Abstract

Technological sophistication is observed to be increasing the necessity for digitalization of Islamic banks in Indonesia to avoid being abandoned by their customers, as conventional banks rapidly advance their digital offerings and set higher expectations for financial services. However, these banks are required to comply with Sharia principles for their products and services. This study was conducted to analyze the justification of digitalization of Islamic banking system and compliance of the digital services implemented to Sharia principles. It employed doctrinal legal study methods. Data were retrieved from literature references and were analysed qualitatively using a conceptual and statutory approach. The results showed several reasons to justify digitalization of Islamic banking system and these include the current demand for digital products and services, the prevalence of the millennial generation, and the legal backing provided for the advancement in Indonesia. These principles mandate that Islamic banks must avoid practices involving maisir (gambling), gharar (obscurity), haram (prohibited activities), riba (usury), and zalim (injustice). This study is novel in its comprehensive analysis of how digitalization can be harmonized with Sharia principles in the Indonesian context, providing a unique legal and practical framework for Islamic banks aiming to modernize their services while maintaining religious compliance.

Abstract

This research aims to find out how Micro, Small and Medium Enterprises respond to packaged food towards the Halal Certification Obligation in Indonesia. This research uses a type of normative juridical research. The results of this research show that first, the response of packaged food MSMEs regarding the understanding of halal certification has been partially understood, although the details have not been conveyed. Second, the response of MSMEs to the JPH Law shows that they strongly agree with the existence of halal certification which is required by regulations to obtain a halal guarantee for a food product served. Third, the response of MSMEs to the benefits of halal certification labeling provides good value because in the future MSMEs want halal certification to be able to bring material benefits as well as benevolent (spiritual) values. Therefore, it is hoped that this latest law can be a solution to the various problems that arise and obstacles faced by MSMEs.

Abstract

Usaha Mikro Kecil dan Menengah (UMKM) are trade and/or service sectors that must be protected by the state. Indonesia as a country of law is obliged to fulfill all the rights of its citizens, including legal rights. The legal protection provided by the state to the intellectual property of UMKM includes trademarks, patents, copyrights, industrial designs, trade secrets, the basis of integrated circuit layouts, and geographical indications. To get legal protection for the trademark used by UMKM, UMKM must immediately register the trademark with the Ministry of Law and Human Rights. By registering a brand, UMKM can get benefit, but there are still many UMKM who do not register it for various reasons. The research uses normative juridical research methods, literature data collection, qualitative analyst techniques, and descriptive writing techniques.

Abstract

Dispute settlement through the dispute board is an alternative to settling new disputes that are not regulated in LawNumber 30 of 1999 concerning Arbitration and APS. The specific objectives to be achieved in this study to look fordata and examine the forms of construction service disputes that are resolved using the dispute board. This research isnormative juridical research. Primary data were obtained through an interview with the Head of Sub Directorate of JBH(Freeway). Secondary data were obtained from documents in the research location above. Data analysis methods usedin this study are statutory approaches and conceptual approaches. The research was analytical descriptive. The forms ofDispute Construction Services using the Dispute board can be seen in various criteria.

Abstract

The millennial and generation Z tend to experience the negative impact of the decoy effect, so a consumer protection law is required. The purpose of this study is to demonstrate the negative impact of the decoy effect and the importance of consumer protection through digital literacy. A quantitative descriptive approach was used with millennial and generation Z research subjects who were given a choice of products using bait items. According to the study's findings, respondents are susceptible to the decoy effect, so consumers have the right to know before making a decision. The findings of this study contribute to the public's understanding and provision of suggestions or criticism, as well as to the government's formulation of consumer protection policies, particularly for the millennial and generation Z generations. The implication is that existing consumer protection laws must be flexible, rational, and based on digital literacy. Legal certainty as a form of consumer legal protection to achieve equality in an engagement as a concept for those who make transaction.

Abstract

As the world enters the era of Industrial Revolution 4.0, Indonesia's creative industry has tremendous potential for economic growth. During this transformation, the digital economy of financial services, such as e-KYC (electronic Know Your Customer), has emerged as a crucial element for authenticating banking and financial technology customers. To safeguard consumer data, e-KYC procedures typically employ electronic methods, such as facial recognition and biometric scanning. In addition to qualitative analysis and secondary data, this research employs legal methodology to evaluate the protection of consumers’ personal dataThis study also aims to better understand the impact of the Personal Data Protection Law on the e-KYC process and its function in driving the growth of the digital economy. This study contributes to a deeper understanding of Indonesia’s evolving digital landscape and economic outlook by emphasizing the legal framework governing consumer data protection. The results of this study indicate that customer personal data in the implementation of e-KYC are already protected by the newly enacted Personal Data Protection Law No. 27 of 2022.

Abstract

Aviation is a strategic business owned by a country, whether managed by a state company or a private company. In Indonesia, airplanes are the most important transportation. It is said to be able to connect every city, province, and inter-island very quickly compared to land and sea transportation. The importance of air transportation must be accompanied by regulations that guarantee the safety and security of airlines and passengers who are users of air transportation services. Security and safety are regulated through national and international rules which must be followed by every airline and passenger for the creation of a good aviation business. The main problem in the aviation business is aircraft accidents which result in aircraft destruction and death to all passengers and crew members. This cannot be avoided because the cause of the accident could be from aircraft engine damage, weather, or error from the pilot. This aircraft accident, not only damage airlines that have planes worth billions of rupiah but can damage passengers and heirs. Due to the risks involved in the aviation business. Although it is said that air transportation is very safe because the technology used by aircraft is the latest, accidents can not be avoided if it occurs.Keyword: Responsibility; Airlines Company; Passenger; Montreal Convention 1999 Pertanggungjawaban dari Maskapai Penerbangan kepada Penumpang berdasarkan Ratifikasi Montreal Convention 1999 oleh Pemerintah Indonesia AbstrakPenerbangan merupakan salah satu bentuk usaha strategis dalam sebuah negara, baik dikelola oleh perusahaan negara sendiri, maupun oleh perusahaan swasta. Di Indonesia sendiri, perusahaan penerbangan merupakan transportasi yang paling penting karena jenis transportasi ini dapat menghubungan setiap kota, provinsi, dan antar pulau dengan cepat dibandingkan dengan transportasi darat maupun laut. Pentingnya transportasi udara ini, tentu harus dibarengi dengan aturan yang menjamin keamanan dan kesalamatan maskapai penerbangan serta penumpang yang menjadi pengguna jasa transportasi udara. Keamanan dan keselamatan tersebut, diatur melalui aturan nasional dan aturan internasional yang wajib diikuti oleh setiap perusahaan penerbangan dan penumpang demi terciptanya bisnis penerbangan yang baik. Permasalahan utama dalam bisnis penerbangan adalah kecelakaan pesawat terbang yang seringkali mengakibatkan hancurnya pesawat terbang dan kematian kepada seluruh penumpang dan juga kru pesawat. Hal ini tidak bisa dihindarkan dikarenakan penyebab kecelakaan tersebut bisa dari kerusakan mesin pesawat, cuaca, maupun kesalahan dari pilot. Kecelakaan pesawat terbang ini tidak hanya merugikan maskapai penerbangan yang memiliki pesawat yang harganya miliaran rupiah, namun dapat merugikan penumpang dan ahli warisnya, dikarenakan resiko yang ada  dalam bisnis penerbangan. Meskipun, dikatakan transportasi yang sangat aman karena teknologi yang digunakan pesawat adalah teknologi yang mutakhir, namun kecelakaan tersebut tidak dapat dihindarkan jikalau terjadi. Artikel ini membahas masalah pertanggungjawaban Pertanggungjawaban dari Maskapai Penerbangan kepada Penumpang setelah adanya Ratifikasi Montreal 1999 oleh pemerintah Republik Indonesia.Kata Kunci: Tanggungjawab; Maskapai Penerbangan; Penumpang; Konvensi Montreal 1999 Ответственность авиакомпании перед пассажирами после ратификации Индонезией Монреальской конвенции 1999 г. АннотацияАвиация - это стратегический бизнес, принадлежащий стране, независимо от того, управляется ли он государственными или частными компаниями. В Индонезии самолеты - самое важное средство передвижения. Говорят, что он может очень быстро соединить каждый город, провинцию и острова по сравнению с наземным и морским транспортом. Важность авиаперевозок должна сопровождаться правилами, гарантирующими охрану и безопасность авиакомпаний и пассажиров, пользующихся услугами авиаперевозок. Охрана и безопасность регулируются национальными и международными правилами, которые должны соблюдаться каждой авиакомпанией и пассажирами, чтобы создать хороший авиационный бизнес. Основная проблема в авиационном бизнесе - авиационные происшествия, в результате которых самолет выходит из строя и гибнут все пассажиры и экипаж. Это неизбежно, потому что причиной аварии могло быть повреждение двигателя самолета, погодные условия или ошибка пилота. Эта авиакатастрофа не только ставит в невыгодное положение авиакомпании, владеющие самолетами на миллиарды рупий, но также может причинить вред пассажирам и их наследникам. Abstract

As a member of the international community, Indonesia has a responsibility to participate in the execution of global policy. Recently, a global policy was implemented to address the sharing of financial information between countries. Financial information transparency between countries requires the sharing of bank customers' financial information via both manual and automatic transmission. This policy aims to prevent economic crimes, including tax evasion. This study combines normative legal research and in-depth interviews aimed at determining how to determine how legal justice can be achieved in the context of the exchange of financial data for taxes purposes in Indonesia. The principle of bank secrecy functions as a safeguard to protect bank clients' right to privacy, which is a human right that must be preserved. On the one hand, citizens have a civic duty to voluntarily fulfill their tax obligations. On the other hand, as bank clients, citizens also have the right to be protected from violations of privacy. Assuming the perspective of legal justice, this paper seeks to describe the balance between these two needs. Finally, the study's results support the argument for abolishing the principle of bank secrecy, especially in the realm of taxation.

Abstract

During the Covid pandemic, SD Muhammadiyah Sagan held an online school. There are several obstacles in learning activities faced by SD Muhammadiyah Sagan during this Covid pandemic. PJJ is known as distance learning (online) has various advantages in addition to disadvantages, including being prone to fraud or irregularities in the form of learning for 6th grade elementary school children, being required to study independently during the PJJ period, this does not cover the possibility of the occurrence of such fraud. including cheating during exams or during closed quizzes/questions, for example, students very easily commit dishonest acts, because online learning, especially using online applications, is not supervised by the teacher directly and is still vulnerable to fraudulent actions. The solution offered for this problem is the need to socialize fraud and its resolution and practice simulations through games, material presentations and pre-post test questions that will be given to 5th grade students of SD Muhammadiyah Sagan. The method offered in this community service program is to organize socialization and games. From the results of monitoring and evaluation of pre and post tests conducted before and after service activities, there is an increase in the assessment that students understand very well about fraud and settlement as many as 7 out of 18 became 25 and less score decreased by one from 3 to 2 after the post test. So that the overall understanding of the fifth grade elementary school students at Muhammadiyah Sagan Elementary School of fraud and its resolution has increased.
