Abstract

This study aims to reveal the development of children as perpetrators of crimes in the West Java region, and also to analyze the legal protection for children who are involved in criminal acts, both from the perspective of Islamic law and positive law. In addition, this study identifies obstacles in educating children who are involved in criminal behavior. In this study, a combined approach method of normative and empirical research was used. The normative approach is carried out by investigating data and facts through literature studies and comparisons of legal literature, including derivative legal products, as well as analysis of the relevance of legal views to the object of research. On the other hand, the empirical approach involves public testing and direct data search (field research) from related parties, including Center for Integrated Service for the Empowerment of Women and Children “Pusat Pelayanan Terpadu Pemberdayaan Perempuan dan Anak” (P2TP2A) and Legal Aid Institutions. The results of the research show that in the case of children as perpetrators of criminal acts, the restorative justice approach is a relevant concept. Limitations of thinking and careful consideration in children are the main factors that support the choice of this approach. Thus, in providing criminal responsibility for children, it is important to consider their development and best interests for their future. Incorrect handling can have a damaging impact on future generations. This is because children are assets as well as successors to the nation and the ideals of the state. Meanwhile, the obstacles faced in educating children who commit criminal acts include, first, sometimes the perpetrator's parents completely surrender to the Social Service, so this is what then becomes an obstacle in providing assistance. The second is the budgetary aspect, in some cases such as harassment, regarding the post-mortem fee, parents sometimes hand it over in full, not to mention if there are additional costs, the Social Service will automatically bear it. The third obstacle is the cooperation that is established with Legal Aid Institutions “Lembaga Bantuan Hukum” (LBH) which demand payment, while social services are government agencies whose allocation has been determined.

Abstract

When discussing mawaqit in pesantren, it becomes clear that not all pesantren implement theory and practice in the same manner. One of these practices is when it's time for prayer. Astronomy is the idea of using arithmetic to calculate things within various Islamic rules. The purpose of this service is to use mentoring to help the community in Sumedang Regency better understand ijtihad and astronomy. The method used is qualitative, where the service provider is the main tool, sample, and data source. The results focus on meaning rather than generalization. The results of this investigation reveal that determining the direction of the Qibla mathematically is difficult in some places. Spherical astronomy and geography are the main issues with prayer direction. There are two ways to determine when the month in the Islamic calendar begins: the calculation method and the observation method. To know the time of Imsak, you also need to know the time of the Subuh prayer. Muslims often miscalculate the time of the Subuh prayer when trying to determine it. Some rules regarding the height of the sun were made by experts through ijtihad. The Ministry of Religious Affairs uses this ijtihad to determine when dawn begins, when true dawn light is visible on the eastern horizon before sunrise, and when the sun is below the eastern horizon until it is visible.

Abstract

Islamic law moves with the times, Islam does not deny ijtihad as a solution offered in the formation of Islamic law. This study aims to analyze that Islamic Law is inseparable from the conceptual values of civilization, where different laws do not have to be prohibited, so that the relationship of Islamic law with diverse cultures is not a rigid law but can change according to changes and human welfare at a certain time. Descriptive analysis became the method used in this study. This study concludes that, first: Culture is an important concept in understanding society, where culture has three layers, namely: basic values that can be maintained, behaviors consisting of rituals and certain symbols. Second, Islamic law is a dynamic and flexible law, where attention to this change is then used as one of the important reasons in extracting law by scholars in conducting ijtihad, because many laws change according to social and cultural changes while still paying attention to the demands of benefit, not about mahdhah worship, the law is not qath'i, and that change must be based on the proposition of shari'i.
