Abstract

Masa remaja, yang berlangsung dari sekitar usia 11 atau 12 tahun hingga sekitar 20 tahun, merupakan periode peralihan di antara masa kanak-kanak dan dewasa. Selama fase perkembangannya, remaja dihadapkan pada tugas-tugas tertentu yang harus mereka selesaikan. Mereka sering merasakan tekanan untuk memenuhi standar dan harapan sosial dari kelompok mereka. Jika mereka tidak berhasil menyelesaikan tugas-tugas tersebut, mereka cenderung melihat hidup sebagai penderitaan dan tidak menyenangkan, yang bisa mendorong mereka melakukan perilaku-perilaku seperti melukai diri sendiri, melarikan diri dari keluarga dan tanggung jawab, terlibat dalam pergaulan bebas, atau bahkan terjerumus ke dalam penggunaan alkohol dan obat-obatan terlarang, termasuk narkotika dan psikotropika. adapaun metode yang digunakan dalam kegiatan pengabdian masyarakat ini yaitu penyuluahan atau sosialisasi. hasil yang diharapkan dari kegiatan yaitu meningkatnya pengetahuan dan kesadaran remaja terkait bahaya penyalahgunaan narkoba.

Abstract

This research aims to analyze and find out the reality of the enforcement of illegal fishing law in Indonesia as well as the enforcement of illegal fisheries law in indonesia after the introduction of the Ciptaker Act. The type of research used is normative research, i.e. research with legislative approaches and supporting literature as research source material. The results of the study indicate that (1) the enforcement of the law of illegal fishing in Indonesia as well as enforcing the law on illegal fisheries in Indonesia after the creation of the Ciptaker Act, is basically aimed at protecting fishing resources,ining the sustainability of the marine environment, and ensuring that seafood can be sustainably utilized by future generations. (2) The enforcement of illegal fishing laws in Indonesia after the introduction of the Ciptaker Act, there are some changes in regulations that affect the enforcing of illegal fisheries law in Indonesia.

Abstract

The purposes of this research are 1) to know and analyze the law enforcement for hate speech against religions and denominations in Indonesia, 2) to know and analyze the factors which influence the law enforcement for hate speech against religions and denominations in Indonesia. The research used an empirical method that reviewed the processing and functioning of law in society, specifically analyzing the law enforcement for hate speech against religions and denominations in Makassar, Polrestabes, and Pengadilan Negeri Makassar. The result of this research shows that the law enforcement for hate speech against religions and denominations in Indonesia is still ineffective, with numerous instances of hate speech occurring without any affirmative action from law enforcement agencies. Additionally, the police have been unsuccessful in enforcing the law against hate speech, and there is a lack of regulations governing hate speech against religions and denominations. The society's black-and-white mindset, which separates religious affairs from state affairs, also contributes to this issue. The recommendations are, 1) the apparatus must have an active role to get through the spread of hate speech against religions and denominations, in particular under Circular No SE/ 06 / X /2015 about handling hate speech as a procedure, 2) construct particular rules about speech and preaching involving religion and denominations, 3) create particular rules for hate speech against religions and denominations to determine any hate speech that will be determined.

Abstract

Kejahatan penodaan agama dipandang dari sudut kebebasan berekspresi dan kebebasan berpendapat. Demokratisasi yang telah melewati batas privat dalam diri setiap individu telah menjadikan penistaan agama sebagai sebuah dilema antara kebebasan berpendapat dan tindak pidana. Penelitian ini dilakukan dengan tujuan: (1) Menganalisis dan menjelaskan penerapan peraturan hukum dan undang-undang terkait penodaan agama melalui media sosial. (2) Menganalisis dan menjelaskan faktor-faktor yang mempengaruhi terjadinya penodaan agama melalui media sosial. Penelitian ini menggunakan metode penelitian hukum empiris, bertujuan untuk mengungkap fakta-fakta lapangan yang terjadi di masyarakat. Lokasi penelitian mencakup media sosial dan Polrestabes Kota Makassar. Data yang dikumpulkan terdiri dari data primer berupa hasil observasi langsung di lapangan, serta data sekunder berupa dokumen dan jurnal-jurnal ilmiah. Data tersebut dianalisis menggunakan metode kualitatif dan disajikan dalam bentuk deskripsi. Hasil penelitian menunjukkan bahwa penerapan pasal 4 Penetapan Presiden Republik Indonesia Nomor 1/PNPS 1965 tentang Pencegahan Penyalahgunaan dan/atau Penodaan Agama sebagai aturan umum, serta Pasal 28 Ayat 2 Undang-Undang Nomor 11 Tahun 2008 tentang Informasi dan Transaksi Elektronik sebagai aturan khusus, telah dilaksanakan oleh penegak hukum. Tujuannya adalah untuk menciptakan sarana publik yang mempromosikan toleransi antar umat beragama berdasarkan Pancasila sebagai konstitusi negara secara serius dan bertahap.Disarankan agar pemerintah melakukan pengawasan ketat terhadap penggunaan teknologi informasi. Langkah ini bertujuan untuk mencegah dan menanggulangi tindakan penistaan agama melalui media online secara efisien dan efektif. Selain itu, penting untuk meningkatkan pemahaman dan kesadaran masyarakat tentang pentingnya berpikir dan berekspresi dengan baik dan benar. Pengawasan yang ketat dan edukasi yang tepat, diharapkan dapat mengurangi penodaan agama di media sosial dan menjaga kerukunan antar umat beragama di Indonesia.

Abstract

This study aims to analyze the juridical aspects of granting remissions to prisoners convicted of corruption crimes, focusing on the legal requirements and their alignment with Indonesian law. The primary questions addressed include the conditions under which remissions are granted, particularly within a moratorium framework, and how these legal regulations synchronize with other relevant laws in Indonesia’s legal system. The research employs a normative legal methodology, reviewing relevant legal materials, theories, principles, and regulations related to the issue. The main findings reveal that the legal requirements for remissions are stipulated in several government regulations, with notable differences between criteria for ordinary and extraordinary crimes, specifically for corruption offenses where stricter conditions are applied, complicating prisoner eligibility. Additionally, legal inconsistencies exist because the moratorium on remission for corruption prisoners conflicts with constitutional provisions and human rights laws. The study emphasizes the urgent need to revise existing regulations to prevent unconstitutional policies, advocating that the government, especially the Ministry of Law and Human Rights, should adhere to principles of correctional principles and human rights in the formulation of policies regarding prisoner development. The results contribute to ongoing debates on legal reforms and the protection of human rights within Indonesia’s correctional system, highlighting the importance of harmonized legal frameworks that respect constitutional and human rights standards.

Abstract

This community service program aims to develop the multidisciplinary competencies of young people through strengthening English literacy, digital ethics, and economic literacy. The program was conducted at PERMAI Pulau Pinang, Malaysia, involving 30 participants from the Indonesian diaspora community, including students and youth members. The implementation used participatory and educational approaches through interactive training, group discussions, and hands-on practice. The results indicate a significant improvement in participants’ understanding and skills, with an average post-training score increase of 80%. Participants demonstrated more effective English communication, ethical behavior in digital activities, and better financial management awareness. The multidisciplinary approach proved effective in shaping an adaptive young generation with strong ethical values and economic empowerment. This program serves as a model for empowering Indonesian diaspora communities to face the challenges of the digital transformation era.

Abstract

This article examined the minimum obligations of the Convention on the Rights of the Child (CRC) can be operationalized in the Indonesian context, which was characterized by legal pluralism and accelerating digital risks. Using normative legal research methods through legislative, conceptual, and limited comparative approaches, this study maps CRC standards and General Comments (particularly GC 5, GC 12, and GC 25) onto national norms, institutional mandates, and implementation-enforcement mechanisms. The findings showed the main problem was not merely a lack of norms, but rather an implementation enforcement gap in the compliance infrastructure: coherence between regimes (child protection, data protection, and platform governance), capacity and coordination across actors, and the absence of auditable procedural indicators to test best interests, protection, and participation. This article proposes a "compliance ecosystem" framework that combines (i) implementation guidelines based on Best Interests Assessment and reason-giving as a bridge for legal pluralism, (ii) protective regulations in the digital space that place the obligation of risk assessment and mitigation on electronic system/platform operators, and (iii) child participation designs that can demonstrate influence through procedural standards and outcome-based monitoring and evaluation.

Abstract

Freedom of association is a fundamental civil and political right that constitutes an essential component of a democratic state governed by the rule of law. This article examines the legal status of freedom of association within the framework of the International Covenant on Civil and Political Rights (ICCPR) 1966 and evaluates the extent to which Indonesian law complies with international human rights standards. The study employs normative legal research using statutory and conceptual approaches, supported by an analysis of relevant international human rights instruments and Indonesian constitutional and legislative provisions. The findings indicate that Article 22 of the ICCPR recognizes freedom of association as a fundamental right whose restriction is permissible only when it satisfies the cumulative requirements of legality, legitimate aim, necessity, and proportionality in a democratic society. Although Indonesia has constitutionally protected this right through Article 28E (3) of the 1945 Constitution and ratified the ICCPR through Law No. 12 of 2005, several regulatory and administrative practices continue to create inconsistencies with international standards. The originality of this study lies in developing an integrated normative framework that positions freedom of association not only as an individual human right but also as a constitutional principle supporting democratic governance under the rule of law. By systematically connecting Article 22 of the ICCPR with Indonesia's constitutional structure, this research offers a new analytical perspective on the harmonization of international human rights obligations and domestic constitutional law, while providing normative guidance for future legal reform aimed at strengthening democratic constitutionalism in Indonesia.

Abstract

The criminal offenses of currency counterfeiting and the circulation of counterfeit money constitute serious crimes that threaten the stability of the monetary system, cause financial losses to society, and undermine public confidence in currency as a lawful means of payment. Therefore, effective law enforcement through the proper application of criminal law is essential to combat such offenses. This study aims to analyze the application of criminal law to the offenses of currency counterfeiting and the circulation of counterfeit money, as well as to examine the legal reasoning adopted by the judges in Decision Number 135/Pid.B/2016/PN.Tsm. This research employs a normative legal research method using both the statute approach and case approach. The legal materials consist of primary, secondary, and tertiary legal sources, which were analyzed qualitatively. The findings indicate that the panel of judges applied Article 245 of the Indonesian Criminal Code (Kitab Undang-Undang Hukum Pidana), concluding that the defendant had intentionally circulated counterfeit currency while knowingly recognizing it as counterfeit. However, the judges' legal reasoning did not comprehensively address the possible application of the doctrine of a continuing offense voortgezette handeling under Article 64 of the Indonesian Criminal Code. Furthermore, offenses relating to currency have been more specifically regulated under Law Number 7 of 2011 on Currency, which provides a more comprehensive legal framework for safeguarding the national monetary system and protecting the integrity of the Indonesian Rupiah. This study concludes that the judges' legal reasoning primarily focused on establishing the constituent elements of the offense without comprehensively examining the legal characterization of the series of acts committed by the defendants based on the facts established during the trial. Furthermore, in cases involving currency counterfeiting and the circulation of counterfeit money, judges should also take into account the broader objectives of sentencing, including social defence, crime deterrence, and the protection of the stability of the national monetary system. A more comprehensive judicial analysis of these aspects is essential to ensure legal certainty, consistency in the application of criminal law, and effective protection of the public interest.

Abstract

Program pengabdian masyarakat ini bertujuan untuk meningkatkan kesadaran hukum mahasiswa mengenai Undang-Undang Tindak Pidana Kekerasan Seksual (UU TPKS). Topik ini dipilih mengingat meningkatnya angka kekerasan seksual di perguruan tinggi yang belum banyak mendapat perhatian dalam konteks pendidikan tinggi. Metode yang digunakan meliputi sosialisasi, pelatihan intensif, dan penerapan teknologi untuk memperluas jangkauan edukasi, melalui seminar, pelatihan praktis, serta pendampingan pasca-pelatihan. Hasil dari program ini menunjukkan adanya peningkatan signifikan dalam pemahaman peserta mengenai kekerasan seksual, yang tercermin dari perbandingan antara hasil pratest dan post-test. Sebagian besar peserta menunjukkan peningkatan pengetahuan yang signifikan, khususnya mengenai definisi, dampak, serta cara melaporkan tindak pidana kekerasan seksual. Program ini juga mengedepankan pentingnya peran mahasiswa dalam pencegahan dan penanganan kekerasan seksual di kampus. Kesimpulan dari pengabdian ini adalah bahwa edukasi tentang UU TPKS sangat efektif dalam meningkatkan kesadaran hukum mahasiswa, yang berpotensi menciptakan lingkungan kampus yang lebih aman dan inklusif.
