Abstract

Ulayat rights are the rights of customary law communities which in essence are the authority possessed by certain customary law communities. The customary land law of the Tolaki Mekongga tribe is land that is controlled or owned by a family, either because the family has directly cultivated it, or because the land has been inherited from generation to generation. The main objective of this research is to find out the concept of customary land ownership of the Tolaki Mekongga tribe and its relation to inheritance and customary rights. The type of research used in this study is normative legal research (doctrinal legal research), namely research on law as a norm and reality (behavior) or as something to aspire to and as a living reality or law. The Tolaki Mekongga indigenous people still exist today and occupy certain areas, but until now there are no regional regulations regarding customary rights over these areas, so efforts are needed to obtain legal certainty and justice for customary law communities in managing their customary rights.

Abstract

This research aims to determine the relationship between criminal law policies as an effort to prevent corruption and to analyze how the Ministry of Religion program should be in preparing programs for preventing corruption in relation to the Integrated Criminal Policy. So that the writing will discuss the relationship between criminal law policies as an effort to prevent corruption and an integrated criminal law policy or Integrated Criminal Policy can increase the role of the Ministry of Religion in preventing corruption. The approach used in this research is the statute approach to examine regulations related to the Ministry of Religion and the prevention of corruption, the conceptual approach, which is to move from the views and doctrines in criminal law related to criminal law policies. integrated (integrated criminal policy). Prevention of corruption which is explicitly stated in UNCAC, the KPK Law and the United Nations Convention on crime prevention is an effort outside of criminal law (non-penal) which is an inseparable part of criminal law policy. The social policy carried out by the Ministry of Religion in preventing corruption is an effort outside of criminal law (non-penal) and can balance the eradication of corruption through criminal law (penal) carried out by law enforcers. This kind of social policy is a manifestation of an integrated criminal law policy that can be carried out by the government.

Abstract

Pertambangan di Indonesia dari berbagai riset telah menunjukan dampak positif diantaranya adalah sebagai lokomotif perekonomian yang secara langsung berkontribusi langsung pada peningkatan PDB, selain itu pada aspek ekonomi sektor riil berkontribusi terhadap peningkatan serapan tenaga kerja, peningkatan pendapatan, mempunyai multi efek player dengan meningkatkan usaha mikro masyarakat, namun disatu sisi riset yang lain menunjukan  dampak negatif terutama dampak lingkungan, konflik agraria, alih fungsi lahan dari pertanian menjadi kawasan eksploitasi pertambangan menyebabkan defisit  persediaan pangan. Khusus untuk permasalahan mitra pada pengabdian masyarakat ini karena terdapat protes warga soal kerusakan lingkungan, konflik horizontal antara masyarakat dan perusahaan, aktifitas ilegal memuat nikel tanpa memiliki syarat admininstrasi yang lengkap, untuk  itu kami melakukan pengabdian kepada masyarakat kiranya dengan informasi yang kami transformasikan masalah dapat diselesaikan oleh stake holders yang didaerah Lokasi mitra. Metode yang kami lakukan ialah metode pra pelaksanaan dan pelaksanaan; pra pelaksanaan dengan  memperhatikan base line visi misi fakultas hingga menentukan topik yang sesuai, kemudian melaksanakan observasi berita dan konfirmasi lapangan untuk memastikan urgensi kebutuhan mitra yang sesuai dengan topik, mengiventaris bahan materi lalu merumuskannnya hingga sistematis dan tersaji dengan baik, kemudian pelaksanaan  dilakukan dengan metode  service learning. Hasil dan pembahasan kami mengemukakan sumber hukum dan ketentuan inti pertambangan di Indonesia, tata kelola dan manejem lingkungan, penanganan konflik agraria, norma yang dapat diterapkan apabila perusahan badan hukum atau perorangan memuat nikel keatas kapal yang belum lengkap syarat admininstrasinya, layanan pengaduan masyarakat yang dapat diakomodir pemeritah daerah sesuai dengan norma undang-undang saat ini.

Abstract

Disrupsi menggambarkan transformasi mendasar dalam digitalisasi berbagai aspek, termasuk diantaranya dibidang system peradilan, khususnya peradilan pidana. Maka dari itu, penelitan ini bertujuan melihat pengaruh pelaksanaan sistem peradilan pidana dan kaitannya dengan pemenuhan keadilan di Indonesia. Pendekatan yang dugunakan dalam penelitian ini adalah pendekatan undang-undang (statute approach) guna menelaah semua peraturan perundang-undangan, regulasi dan kebijakan yang berkaitan dengan teknologi digital pada sistem peradilan pidana. Peraturan Mahkamah Agung Tentang Administrasi dan Persidangan Perkara Pidana Di Pengadilan Secara Elektronik mempengaruhi proses administrasi peradilan, baik pada mekanisme persidang secara elektronik. Persidangan secara elektronik adalah serangkaian proses memeriksa, mengadili, dan memutus perkara terdakwa oleh pengadilan yang dilaksanakan dengan dukungan teknologi informasi dan komunikasi, audio visual dan sarana elektronik lainnya. Selain itu juga digunakan pada proses permohonan izin secara elektronik dan pelimpahan berkas melalui Sistem Informasi Pengadilan. Administrasi perkara pidana terpadu secara elektronik telah berdampak pada percepatan proses peradilan, penyederhanaan system birokrasi yang rumit antara penegak hukum dan membuat biaya peradilan semakin efisian bagi pencari keadilan.

Abstract

Advances in digital technology have brought massive changes to various aspects of life, including managing natural resources in renewable energy. Digital technology has become one of the strongest drivers for the energy transition goal. In light of this potential, various government policies are currently underway to facilitate the expansion of these resources. Initially, this expansion initiative appears to be a sound and perfect plan, as the transition towards renewable energy will significantly affect environmental conservation efforts, bolstered by digitalization in the energy management sector. Holistically, there appears to be some confusion from both social and economic perspectives, and particularly from a legal perspective at the regulatory level. Objective of this research is to investigate the relationship between advancements in digital technology on renewable energy expantion. Additionally, it aims to investigate the legal barriers that hinder efforts to expand renewable energy in the country, and to explore the significance of paradoxes in this process. This research was conducted principles of law, synchronisation regulations, historical legal analysis, and comparative jurisprudential study. The findings of the research indicate that digital technology, or digitization, in the management of renewable energy provides a significant positive contribution in terms of improving safety, production processes, increasing access, and sustainable management. On the other side, renewable energy regulations have not been able to accommodate the country's expansion efforts and potential. There are still many legal, social, economic, and environmental conflicts in this process.

Abstract

This research critically examines Indonesia's land bank regulations, introduced under the Job Creation Law to boost investment, but which risk promoting land grabbing, particularly affecting farming and indigenous communities. The study's novelty lies in its focus on assessing the compatibility of land bank policies with Indonesia's agrarian legal framework through the lens of legal utilitarianism. By employing normative research methods, including theoretical and regulatory analysis, the study identifies significant legal flaws in both the legislative process and the content of the regulations. These issues undermine the principles of agrarian justice, particularly in ensuring equitable land ownership rights. This research offers urgent recommendations to policymakers, advocating for the protection of vulnerable communities from the adverse effects of land bank policies.
