Abstract

Salah satu bagian dari transformasi digital dalam layanan kepemilikan tanah adalah penerapan sertifikat tanah elektronik, yang bertujuan untuk mengurangi kesalahan manusia, perselisihan, dan tumpang tindih data. Meskipun sistem ini mudah diakses, aman, dan efisien dalam pengelolaan tanah, implementasi sistem ini menghadapi masalah dengan akses teknologi. Ini menjadi masalah terutama bagi orang-orang yang tinggal di daerah dengan akses internet yang terbatas. Selain itu, masalah teknis dan ketidaksesuaian data saat ini memperlambat proses verifikasi. Perspektif Notaris/PPAT menunjukkan bahwa meskipun sistem ini dapat mempercepat transaksi, pembenahan dan pelatihan diperlukan karena masalah teknis dan kurangnya pemahaman pihak terkait. Metode yang dipakai dalam penelitian ini dengan cara mengkaji ketentuan umum yang berlaku dan melihat apa yang terjadi di lapangan. Dalam Penerapan Sertifikat Tanah Elektronik di Kabupaten Langkat, peningkatan sistem teknologi dan pembaruan undang-undang sebaiknya lebih komprehensif hal ini merupakan langkah penting untuk menjamin bahwa penerapan sertifikat tanah elektronik di Indonesia akan berjalan dengan baik dan aman.

Abstract

Penelitian ini bertujuan untuk menganalisis secara yuridis Implikasi Hukum Dari Pembatalan Hibah Dalam Konteks Perselisihan Keluarga, Jenis penelitian yang digunakan adalah penelitian hukum normatif, yaitu penelitian hukum yang dilakukan dengan cara meneliti bahan pustaka atau data sekunder, Adapun teknik analisis data yang digunakan adalah deskriptif kualitatif, Hasil dari peneltian in I adalah peraturan dari pembatalan hibah dalam mendorong implementasi kebijakan hukum yang efektif terkait pembatalan hibah yakni  hanya dapat dimintakan oleh penghibah dengan jalan menuntut pembatalan hibah yang diajukan ke Pengadilan Negeri, supaya hibah yang telah diberikan itu dibatalkan dan dikembalikan padanya. Dalam penyelesaian suatu kasus pembatalan hibah di Pengadilan Negeri, hukum pewarisan yang digunakan pada dasarnya adalah hukum waris adat dimana Pengadilan Negeri itu bertempat. Mengenai proses penyelesaian pembatalan akta hibah melalui pengadilan ini tidaklah mudah dilakukan karena dalam proses persidangan itu memerlukan adanya suatu pembuktian. Penentuan beban pembuktian merupakan masalah yang tidak mudah karena tidak ada satu pasal pun yang mengatur secara tegas tentang pembagian beban pembuktian. rekomendasi penyelesaian hukum yang dapat diajukan untuk memperkuat kepastian hukum dan keadilan dalam hal pembatalan pada konteks perselisihan keluarga adalahb dengan Prosedur Mediasi di Pengadilan. Majelis hakim menganalisis dan mengaplikasikan ketentuan hukum yang relevan dengan kasus yang sedang diajukan, termasuk peraturan undang-undang, konstitusi, dan prinsip-prinsip hukum yang berlaku. Pertimbangan hakim juga mencakup aspek keadilan, di mana hakim memastikan bahwa keputusan yang diambil akan menghormati hak-hak dan kepentingan semua pihak yang terlibat dalam persidangan

Abstract

Protection of cultural heritage in Indonesia is regulated in Law no. 11 of 2010 concerning Cultural Heritage. Violations in the form of destroying cultural heritage can be subject to serious criminal sanctions. One example of a protected cultural heritage is Fort Putri Hijau, with various protection efforts by the government such as restoration, monitoring and outreach, in order to preserve this historic site as the nation's cultural heritage.

Abstract

This study examines the implementation of the horizontal separation principle in the regulation of buildings as objects of fiduciary collateral based on Government Regulation No. 16 of 2021, with a study focus on the City of Medan. This principle allows buildings to be used as fiduciary collateral without having to pledge the land on which the building stands, thus opening up new access to credit facilities. However, the implementation of this principle still faces various obstacles, including low understanding from business actors and financing institutions, as well as limitations in the administrative system and socialization of regulations. The results of the study show that although the Building Ownership Certificate (SBKBG) has been regulated as the legal basis for fiduciary imposition on buildings, its implementation is still not optimal due to limited supporting infrastructure and technical regulations for implementation. This study emphasizes the importance of strengthening socialization, harmonization of regulations, and the readiness of related institutions to ensure legal certainty and the effectiveness of the implementation of the horizontal separation principle in supporting the development of the fiduciary guarantee system. These findings are expected to contribute to the formulation of more inclusive and responsive policies in supporting the property financing sector in Indonesia.

Abstract

The development of technology and information has brought significant changes in various aspects of life, including in the practice of the legal profession in Indonesia. This research is motivated by the development of the transformation of the notary world towards the digital era through the concept of cyber notary. Cyber notary is the notary's authority to certify transactions electronically. Although Article 15 paragraph (3) of Law Number 2 of 2014 concerning the Notary Position (UUJN) provides the opportunity for such authority, there is a discrepancy with Article 16 paragraph (1) letter m of the UUJN which requires the physical presence of the parties and the direct reading of the deed. This research is a type of normative legal research with a statute approach that is descriptive and analytical. The results of the study show that regulations regarding cyber notaries in Indonesia are still experiencing juridical insynchronization and ambiguity of meaning because the term is only included in the explanation section without a clear operational definition. From a civil law perspective, deeds made by the cyber notary method currently do not have the same legal certainty as conventional authentic deeds because the formality requirement of "physical presence" in Article 1868 of the Civil Code has not been met. The implication is that the deed risks degrading the power of proof into a deed under hand and losing its executory nature. Therefore, synchronization between the UUJN, THE ITE Law, and the Civil Code is needed as well as clear technical regulations to ensure legal certainty for practitioners and the public.

Abstract

This study aims to analyze the position and function of prenuptial agreements in the Indonesian marital law system and their role in providing legal protection to parties harmed by infidelity. Infidelity is one of the main causes of marital breakdown that not only generates moral and psychological consequences but also produces legal and economic implications, particularly regarding the division of joint property and the fulfillment of post-divorce rights. This research employs a normative legal method using statutory and conceptual approaches supported by primary, secondary, and tertiary legal materials obtained through literature review. The findings show that prenuptial agreements function as a special legal instrument (lex specialis) that allows spouses to regulate deviations from the joint property regime as long as such arrangements do not contradict statutory law, religious values, and public morality. The legal development following Constitutional Court Decision Number 69/PUU-XIII/2015 expands the timeframe for making marriage agreements so that they may be concluded before or during the marriage. This development strengthens the function of prenuptial agreements as a preventive and repressive mechanism of legal protection against potential marital disputes, including those caused by infidelity. However, the scope of such agreements is legally limited because private parties cannot stipulate criminal sanctions for adultery, as criminal liability may only be determined by statutory law. Nevertheless, prenuptial agreements may regulate various civil consequences, including provisions concerning the division of property, maintenance obligations, compensation, and the protection of the rights of wives and children in the event of divorce due to infidelity. Therefore, a marriage agreement serves not only as an instrument for managing marital assets but also as a legal protection mechanism that anticipates the civil consequences of infidelity within the Indonesian marital law framework.

Abstract

The purpose of this writing is to discuss social inequalities that often occur in the health sphere, where the presence of the BPJS Kesehatan program is expected to provide good health services regardless of economic and social status, but in its implementation there are still often non-fulfillment of the rights of people who use BPJS Kesehatan. , even though Health BPJS is issued by the government to obtain health insurance as stipulated and contained in the Law of the Republic of Indonesia No. 40 of 2004 concerning the National Social Security System, it is organized nationally based on social insurance principles and equity principles with the aim of ensuring that participants or patients receive health care benefits and protection in meeting health needs. In principle, legal protection for BPJS Health participants is in accordance with the laws and regulations related to the BPJS Health program, but the implementation of legal protection is still ineffective. Analyzing the service problems in BPJS Health is still not providing good service to participants as BPJS Health patients. Keywords: legal protection, BPJS patients, services

Abstract

Issues regarding compensation for flight cancellations during a pandemic must be resolved is a concern of the government as a policy maker and airlines as a responsible party according to laws and international conventions concerning air transportation, one of which is the Aviation Law and the Consumer Protection Law. Covid-19 are causing problems regarding the form of cash compensation which was replaced with a voucher and the return procedure which was considered to be many times longer and even threatened that no compensation would be given. Therefore, the author analyzes to find out the factors that cause these problems and how airline responsibility and consumer protection should be in terms of laws and regulations. In addition, there was a significant spike at one time in requests for cancellation and the following Government Regulation No. 25 of 2020, which abolished the cash refund policy, turned out to be one of the factors in the increasing number of consumer complaints about compensation issues and has clearly contrary to the laws and regulations.

Abstract

The development of the Indonesian Capital City (IKN) requires substantial investment support, so the government is providing various tax incentives to attract investors. This policy aims to create a conducive investment climate, but on the other hand, it raises issues related to justice and legal certainty. The research questions are: (1) how are tax incentives regulated and implemented for investors in the IKN, and (2) how are these incentives viewed from the perspective of justice and legal certainty. This research uses a normative legal method with a statutory and conceptual approach. The legal materials used include regulations related to investment and taxation, as well as scientific literature in the form of journals and previous research results. Data collection techniques were conducted through literature studies and analyzed qualitatively and descriptively. The results show that the regulation of tax incentives in the IKN has been comprehensively regulated through various regulations, such as Law No. 25 of 2007 and Government Regulation No. 12 of 2023. However, implementation still faces obstacles in the form of policy inconsistencies, bureaucracy, and rapid regulatory changes. From a justice perspective, this policy has the potential to create inequality if not balanced by an equitable distribution of benefits. In terms of legal certainty, despite the existence of normative guarantees, practices in the field are not entirely consistent. In conclusion, tax facilities in the new capital city (IKN) do not fully meet the principles of justice and legal certainty. Therefore, regulatory strengthening, policy consistency, and effective oversight are needed to ensure this policy supports sustainable development.
