Abstract

Lamanya waktu penyelesaian perkara di persidangan, dan pemidanaan yang tidak menjamin pulihnya ketertiban menjadi latar belakang tulisan ini. Metode penulisan yang digunakan adalah deskriptif analitis. Masalah yang dikaji adalah apa saja kelebihan dan kekurangan Mediasi sebagai alternatif penyelesaian sengketa yang sekarang wajib dilakukan oleh para pihak, dan bagaimana mengatasi kekurangan mediasi dalam penyelesaian sengketa di peradilan. Kesimpulan dari tulisan ini adalah Kelebihan Mediasi antara lain : Jadwal fleksibel, Biaya ringan, Proses cepat, Tidak perlu pengacara, Hasil akhir berupa akta perdamaian yang menguntungkan kedua belah pihak, Hubungan baik tetap terjaga, Tidak dimungkinkan adanya upaya hukum; sedangkan Kekurangan dalam pelaksanaan mediasi, antara lain : Para pihak tidak menganggap mediasi penting, Para pihak tidak mau membayar biaya mediator non-hakim dan biaya mediasi, Para pihak memiliki hambatan komunikasi, Para pihak tidak beritikad baik untuk melakukan mediasi. Untuk mengatasi kekurangan Mediasi, maka hendaknya : Dilakukan sosialisasi bagi pihak yang tidak memahami mediasi, kesepakatan di awal sebelum mediasi dilakukan dapat menjadi solusi bagi para pihak yang keberatan dengan biaya mediasi dan biaya mediator, mediator bertugas mewujudkan keseimbangan posisi para pihak, serta sosialisasi kepada pihak yang tidak beritikad baik tentang konsekuensi hukum atas tindakannya

Abstract

This Community Service activity focuses on strengthening mediation training for Damang and Mantir Adat in the Sebangau District, aiming to enhance their knowledge, skills, and professionalism in resolving community conflicts. The program was implemented by a team of lecturers from the Faculty of Law, Palangka Raya University, involving the Damang Customary Head, Mantir as Assistant Damang, the Sebangau District Head, and local village officials. This training was considered essential in accordance with Supreme Court Regulation (Perma) No. 1 of 2016 concerning Mediation Procedures in Court, particularly Article 36, which allows mediation outside the court to be facilitated by community or customary leaders. The main issue identified was the limited understanding among Damang and Mantir Adat regarding the proper format and procedures for drafting a legally binding Peace Agreement, as well as the follow-up mechanisms to ensure its enforcement under both Customary and National Law. Therefore, the training aimed to provide participants with the necessary legal knowledge and practical skills to prepare and implement peace agreements in compliance with existing regulations. During the sessions, participants actively engaged in discussions and question-and-answer activities. They were also introduced to a standardized peace agreement format and practiced drafting agreements using the provided template. This initiative successfully improved the capacity of Damang and Mantir Adat as mediators, enabling them to conduct conflict resolution processes that are both culturally rooted and legally valid.

Abstract

The advancement of digital technology has driven the emergence of cryptocurrency as a new investment instrument that promises high accessibility and potential returns. However, this development also creates legal risks for consumers, particularly when transactions are carried out through illegal platforms that operate outside government supervision. This study aims to examine the legal reasoning used by judges in determining unlawful acts in illegal cryptocurrency transactions and to assess the effectiveness of civil legal protection for consumers. The research employs a normative juridical method using statutory, case, and conceptual approaches. The results indicate that the application of consumer protection principles and the construction of civil liability provide legal certainty for victims, despite the limited regulatory framework governing crypto assets in Indonesia. The novelty of this study lies in the application of the Digital Consumer Vulnerability Theory (DCVT) as an analytical framework to identify digital consumer vulnerabilities arising from information asymmetry, technological opacity, regulatory vacuum, and psychological manipulation in crypto investment schemes. This research highlights the need for a more adaptive and comprehensive legal approach to ensure consumer protection in the digital era.

Abstract

Digital transformation in the Society 5.0 era encourages the use of information technology in various aspects of life, including in notarial practice and the holding of General Meetings of Shareholders (GMS). Law Number 40 of 2007 concerning Limited Liability Companies through Article 77 has provided the legal basis for holding GMS through electronic media. However, detailed technical regulations are currently only available for Public Companies, thus creating a normative vacuum in the implementation of electronic GMS in Private Limited Companies, particularly regarding the preparation of deed releases by notaries. This study aims to analyze the implementation of the preparation of deed releases for Public Limited Companies GMS through electronic media by notaries and identify the normative, technical, and sociological obstacles that influence its implementation. This study uses an empirical juridical approach with participatory observation methods and semi-structured interviews with notaries in Palangka Raya City. The results show that the absence of technical regulations causes notaries to apply the principle of excessive caution, which has an impact on the stagnation of innovation in notarial practices. The main obstacles include the lack of implementing regulations, limited technological infrastructure, and low trust and understanding of business actors regarding the electronic GMS mechanism. This research emphasizes the need for regulatory updates that explicitly regulate the implementation of electronic GMS for closed PTs and standards for the preparation of deed releases by notaries to ensure legal certainty and the adaptation of notarial practices to developments in information technology.
