Abstract

Pernikahan sumbang yang terjadi di antara anak keturunan dari saudara laki-laki dan anak keturunan dari saudara perempuan berkonsekuensi pada denda adat bagi pasangan yang melangsungkannya disebut dengan budendo. Penelitian ini bertujuan pada eksplorasi: 1) makna adat tradisi budendo pada nikah sumbang; 2) faktor-faktor penyebab terjadinya nikah sumbang; dan 3) implikasi tradisi budendo terhadap pelaksanaan nikah sumbang bagi masyarakat Desa Semurup, Kecamatan Air Hangat, Kabupaten Kerinci. Penelitian ini menggunakan metode kualitatif. Penelitian ini dilakukan dengan cara wawancara dengan narasumber terkait dengan judul pembahasan serta literatur yang berhubungan dengan nikah sumbang. Hasil dari penelitian ini adalah; 1) tradisi budendo bermakna sebuah rangkaian acara adat yang bertujuan untuk memintakan denda adat kepada pasangan yang melakukan pernikahan sumbang, dan juga untuk menghilangkan kemudhoratan dari pernikahan yang telah mereka laksanakan; 2) faktor pendorong terjadinya pernikahan sumbang disebabkan beberapa hal antara lain, perjodohan, mempererat tali persaudaraan, suka sama suka, kemurnian keturunan dan mempertahankan harta; 3) implikasi yang ditimbulkan dari tradisi budendo ini berupa kepatuhan terhadap hukum dan untuk menertibkan masyarakat dengan cara membayar denda adat.The occurrence of intermarriage between descendants of male relatives and descendants of female relatives resulting in customary fines for the couple who conduct it is known as "budendo." This study aims to explore: 1) the cultural significance of the budendo tradition in intermarriages; 2) the factors contributing to intermarriages; and 3) the implications of the budendo tradition on the execution of intermarriages in the Semurup village, Air Hangat Subdistrict, Kerinci Regency. This research utilizes a qualitative methodology. It involves conducting interviews with relevant informants on the subject matter and reviewing literature related to intermarriages. The findings of this study are as follows: 1) the budendo tradition signifies a series of customary proceedings aimed at seeking customary fines from couples engaged in intermarriage and also at eliminating any harm resulting from the marriage they have undertaken; 2) the driving factors behind intermarriages include arranged marriages, strengthening familial ties, mutual affection, preserving lineage purity, and safeguarding wealth; 3) the implications arising from the budendo tradition encompass compliance with customary law and maintaining societal order by paying customary fines.

Abstract

This study aims to analyze the constitutionality of the parliamentary threshold for the 2029 general election following Constitutional Court Decision No. 116/PUU-XXI/2023. The research applies a normative juridical method with statutory and conceptual approaches, focusing on legal norms, constitutional principles, and relevant court decisions. Data are collected through literature review, including legislation, constitutional court rulings, and academic writings, and are analyzed qualitatively. The findings reveal that the parliamentary threshold remains constitutionally valid as a mechanism to simplify the party system and support the effectiveness of the presidential system. However, its implementation must adhere to democratic principles, particularly popular sovereignty, equality of political rights, and fair representation. The Constitutional Court’s decision reflects a model of conditional constitutionality, requiring that any threshold policy be rational, proportional, and not excessively limit political participation. This study concludes that future regulation of the parliamentary threshold must carefully balance electoral system efficiency with the protection of citizens’ constitutional rights. The academic contribution of this research lies in offering a comprehensive interpretation of constitutional law in the field of electoral governance, especially in linking democratic theory with constitutional adjudication. Additionally, this study provides insights into the broader implications of judicial review decisions on legislative policy-making and electoral reform in Indonesia.

Abstract

This study aims to examine the transformation of ancestral property (harta pusaka) disputes in the Minangkabau matrilineal system from customary law (adat) into state law, with a particular focus on how Islamic law interprets, mediates, and influences such conflicts. The research seeks to analyze the tension between adat inheritance norms, which prioritize maternal lineage, and statutory legal frameworks that increasingly regulate property disputes within Indonesia’s national legal system. The methodology employed is qualitative juridical research with a normative-empirical approach. Primary legal materials include Islamic legal texts (Qur’an, Hadith, and classical fiqh), Indonesian inheritance law regulations, and customary law principles of Minangkabau society. Secondary data are derived from scholarly literature, case studies, and relevant court decisions. Data analysis is conducted through comparative legal analysis and interpretative content analysis to identify intersections and divergences among adat, state law, and Islamic legal principles. The findings indicate that ancestral property disputes in Minangkabau arise from dual legal legitimacy between adat inheritance (collective matrilineal ownership) and Islamic inheritance law (individual bilateral distribution). State law functions as an intermediary but often fails to fully reconcile these normative systems, leading to prolonged disputes. Islamic law, particularly through the principles of maslahah (public interest) and ‘urf (custom), provides a flexible framework for harmonizing customary practices with normative Islamic injunctions. The study concludes that a hybrid legal approach is essential to resolve inheritance conflicts in Minangkabau, integrating adat legitimacy with Islamic legal ethics and national legal certainty. The academic contribution of this research lies in offering a comparative synthesis model that bridges customary matrilineal inheritance and Islamic legal theory, contributing to broader discourse on legal pluralism and family law reform in Indonesia.

Abstract

Fatwa DSN-MUI No. 115/DSN-MUI/IX/2017 tentang Kontrak Mudharabah merupakan fatwa penting untuk kegiatan pendanaan ini. Penelitian ini berfokus pada salah satu Baitul Maal wat Tamwil (BMT): BMT Agam Madani Nagari Kapau. Tujuan dari penelitian ini, yang menggunakan metodologi kualitatif dan deskriptif, adalah untuk memberikan deskripsi dan penilaian praktik kontrak mudharabah di BMT Agam Madani Nagari Kapau. Data yang diperoleh dari penelitian ini terdiri dari data primer dan sekunder yang diperoleh melalui berbagai metode, termasuk wawancara mendalam dengan pejabat dan karyawan BMT. Data sekunder diperoleh dari literatur, makalah, dan sumber lain yang mendukung penelitian ini. Fatwa DSN-MUI No. 115/DSN-MUI/IX/2017 tidak sesuai dengan rasio pembiayaan mudharabah Koperasi Konsumen Syariah BMT Agam Madani Nagari Kapau yang didasarkan pada proporsi modal pembiayaan. Selain itu, BMT terus meminta anggota untuk mengembalikan uang secara penuh saat melakukan penutupan kerugian. Namun, persyaratan fatwa yang membahas prinsip-prinsip pembagian keuntungan dan penutupan kerugian dalam kontrak mudharabah tidak mengikuti praktik ini.

Abstract

This study aims to examine the legal qualification of repeated sexual abuse against male children in pesantren (Islamic boarding schools) by evaluating the application of concursus realis and voortgezette handeling under Indonesian criminal law from the perspective of Islamic law. This study employed an empirical legal method with a qualitative approach through field research conducted from January to March 2026. Data were collected through semi-structured interviews with judges, public prosecutors, investigators, advocates, criminal law scholars, and Islamic law scholars, supported by observations and document analysis. Documentary sources included the Indonesian Criminal Code, Law Number 12 of 2022 on Sexual Violence Crimes, Decision Number 130/Pid.Sus/2024/PN Bukittinggi, Decision Number 989/Pid.Sus/2021/PN Bandung, and related legal documents. The findings indicate that judicial practice predominantly applies concursus realis, emphasizing the plurality of criminal acts while overlooking the continuity of criminal intent and the cumulative harm suffered by child victims. Interview participants considered voortgezette handeling a more appropriate legal framework because it recognizes repeated offenses arising from a single criminal intent, thereby supporting proportional punishment, consistent judicial reasoning, and stronger child protection. This study concludes that reconstructing the application of voortgezette handeling is necessary to strengthen legal certainty, sentencing consistency, and victim protection. Academically, this study contributes an empirical and doctrinal framework integrating Indonesian criminal law with Islamic legal principles to improve judicial responses to continuing child sexual abuse cases.
