Abstract

This non-doctrinal study analyzes the practice of ignoring the values of logical-factual justice and righteousness to eliminate corruption among the high-positioned state officials. The aim is to describe the establishment of criminal trials which are ambitious, which yet has counterproductive effects. There is not only injustice, but there is also the ignorance of the premise of material righteousness as the rational working character of criminal law. The primary data is in the form of interview to the perpetrators and the informants. The secondary data is in the form of case documents, which are analyzed qualitatively with the hermeneutic interpretation technique. Results of the study show that the ambitious elimination of corruption has the potentials to break the logics of criminal trials and restricts the ratio and conscience of law enforcers.

Abstract

One of the functions of the DPRD is a regional people's representative institution, namely the legislative function. This function is even often referred to as the core of a representative institution, namely as a law-making body within the scope of the region, in other words having the authority to form regional regulations (PERDA). In implementing the policy of making local regulations. The role of DPRD is very large in local government because it is a regional legislative body that functions as one of the institutions that channel people's aspirations in the city of Cirebon. The problem in this study is related to the legislative function of the Regional People's Representative Council (DPRD) in forming Regional Regulations (Perda). This research method is library research (field research) which is descriptive-analytical. The results of this study are the function of the Regional People's Representative Council (DPRD) in line with the People's Representative Council (DPR) in the central government which has an important function in the implementation and administration of government in the regions. Furthermore, the revitalization of the role of the Regional People's Representative Council (DPRD) can be observed in Law Number 32 of 2004 concerning Regional Government, where the Regional People's Representative Council (DPRD) has the authority to make regional regulations (PERDA), budget preparation and supervision, as mandated in Article 41: “Regency/City DPRD has the functions: 1) legislation, 2) budget, and 3) supervision.” Paragraph (2) explains that the three functions as referred to in paragraph (1) are carried out within the framework of people's representation in districts/cities.

Abstract

One of the conditions for the validity of the agreement mentioned above is legal competence. Legal competence in question is that if a person commits a legal act, he can be subject to certain legal actions against him. One of the conditions for a person to be legally proficient is that he is an adult. Adults here are seen from the age limit determined by each legal discipline. Failure to fulfill the requirements for legal competence will result in the cancellation of the agreement being requested by the judge. So that the agreement can be canceled at the will of one of the parties but if the parties wish to continue, the sale and purchase agreement can still be carried out provided that the terms of the agreement are valid according to Article 1320. This type of research is normative juridical, namely the type of research conducted by studying norms - existing norms or laws and regulations related to the issues discussed. The legal force of agreements made by minors in e-commerce transactions can still be considered valid. However, this can later cause legal problems for minors who carry out e-commerce transactions, because the agreement is weak. After all, it does not fully meet the legal requirements of the agreement law based on Article 1320 of the Civil Code, namely the subjective requirements. While the legal consequences of an online sale and purchase agreement (e-commerce) carried out by minors, which is the agreement can be canceled. This is different from being null and void because null and void can only be done if the objective conditions are not met while the minors are included in the subjective conditions. However, as long as the parties are not concerned about the non-fulfillment of one of the legal conditions of the agreement according to Article 1320 of the Civil Code and the parties continue to carry out the agreement they have made, the contract is made to remain valid so that it is binding and becomes law. Abstract

Ideally, the allocation of village funds is sought so that its management can be efficient and effective in the directions for which the funds are given. So the allocation of the Village Fund is a manifestation of the fulfillment of the village's right to carry out its autonomy, to realize the growth and development of Bungko Lor Village, Kapetakan District, Cirebon Regency, and to obtain financing in the form of a budget to carry out authority and at the same time support the implementation of good development. The purpose of this study is to determine the management of village funds and the obstacles in managing village funds in Bungko Lor Village, Kapetakan District, Cirebon Regency. The results of this study are as follows: 1. The management of Bungko Lor village funds, Kapetakan District, Cirebon Regency is to see the priority of using village funds to finance the implementation of programs and activities in the field of Village Development and Village Community Empowerment. The technical mechanism for managing village funds refers to the Cirebon Regent Regulation Number 25 of 2015 concerning Village Financial Management, starting from the stages of planning, implementation, reporting and accountability. 2. The management of village funds in Bungko Lor Village, Kapetakan District, Cirebon Regency has obstacles in implementation, namely a) Human resources that are not yet reliable and incompetent in managing village finances; b) low self-reliance of village communities; c) Direct community supervision by the community in managing village funds in Bungko Lor village has not yet occurred; d) community participation is very weak, sometimes it is carried out only unilaterally; e) Community understanding there are still many people who do not understand and do not know the use of village funds. Abstract

The secret sale of land raises changes in certificate ownership dilemma. The absence of seller during creation of the Deed of Sale and Purchase (AJB) poses a severe obstacle, coupled with the buyer's lack of knowledge. Another constraint is buyer's inability to create a deed due to seller's unknown address. This research highlights buyer's efforts to overcome obstacles in transferring land certificates from off-the-record land transactions. This is a normative legal approach through literature analysis. The results show that buyers can overcome obstacles by filing a lawsuit for unlawful actions in the district court where the land is located. This lawsuit is related to unlawful actions by the defendant, such as rejection or hindrance to changing the land certificate's name. Through the trial, the court can issue an order instructing the National Land Agency (Badan Pertanahan Nasional or BPN) to transfer the land certificate in the buyer's name. Even without the Deed of Sale and Purchase (AJB), the court order serves as a legal basis for BPN to execute this process. Upon completion, the buyer obtains legal certainty regarding land ownership, and despite lacking AJB, the renamed land certificate becomes valid proof of the buyer's land ownership.

Abstract

AbstrakUndang-Undang Dasar 1945 sebagai kesepakatan para pendiri republik, tekanan pembangunan kemerdekaan seutuhnya di Indonesia merdeka, lepas dari segala bentuk imperialisme, kolonialisme, penjajahan yang tidak sesuai dengan perikemanusiaan artinya dalam masa penjajahan manusia tidak dimanusiakan dalam mengembangkan kehidupan dan penghidupan serta perikeadilan maknanya adalah manusia yang mengusahakan kehidupan dan penghidupannya dicurahkan untuk kepentingan kesejahteraan negara penjajah. Rumusan masalah dalam penelitian ini bagaimana konsepsi membangun hukum ekonomi kerakyatan dan bagaimana pengembangan hukum ekonomi kerakyatan yang berkeadilan dan bermartabat. Metode penelitian yang digunakan adalah penelitian hukum normatif. Hasil penelitian ini adalah sebagaimana yang dikehendaki oleh Pasal 33 UUD 1945. Oleh karena itu, Pembahasan secara komprehensif mengenai pembangunan kerakyatan hukum ekonomi yang berkeadilan dan bermartabat telah dilakukan dalam kerangka reformasi sistem perekonomian hukum yang menyentuh seluruh sub sistem yang dibutuhkan dalam penyelenggaraan perekonomian yang berbasis rakyat. Dalam kerangka melaksanakan amanat Pasal 33 UUD 1945 tersebut, konstitusi juga telah menetapkan salah satu alat yang dapat digunakan oleh negara untuk dapat mengimplementasikan semangat kekeluargaan yang terkandung dalam Pasal tersebut, yaitu Pasal 1 ayat (2) dan ayat (3) UUD 1945.Kata Kunci: Hukum Ekonomi, Keadilan, Martabat.  AbstrakUUD 1945 sebagai kesepakatan para founding fathers republik menekankan pembangunan kemerdekaan penuh dalam Indonesia merdeka, bebas dari segala bentuk imperialisme/kolonialisme/kolonialisme yang tidak sesuai dengan kemanusiaan, artinya pada masa penjajahan manusia tidak dimanusiakan. dalam mengembangkan kehidupan dan penghidupan serta keadilan, yang dimaksud adalah manusia yang berusaha agar kehidupan dan penghidupannya diabdikan untuk kepentingan kesejahteraan negara jajahan. Rumusan masalah dalam penelitian ini adalah bagaimana konsepsi membangun hukum ekonomi kerakyatan dan bagaimana membangun hukum ekonomi kerakyatan yang adil dan bermartabat. Metode penelitian yang digunakan adalah penelitian hukum normatif. Hasil kajian ini sebagaimana disyaratkan oleh Pasal 33 UUD 1945. Karena itu, Pembahasan komprehensif tentang pembangunan hukum ekonomi kerakyatan yang adil dan bermartabat telah dilakukan dalam kerangka reformasi sistem hukum ekonomi yang menyentuh seluruh sub sistem yang diperlukan dalam penyelenggaraan ekonomi kerakyatan. . Dalam rangka menjalankan amanat Pasal 33 UUD 1945, konstitusi juga telah menetapkan salah satu alat yang dapat digunakan oleh negara untuk dapat melaksanakan semangat kekeluargaan yang terkandung dalam pasal tersebut, yaitu Pasal 1 ayat ( 2) dan ayat (3) UUD 1945.Kata Kunci :  Hukum Ekonomi, Keadilan, Martabat.
