Abstract

Marriage aims to build a happy and eternal family, but realizing this is challenging because many factors trigger a conflict that leads to divorce. Research focuses on reasons for divorce based on marriage law. To sharpen reasoning in studying the laws of other countries, the research was carried out using comparison. The country chosen to compare with Indonesia is Turkey because Turkey has reformed family law in the form of a law, apart from that because Indonesia and Turkey have a majority Muslim population with a majority of the Shafi'i school of thought in Indonesia and Hanafi in Turkey. The research method uses a statutory and comparative approach with secondary data, namely Law Number 1 of 1974 concerning Marriage, the Compilation of Islamic Law (KHI), and the Turkish Civil Code 1926. The analysis uses three paths with conclusions based on vertical comparisons: Indonesia and the Islamic School of Religion. Shafi’i and Turkey, with the Hanafi School, both adopted some of the provisions of the school to become part of the regulations. Horizontally, the reasons for divorce in the Marriage Law in Indonesia and The Turkish Civil Code 1926 in Turkey are largely similar, and diagonally with a comparison of the history of marriage legislation, namely that every aspect of marriage law regulations is more or less influenced by the school of thought followed by that country.

Abstract

Penelitian ini bertujuan untuk mengetahui apa saja, alasan berkembang, dan bagaimana tren pengkajian hadis pendidikan masif dikaji dalam kajian hadis. Hadis sebagai sumber ajaran kedua agama Islam sejak zaman Nabi hingga saat ini senantiasa terus dikaji oleh banyak kalangan. Berstatus sebagai sumber rujukan, hadis dikaji oleh berbagai macam bidang keilmuan salah satunya ialah dalam bidang pendidikan. Oleh karenanya, dewasa ini muncul pengembangan hadis berbasis nilai-nilai pendidikan atau lebih dikenal dengan hadis tarbawi. Artikel ini mengkaji tren pengkajian hadis pendidikan dalam kurung waktu satu tahun terakhir dimulai dari periode tahun 2022 hingga tahun 2023 melalui perbantuan Open Knowledge Maps. Pendekatan yang digunakan dalam penelitian ialah kualitatif dengan metode studi literatur, pengumpulan data menggunakan jurnal sebagai data primer dan dokumentasi sebagai data sekunder, adapun analisis data yang dipergunakan ialah deskriptif. Hasil penelitian menunjukkan bahwa tren pengkajian hadis pendidikan periode 2022—2023 melalui Open Knowledge Maps antara lain pembinaan akhlak (sebanyak 3 artikel), media pembelajaran (sebanyak 2 artikel), dan proses pembelajaran (sebanyak 2 artikel). Setelah dianalisis, terbentuk satu kesatuan antara pembinaan akhlak dan media yang terjadi dalam proses pembelajaran. Artikel ini dapat membantu bagi pengembangan kajian berikutnya sebagai hasil referensi dalam menelaah hadis pendidikan lainnya dengan alat bantu pencarian artikel yang lain (semisal Google Scholar, ScinceDirect, Tandfonline, dan lain-lain). Hasil penelitian ini menghasilkan bahwa pengkajian hadis pendidikan sudah muncul berbagai macam dan dapat ditelusuri menggunakan search engine sehingga memudahkan pengkajian serta memunculkan kebaruan dalam penelitian selanjutnya.

Abstract

This research is based on the results of the 2022 PISA test, which revealed that Indonesia's scores are still lower than Malaysia's, despite both countries emphasizing literacy in reading, mathematics, and science in their education policies, as outlined in their respective constitutions and laws. This study employs a descriptive- qualitative method with a comparative approach through literature review. The results of the study show that indicate a significant gap in the abilities of Indonesian and Malaysian students in reading literacy, mathematics, and science, as shown by the 2022 PISA results. Malaysian students excel due to a more stable curriculum, a progressive mindset, and strong socio-cultural support. In contrast, Indonesian students face challenges such as a fixed mindset, math anxiety, low scientific literacy, and ineffective teaching methods. However, Indonesia's new education policies bring hope for future improvements. Changes are needed, including fostering a positive mindset, stabilizing the curriculum, implementing innovative teaching methods, and enhancing teacher quality.Collaboration among the government, schools, and families is crucial to creating a supportive learning environment, enabling Indonesian students to compete on an international level.Penelitian ini dilatar belakangi hasil tes PISA 2022 yang mana hasil skor Indonesia masih kalah unggul dari Malaysia yang saat bersamaan memiliki semangat pendidikan melalui kebijakan pendidikan yang sama dengan mengutamakan literasi membaca, matematika, dan sains yang dituangkan di konstitusi dan peraturan perundang-undangan masing-masing negara. Penelitian ini menggunakan teknik komparatif untuk mengkaji literatur dan bersifat deskriptif-kualitatif. Hasil penelitian ini menunjukkan bahwa melalui hasil tes PISA 2022 terdapat kesenjangan signifikan antara kemampuan siswa Indonesia dan Malaysia dalam literasi membaca, matematika, dan sains. Siswa Malaysia unggul karena kurikulum yang lebih stabil, mindset yang progresif, serta dukungan sosial-budaya yang kuat. Sebaliknya, siswa Indonesia menghadapi tantangan seperti fixed mindset, kecemasan terhadap matematika, rendahnya literasi sains, dan metode pembelajaran yang kurang efektif. Namun, kebijakan pendidikan baru di Indonesia membawa harapan untuk perbaikan pada masa depan. Perubahan diperlukan, termasuk pengembangan mindset positif, stabilisasi kurikulum, metode pembelajaran inovatif, dan peningkatan kualitas guru. Kolaborasi antara pemerintah, sekolah, dan keluarga sangat penting untuk menciptakan lingkungan belajar yang mendukung agar siswa Indonesia mampu bersaing di tingkat internasional.

Abstract

The distribution of inheritance according to the Badamai custom is a form of customary inheritance law practised by the Muslim Banjar community in South Kalimantan. This custom results in an equal distribution pattern between male and female heirs. This study aims to analyze the value of justice within this equal distribution system using John Rawls’ Theory of Justice. Conducted as a field study with a sociological approach in South Kalimantan, the research draws on interviews with members of the Indigenous Muslim Banjar Community, community leaders, and supporting literature, including four journal articles. Viewed through Rawls’ theory, the Badamai inheritance system is considered fair because it aligns with two key principles. The first is the principle of equal liberty, which ensures that both men and women have the same fundamental right to inherit property. The second is the difference principle, which seeks to minimize inequality. By implementing equal distribution, the Badamai custom removes disparities in inheritance allocation, ensuring equal opportunities for all heirs. This study contributes to the development of Customary Inheritance Law and encourages local governments to support the establishment of the Badamai institution to help resolve inheritance-related disputes.

Abstract

Abstracts: This study examines the implementation of restorative justice through the mechanism of penal mediation within Indonesia's criminal justice system, using John Rawls’ theory of justice as a theoretical framework. The research is grounded in the need for a more humane, participatory, and efficient alternative for resolving minor criminal offenses, as opposed to the conventional retributive justice system. This is a normative legal study employing both statutory and conceptual approaches. The data sources consist of primary and secondary legal materials obtained through literature review. The findings reveal that penal mediation has been applied in cases such as petty theft, defamation, and domestic violence, involving offenders, victims, families, and the community in the restorative process. This implementation reflects Rawls’ principles of justice particularly the equal basic liberties and the difference principle—in protecting vulnerable groups such as juvenile offenders and first-time offenders. In conclusion, penal mediation aligns not only with restorative justice values and the Islamic legal concept of maslahah, but also embodies a substantive model of justice that is inclusive and responsive to local values. Therefore, this approach deserves to be formally institutionalized within the national criminal law system.Keywords: Penal mediation, restorative justice, John Rawls’ theory of justice, Indonesian criminal law, non-litigation resolution.Abstrak : Penelitian ini mengkaji penerapan keadilan restoratif melalui mekanisme mediasi penal dalam sistem peradilan pidana Indonesia, dengan menggunakan perspektif teori keadilan John Rawls. Latar belakang penelitian ini berangkat dari kebutuhan untuk menghadirkan alternatif penyelesaian perkara pidana ringan yang lebih manusiawi, partisipatif, dan efisien dibandingkan sistem peradilan konvensional yang cenderung retributif. Penelitian ini merupakan studi hukum normatif dengan pendekatan perundang-undangan dan pendekatan konseptual. Sumber data diperoleh dari bahan hukum primer dan sekunder melalui studi kepustakaan. Hasil penelitian menunjukkan bahwa mediasi penal telah diterapkan dalam sejumlah kasus seperti pencurian ringan, penghinaan, dan kekerasan rumah tangga, dengan melibatkan pelaku, korban, keluarga, dan masyarakat dalam proses pemulihan. Implementasi ini mencerminkan prinsip keadilan Rawls, yaitu kebebasan dasar yang setara dan prinsip perbedaan, khususnya dalam melindungi pelaku dari kelompok rentan seperti anak dan pelaku pertama. Kesimpulannya, mediasi penal bukan hanya sejalan dengan nilai-nilai keadilan restoratif dan maslahah dalam hukum Islam, tetapi juga mencerminkan prinsip keadilan substantif yang inklusif dan adaptif terhadap nilai lokal. Oleh karena itu, pendekatan ini layak untuk dilembagakan secara normatif dalam sistem hukum pidana nasional.Kata kunci: Mediasi penal, keadilan restoratif, teori keadilan John Rawls, hukum pidana Indonesia, penyelesaian non-litigasi.
