Abstract

The process of buying a house through a Home Ownership Credit all the time is always met with obstacles in installment payments, so that the buyer is in default because he does not pay the installments according to the agreement signed between the buyer and the bank. The formulation of this research problem is what are the legal consequences of the transfer of the purchase and sale of the object of home ownership credit guarantee in a credit pass transaction without the knowledge of the bank and how is the legal protection for consumers in the purchase and sale of home loan guarantee objects in a credit pass transaction without the knowledge of the bank. The theories used in this study are according to Moch, Ismaeni, Legal Protection Theory, Civil Contract Theory according to Sudikno Mertokusumo. The method used in this study is normative juridical (research on literature law or secondary data with sources of primary, secondary and tertiary legal materials). The research approach used is a legal, case, analytical approach and a conceptual approach with legal material collection techniques carried out by identifying and inventorying legal rules, book literature, and other legal materials. The technique of analyzing legal materials is carried out by grammatical legal interpretation and systematic interpretation. From the research, it was concluded that the transfer of home loans without the knowledge of the bank as a creditor before the credit is paid off is an act that should not be done by the debtor. The impact of this action is the emergence of risks to the debtor who accepts and sullito to take a certificate for the new debtor and in the credit over.

Abstract

Pembahasan mengenai kepastian hukum akta perjanjian pengikatan jual beli terkait tidak adanya batas waktu pelaksanaan prestasi dan akibat hukumnya. Penelitian yang dilakukan dengan menggunakan metode yuridis normatif. Permasalahan yang berkaitan dengan kepastian hukum akta pengikatan jual beli  tidak adanya batas waktu  pelaksanaan prestasi dalam perjanjian pengikatan jual beli yang dibuat di hadapan notaris. Analisis bahwa Jual beli merupakan suatu persetujuan, dengan mana pihak yang satu mengikatkan diri untuk menyerahkan suatu barang dan pihak yang lain untuk membayar harga yang dijanjikan, menurut Pasal 1457 Kitab Undang-Undang Hukum Perdata. Kepastian hukum akta pengikatan jual beli yang tidak mencantumkan ketentuan batas waktu bahwa batas waktu dengan adanya klasul-klausul yang berkaitan mengenai jangka waktu dan sanksi tersebut terdapat dalam akta PPJB, para pihak mendapatkan kepastian hukum dan kepentingan para pihak juga dapat terlindungi oleh keadaan yang di dalam akta PPJB.

Abstract

Pembahasan mengenai penyelesaian sengketa kepemilikan tanah milik perorangan yang berasal dari  tanah negara. Penelitian yang dilakukan dengan menggunakan metode yuridis normatif. Permasalahan yang berkaitan dengan bidang pertanahan, khususnya yang berkaitan dengan hak atas tanah, seringkali menimbulkan konflik. Analisis ini berfokus pada penyelesaian konflik hak atas tanah yang dulunya berada di bawah kendali negara, namun kini beralih ke masyarakat. Pembahasan Upaya penyelesaian sengketa kepemilikan tanah milik perorangan yang berasal dari tanah Negara bahwa individu yang memiliki tanah yang dulunya merupakan tanah negara dapat berupaya menyelesaikan permasalahan kepemilikan melalui peran BPN atau melalui pengadilan Penyelesaiannya berdasarkan pedoman dalam Keputusan Kepala BPN RI Nomor 34 Tahun 2007 dan Petunjuk Teknis Nomor 5 tentang Mekanisme Pelaksanaan Mediasi.

Abstract

Pembahasan mengenai tanggung jawab notaris terkait pembacaan akta yang hanya dilakukan oleh karyawan notaris. Penelitian yang dilakukan dengan menggunakan metode yuridis normatif. Kewajiban notaris terkait dengan pembacaan akta yang secara eksklusif dilakukan oleh staf notaris dibahas. Meskipun notaris tidak membaca akta yang dibuatnya, namun di akhir akta tertera bahwa notaris telah melakukannya. Hal inilah yang sungguh-sungguh menimbulkan masalah, menjadikan akta notaris menjadi akta di bawah tangan, dan merugikan pihak-pihak yang terlibat. Notaris dengan sengaja salah mengartikan akta yang dibuatnya secara tidak langsung. Kecuali beberapa akta yang dibuatnya, notaris sangat terpengaruh oleh tugasnya untuk membaca akta notaris, yang secara eksklusif dilakukan oleh staf notaris.

Abstract

This study analyzes the legal consequences of not applying the contradictory delimitation principle in the initial land registration process for land certification. This principle is essential to ensure clear land boundaries and prevent future disputes. The absence of this principle can lead to legal uncertainty, defects in land certificates, and boundary disputes, such as overlapping or duplicate certificates. This research employs a normative juridical approach with case analysis. The findings indicate that consistent application of the contradictory delimitation principle can protect land applicants, prevent disputes, and ensure legal certainty. As a form of legal protection, the National Land Agency (BPN) is responsible for re-measuring, restoring land boundaries, and compensating affected parties. The study recommends implementing the contradictory delimitation principle in all stages of land registration to minimize future conflicts.

Abstract

Violations of the indigenous peoples' rights to customary land ownership recognized by the state often fail to provide justice and legal certainty to the indigenous communities. For instance, the customary land dispute between the Mansim indigenous community and a third party has yet to find a resolution and offer legal certainty to the parties involved, despite the dispute having gone through judicial settlement. The legal theories applied here include legal certainty and dispute resolution. The method used in this study is normative juridical legal research, conducted by examining library materials or secondary data only, supported by interviews. The approaches in this study include the legislative approach, the conceptual approach, the analytical approach, and the case approach. The sources of legal material in this study are primary, secondary, and tertiary legal sources, with the collection technique involving the identification and inventory of positive legal rules, examination of library materials, and analysis of legal material sources through systematic and analogous legal interpretation.The findings of the study include that the resolution of overlapping customary land disputes with third parties, based on the Minister of Agrarian Affairs and Spatial Planning/Head of the National Land Agency Regulation No. 21 of 2020 concerning the Handling and Settlement of Land Cases, can begin with a mediation process. Mediation is implemented in the dispute between the Mansim indigenous community and a third party, using the Yielding and Problem-Solving strategy approach. The legal certainty of the peace deed, which is an authentic act in the context of resolving overlapping customary rights with certificated land, has the binding legal force and becomes the law for those who execute the agreement

Abstract

Pembahasan mengenai perlindungan hukum anak luar kawin terkait kepemilikan hak atas tanah waris yang dijual oleh ahli waris lainnya ditinjau dalam   perspektif kuhperdata. Penelitian yang dilakukan dengan menggunakan metode yuridis normatif. Perlindungan hukum bagi anak luar kawin terkait kepemilikan tanah waris yang dijual oleh ahli waris lainnya bahwa perlindungan hukum bagi anak luar kawin terkait kepemilikan tanah waris yang dijual oleh ahli waris lainnya mempunyai perlindungan hukum bagi anak luar kawin untuk memperoleh hak pewarisan jika seorang ayah dari anak diluar kawin yang memenuhi Pasal 272 KUHPerdata membuat wasiat untuk memberikan harta peninggalannya kepada anak diluar kawin, maka anak di liar kawin dan ayahnya tersebut harus datang ke kantor Notaris untuk membuat Surat Wasiat untuk membuat wasiat ataupun untuk menyimpan wasiat tersebut agar diterima oleh anak diluar kawin nantinya.

Abstract

Indonesia's ongoing development necessitates the existence of the right of management, which delegates state control over land use for the achievement of public welfare. In spite of ongoing controversies, it remains an important part of Indonesian development. The lack of recognition of its importance may be the cause of unresolved land issues. Given the very heterogeneous nature of Indonesian society and the diverse land structures, the right of management is a necessary reality. Such an analysis shall take into consideration legal protection of holders of construction rights on government lands which are converted into construction rights under management rights, as well as legal protection of holders of construction rights on government lands which are converted into construction rights under management rights. It is crucial to examine the ownership rights of land for the holders of construction rights under management rights. This examination is based on the principle of justice in connection with the right of state control in the development of land law in Indonesia.

Abstract

Responsibilities of notaries in making deeds outside their work area investigate the obligations and roles of Notaries when making deeds outside their work area. Related legal consequences for violation of the Notary Office Act and the notary Code of Ethics investigate the legal consequences that a notary may face if he violates the Notary Office Law and the notary Code of ethics. This study uses two theories of law, namely The Theory of legal consequences and liability theory. The method used in this research is normative juridical research, specifically a library law research or secondary data with primary, secondary and tertiary legal sources. As for the research approach used in this case the legislation relating to land acquisition and the method of collecting the legal materials are carried out by identifying and taking an inventory of positive law, journals and other legal sources. The method used in analyzing the legal materials (interpretation) is to get views on the public interest is ultimately owned by either private ownership or management. to get legal certainty and legal construction method. The result of this study is the deed outside the territory of the Notary is valid as evidence, can be canceled if it is defective and disputed, only by the party in the deed. The act of abrogation occurs as an act under hand. The notary is responsible civil and administrative, can sanction fees, damages, interest, warning, dismissal, or dismissal. Violation of Article 17 paragraph (1) letter a uujn-P triggers civil and administrative liability, lawsuit to the General Court. If the deed is void, the Notary is charged fees, damages, and interest. Administrative sanctions are established by the Supervisory Board of Notaries. Although not a criminal offense, notaries are bound by civil, administrative, and professional code of ethics liability. The Code provides for obligations, prohibitions, exceptions and internal sanctions

Abstract

The Notary Supervisory Council is a body that has the authority and obligation to carry out guidance and supervision of Notaries. The Notary Supervisory Council is divided into the Central Supervisory Council, Regional Supervisory Council, and Regional Supervisory Council. The aim of supervision is to ensure that Notaries when carrying out their official duties fulfill all requirements relating to the implementation of the duties of a Notary. Supervision by the Notary Supervisory Board is carried out repressively. The theory used in this research is the Theory of Legal Certainty according to Gustav Radbruch, the Theory of Legal Supervision according to Lyndal F. Urwick and Stephen Robein. The method used in this research is normative juridical (library law research or secondary data with primary, secondary and tertiary legal material sources), coupled with interviews as complementary data. The research approaches used are statutory, case, analytical and conceptual approaches with legal material collection techniques carried out by identifying and inventorying legal rules, book literature and other legal materials. Legal material analysis techniques are carried out using grammatical legal interpretation and systematic interpretation. From the results of the research, it was concluded that in order to carry out the function of supervision and guidance for Notaries, the Notary Supervisory Council has the role of supervising the party not only aimed at complying with the code of ethics but also has a broader aim, namely that the Notary in carrying out his duties fulfills the requirements. determined by statutory regulations for the protection of the interests of the community it serves. The Notary Supervisory Council has the authority to supervise, examine and impose sanctions on Notaries. In the event that a Notary commits a violation of holding multiple positions, the Notary is not authorized to make a deed and the deed cannot be treated as an authentic deed, so the deed is only a private deed.
