Abstract

This study aims to examine the feasibility and normative design of integrating the Dayak philosophy of Handep Hapakat—solidarity, deliberative consensus, and social harmony—into industrial relations dispute resolution, especially at the pre-litigation stage. The research method used is normative legal research employing statutory (legislative), conceptual, and historical approaches. Primary legal materials consist of labor and industrial relations dispute settlement regulations, while secondary materials include scholarly works on Dayak customary law, local wisdom, restorative justice, and legal pluralism. The analysis is descriptive-analytical to construct an integration framework compatible with positive law. The novelty in this research is the formulation of a conceptual integration model that translates Handep Hapakat values into three operational pathways within the existing PPHI structure: (i) customary deliberation-based bipartite settlement (“bipartite plus”), (ii) culturally informed mediation, and (iii) customary arbitration oriented toward restorative outcomes while maintaining legal safeguards. Based on the research, it is concluded that embedding Handep Hapakat can strengthen pre-litigation dispute settlement by promoting faster, lower-cost, participatory resolutions that prioritize relationship repair and reinforce Indonesia’s legal pluralism. Implementation nonetheless requires local regulatory support, systematic stakeholder socialization, and capacity-building for customary leaders to ensure alignment with labor-law standards and rights protection.

Abstract

This study was prompted by a criminal case in Palangka Raya City involving a cooperating witness (Justice Collaborator) who faced intimidation during the law enforcement process. This situation highlights asymmetrical power relations that potentially hinder investigations and reduce the effectiveness of legal protection. This study aims to analyze the legal considerations of the Witness and Victim Protection Agency (LPSK) in designating MH as a Justice Collaborator and to examine the role of the LPSK in providing protection during the trial process at the Palangka Raya District Court. Employing an empirical legal method with a qualitative approach, data were collected through interviews with an expert staff member of the LPSK’s Protection Bureau and the Chair of the Genta Keadilan Legal Aid Institute, who served as MH’s legal counsel. The findings indicate that MH’s designation as a Justice Collaborator was based on the fact that he was not the principal perpetrator, the importance of his testimony in uncovering the offense, his good faith, and the need for protection due to intimidation and psychological trauma. The protection provided by the LPSK includes physical, psychological, legal, and family protection, enabling the witness to testify freely and safely throughout the judicial process. Theoretically, this study reinforces research on the importance of protecting Justice Collaborators in power imbalances, demonstrating that legal protection effectiveness depends on institutional implementation rather than statutory norms alone. Practically, these findings serve as an evaluative basis for the LPSK and law enforcement to strengthen protection mechanisms in cases involving unequal power dynamics.

Abstract

Penyelesaian perselisihan hubungan industrial di Indonesia selama ini masih didominasi oleh jalur litigasi di Pengadilan Hubungan Industrial, yang sering kali memakan waktu lama, biaya tinggi, dan meninggalkan ketegangan sosial antara pekerja dan pengusaha. Dalam konteks ini, nilai-nilai kearifan lokal seperti falsafah Handep Hapakat dari masyarakat Dayak Kalimantan Tengah menjadi relevan untuk memperkuat mekanisme penyelesaian non- litigasi. Falsafah ini menekankan semangat gotong royong, musyawarah, dan mufakat sebagai dasar penyelesaian sengketa yang mengedepankan keadilan sosial dan pemulihan hubungan. Penelitian ini menggunakan metode hukum normatif dengan pendekatan perundang-undangan dan konseptual untuk mengkaji peluang integrasi nilai-nilai Handep Hapakat dalam sistem penyelesaian hubungan industrial di Indonesia. Hasil analisis menunjukkan bahwa nilai-nilai hukum adat Dayak memiliki kesesuaian dengan asas musyawarah dan prinsip keadilan restoratif dalam hukum ketenagakerjaan nasional. Integrasi nilai Handep Hapakat tidak hanya memperkaya hukum positif, tetapi juga memperkuat upaya pembangunan hukum ketenagakerjaan yang inklusif, partisipatif, dan berkelanjutan sesuai dengan agenda kerja layak dan pertumbuhan ekonomi nasional.

Abstract

Termination of Employment on urgent grounds has generated debate in judicial practice because the conceptual boundaries of what constitutes “urgent” are not yet fully clear. Previous studies have analyzed the regulation of urgent termination normatively; however, they have not examined how judges apply the criteria of urgency in judicial practice and its relationship with trust as the foundation of the employment relationship. This study analyzes Decision Number 5/Pdt.Sus-PHI/2025/PN Plk to identify the judges’ considerations in assessing urgent termination, using a normative juridical method with a case approach. The results show that the Panel of Judges applied a cumulative four-pillar approach: violation of the legality principle under the Fiduciary Security Law, ultra vires actions, a concrete loss of Rp120,000,000.00, and a breach of fiduciary duty due to a conflict of interest. Urgent termination does not require a warning letter because such conduct fundamentally damages trust, in accordance with the provisions of Law Number 6 of 2023 and Government Regulation Number 35 of 2021. The decision clarifies the limits of vicarious liability, which does not apply to actions that harm the company, with the consequence of limited compensation without severance pay and long-service awards.

Abstract

This study analyzes the conflict between the application of Article 29 of the AB and Article 78 of the Environmental Protection and Management Law (UU PPLH) in determining the prematurity of a lawsuit for environmental torts in Supreme Court Decision No. 4441 K/Pdt/2024. This normative legal research employs statutory, conceptual and case-based approaches. The results of the study indicate that Article 78 of the Environmental Protection and Management Law is more appropriately applied because it allows for the parallel enforcement of administrative, civil and criminal law, thereby ensuring that ongoing criminal proceedings do not render a civil environmental lawsuit premature. Thus, a decision that bases the prematurity of a lawsuit on an unresolved criminal process potentially hinders the effectiveness of environmental protection and restoration.
