is not just determined by the organizational structure of an institution; expertise, field data, and appearance must also be considered. The Indonesian Ulema Council's application of the Professionalism principle in granting Halal Guarantee Certification to the food processing industry in West Java is evident in its product assessment methods. The Council has effectively coordinated with LPPOM to carry out the process appropriately and efficiently.Majelis Ulama Indonesia senantiasa dituntut untuk menjunjung profesionalisme dan independensi dalam pemberian penetapan halal agar kebutuhan konsumen muslim dapat tetap terjaga dari hal-hal yang diharamkan menurut ajaran agama. Penelitian dilakukan untuk mengetahui mekanisme penerbitan sertifikasi jaminan halal pada Industri Olahan Makanan di Jawa Barat; serta penerapan prinsip independensi dan profesionalisme Majelis Ulama Indonesia dalam menerbitkan Sertifikasi Jaminan Halal. Penelitian ini merupakan penelitian lapangan (field research) dengan pendekatan kualitatif. Mekanisme penerbitan sertifikasi jaminan halal diawali dengan Perusahaan menyatakan secara tertulis tujuan penerapan SJH di perusahaannya sesuai dengan aturan yang telah digariskan oleh LPPOM MUI. Aspek independensi tidak hanya dilihat dari kemandirian dalam penyelenggaraan suatu lembaga saja, jauh dari itu pertimbangan keahlian, data lapangan dan juga penampilan harus menjadi tolak ukur utama. Penerapan prinsip Profesionalisme Majelis Ulama Indonesia dalam menerbitkan Sertifikasi Jaminan Halal pada industri makanan olahan di Jawa Barat dapat dilihat pada metode pengkajian produk industri olahan makanan. Majelis Ulama Indonesia telah mampu melaksanakan koordinasi yang baik dan tepat dengan memberikan peran ini pada LPPOM.

Abstract

This study aims to examine the urgency of premarital education as a preventive effort in reducing divorce rates in West Java, DKI Jakarta, and Banten. The research method used is the literature review method, which involves an in-depth analysis of various relevant literature sources. The results showed that premarital education has a crucial role in preparing prospective couples to face the challenges of married life. Through a deep understanding of values, effective communication, and conflict resolution skills, couples can build a solid foundation for a sustainable marriage relationship. This study also identified various supporting and inhibiting factors for the implementation of premarital education in the region. These findings provide valuable insights for the development of premarital education programs that are more effective and can be widely adopted in the community. The implications of this research can help the government, educational institutions, and related parties to design policies that support improving the quality of marriage relationships and reducing divorce rates in society.
