Abstract

Abstract The State Administrative Court as one of the actors of judicial power is an independent judicial environment, separate from the general court, Military Court, and Religious Court, in accordance with the provisions of Article 10 paragraph (1) and paragraph (2) of Law Number 4 of 2004 about judicial power. On this basis, state administrative courts have specificities compared to other courts and have their own consequences. The aim of this research is to determine the position of the State Administrative Court as a special judicial institution in Indonesia and its consequences. This type of research is normative legal research because this research examines statutory regulations, theories or doctrines, conceptual thinking, and previous research related to the object of study in this research. The results of this research show that the consequence resulting from this specificity is that only those that are judged by the State Administrative Court are those related to State Administrative disputes. Article 1 number (10) of Law Number 51 of 2009 states that state Administrative Disputes are disputes that arise in the field of State Administration between individuals or civil legal entities and State Administrative bodies or officials, both at the central and regional levels, as as a result of the issuance of a State Administrative Decree, including employment disputes based on applicable laws and regulations. Abstract

Employee performance is not yet optimal, seen from the effectiveness of resolving complaints and grievances. Employee performance refers to individual work performance which is regulated based on standards or criteria set by an organization. The aim of this research is to analyze the influence of workload and job satisfaction on employee performance with work motivation as a mediating variable. The population in this study were all permanent employees of Perumda Tirta Mangutama, totaling 293. The sample was determined using the Slovin formula with the sampling technique used was proportional stratified random sampling, so that 75 respondents were obtained. The data analysis method used uses descriptive analysis and inferential analysis using Structural Equation Model-Partial Least Square (SEM-PLS). The research results show that workload has a positive and significant effect on employee performance. Workload has a positive and significant effect on work motivation. Work motivation has a positive and significant effect on employee performance. Job satisfaction has a positive and significant effect on employee performance. Job satisfaction has a positive and significant effect on work motivation. The mediating effect of work motivation shows that work motivation acts as a partial mediator on the influence of workload and job satisfaction on employee performance.

Abstract

Population administration services will play a strategic role in providing protection as well as recognition of the personal status of residents before the law, whether in the form of a person's status, name, address and so on. On this basis, it is necessary to apply the principles of good service law in population administration services so that people get protection for their rights. This study aims to identify and analyze the implementation of the legal principles of good public service and legal protection of the right to population administration services at the Department of Population and Civil Registration of Karangasem Regency. The type of research used in compiling this research is empirical legal research. This research is descriptive-qualitative in nature. The type of data used is in addition to using primary data also using secondary data. Primary data collection techniques through field research, while secondary data obtained through library research. The results of the study show that: first, that the Karangasem Regency Population and Civil Registration Office has not fully complied with the legal principles of good public service, particularly the principles of openness, participation and accountability. This can be seen from the lack of application of adequate service standards, the low level of knowledge of public service staff which has implications for the accuracy and discipline of service staff, the unavailability of supporting facilities and infrastructure and the low level of public understanding of the importance of population documents. Second, Legal protection of community rights in the field of population administration services at the Karangasem Regency Population and Civil Registration Service as mandated in the provisions of Article 2 of Law Number 24 of 2013 concerning Amendments to Law Number 23 of 2006 concerning Population Administration has not been fully implemented as should be in accordance with the corridor that has been determined. The community's rights that are not implemented properly are actually obliged to get legal protection, in fact this has not received a good response and a settlement pattern that benefits the community.

Abstract

The right to education for poor children is one of the rights that must be protected by a state to achieve the broadest possible welfare of the people without discrimination. Karangasem Regency is one of the districts in Bali Province with the highest number of poor people, which has an impact on the large number of children dropping out of school and resulting in poor children's right to education in Karangasem Regency not being properly obtained. The aim of this research is to determine and analyze legal protection for the right to education of poor children in Karangasem Regency. The type of research used in compiling this research is empirical legal research. This research is descriptive-qualitative in nature with data collection techniques, namely through observation, interviews and documentation. The results of this research indicate that legal protection for the right to education of poor children in Karangasem Regency has not been fully implemented properly. This can be seen from the dissemination of policies issued by the government to help the education of poor children in Karangasem Regency which is still not evenly distributed, and the amount of assistance provided by the government to help with the costs of educating poor children in Karangasem Regency is still limited. The obstacles faced in providing legal protection for poor children's right to education in Karangasem Regency originate from 3 factors, the first is from community factors, namely regarding community motivation in continuing education which is still low. The two factors are facilities and infrastructure, namely the number of educational facilities in the form of the number of schools, the ratio of students and teachers is still not optimal. Lastly, there is the government factor, where the validity of data on poor residents or children in Karangasem Regency is not yet optimal, which results in the legal protection being provided not being optimal.

Abstract

Abstract The issue of decentralization is also closely related to the vertical separation of powers, namely a proposition that explains the distribution of powers between various levels of government. This is related to the division of authority between central and regional government levels. In Indonesia there have been several regulatory changes related to regional government, which of course also have an impact on the pattern of division of authority between the central and regional governments. The aim of this research is to analyze the ideal concept of decentralization for the Unitary State of the Republic of Indonesia. This type of research is normative legal research, because this research examines statutory regulations, theories or doctrines, and conceptual thinking and previous research related to the object of study in this research. The results of this research show that the ideal decentralization concept for the Unitary State of the Republic of Indonesia is a combination of symmetry and asymmetry which is the right combination or is known as the Integrated Decentralization System concept. In this decentralization, regions have broad authority in terms of managing their household affairs, including planning, implementation and evaluation, which are given to the regions with complete authority. In this decentralization, the role of the central government is not completely absent, the central government continues to supervise certain limits. Abstract

Pembentukan peraturan perundang-undangan di Indonesia memiliki keterkaitan yang sangat erat dengan konsep negara hukum, karena dalam konsep negara hukum termuat beberapa konsep yang akan memberikan petunjuk bagi para pembentuk peraturan perundang-undangan. Harapannya dengan hal tersebut, peraturan perundang-undangan yang dihasilkan mampu berorientasi pada kepentingan masyarakat, menjamin adanya perlindungan hak asasi manusia serta mampu mewujudkan keadilan bagi seluruh rakyat dan elemen masyarakat. Jenis penelitian ini adalah penelitian hukum normatif, karena penelitian ini mengkaji peraturan perundang-undangan, teori atau doktrin, dan pemikiran konseptual serta penelitian terdahulu yang berkaitan dengan obyek telaah dalam penelitian ini. Hasil penelitian ini menunjukkan bahwa konsep negara hukum menjadi bagian yang tidak terpisahkan dengan pembentukan peraturan perundang-undangan di Indonesia, karena di dalamnya terdapat beberapa hal yang penting dapat menunjang pembentukan produk hukum nasional yaitu diantaranya supremasi hukum (supremacy of law), persamaan kedudukan dalam hukum (equality before the law) dan pemerintahan, asas legalitas (due process of law), peradilan bebas dan tidak memihak, perlindungan Hak Asasi Manusia (HAM), berfungsi sebagai sarana mewujudkan tujuan bernegara (welfare rechtsstaat), serta transparansi dan kontrol Sosial. Apabila konsep negara hukum tersebut diimplementasikan dengan baik dan konsekuen dalam pembentukan peraturan perundang-undangan di Indonesia, maka produk peraturan perundang-undangan yang dihasilkan akan memberikan manfaat serta membawa aspek keadilan terhadap masyarakat. Abstract

Elections are an important tool in realizing democracy and popular sovereignty. However. This triggered a lawsuit to the Constitutional Court (MK) to test the constitutionality of norms that were considered contrary to the 1945 Constitution of the Republic of Indonesia. Decision Number 90/PUU-XXI/2023 which regulates the age limit of presidential and vice presidential candidates After the Constitutional Court's decision, Article 169 letter q of the Election Law was amended by adding the phrase "or has / is currently holding an office elected through general elections including regional head elections". This decision has drawn pros and cons because it is considered to open up opportunities for young politicians to advance in the electoral contestation, but on the other hand it is feared that it will result in a lack of experience and capability in leading the nation. The purpose of this study is to examine and analyze the legal review of the Constitutional Court's decision Number 90/PUU-XXI/2023 in the perspective of comparison with other legal provisions and to find out and analyze the legal implications arising from the Constitutional Court's decision Number 90/PUU-XXI/2023 in guaranteeing people's constitutional rights. This research uses normative research methods with a doctrinal juridical approach. Research data is obtained through literature studies, namely primary and secondary legal materials relevant to the research topic. This research uses judicial theory, legal state theory, and democracy theory as the basis for analyzing the Constitutional Court's decision and its implications for people's constitutional rights. The results of this study show that this decision is in accordance with the constitution and legal principles applicable in Indonesia. Strengthening the people's political rights to elect and be elected to run for president and vice president. Thus, upholding the principles of equality and justice in the democratic process. Other countries have provided opportunities for every citizen under the age of 40 to participate in running for president and vice president as regulated in the laws of each country. The implications of the Constitutional Court's decision number 90/PUU-XXI/2023 give hope to young people or regional heads who are under the age of 40 to participate in the contestation of the election of the president and vice president of the Republic of Indonesia.

Abstract

Through MK decision no. 14/PUU-XI/2013 concerning the review of Law no. 42 of 2008 concerning the General Election of the President and Vice President states that general elections in Indonesia are held simultaneously between the legislature and the executive, which is generally known as simultaneous general elections. However, in its implementation, this simultaneous general election still experienced a number of problems. This is why law enforcement in simultaneous general elections is very important to realize honest and democratic elections. The aim of this research is to examine the problems that occurred in simultaneous elections and their law enforcement. The research method used in this research is normative legal research, which refers to doctrine and theory as well as statutory regulations and previous research that are relevant to the problem at hand. The research results show that several problems that arise related to simultaneous general elections include general election logistics issues, updating the final voter list, errors in vote counting due to damaged or invalid ballot papers, as well as money politics problems that still occur. General election law enforcement must pay attention to three benchmarks, namely General Election Administration Provisions (KAP), General Election Criminal Provisions (KPP), and General Election Ethics Provisions (KEEP). These three elements need to be empowered and regulated repeatedly in order to create law enforcement and democratic resolution of election disputes.

Abstract

Pemerintah Kabupaten Karangasem melalui Peraturan Bupati Nomor 58 Tahun 2021 sebagaimana terkahir dirubah melalui Peraturan Bupati Karangasem Nomor 47 Tahun 2022 tentang Pemberian Penghargaan atas Pengurusan Pencatatan Kematian, Pemerintah Kabupaten Karangasem meluncurkan sebuah program Atma Kerthi yang tujuannya adalah untuk meningkatkan partisipasi masyarakat dalam melaporkan peristiwa penting kependudukan yang dialami yaitu berupa peristiwa kematian. Penelitian ini bertujuan untuk menganalisis pengimplementasian program Atma Kerthi serta menganalisis faktor penghambat dan faktor pendukung pengimplementasian program tersebut dalam mewujudkan tertib administrasi kependudukan di Kabupaten Karangasem. Jenis penelitian yang digunakan dalam menyusun penelitian ini adalah penelitian hukum empiris. Penelitian ini bersifat deskriptif-kualitatif. Jenis data yang digunakan adalah selain menggunakan data primer juga menggunakan data sekunder. Teknik pengumpulan data primer melalui penelitian lapangan, sedangkan data sekunder diperoleh melalui penelitian kepustakaan. Data-data tersebut kemudian dianalisis dan deskripsikan secara kualitatif. Hasil penelitian menunjukkan bahwa pengimplementasian program Atma Kerthi di Kabupaten Karangasem masih menemui masalah yaitu diantaranya kehabisan anggaran yang menyebabkan banyaknya pemohon Atma Kerthi yang seharusnya menerima penghargaan atas pelaporan kematian secara tepat waktu, justru harus menunggu sampai berbulan-bulan. Adapun faktor penghambat dan faktor pendukung dalam pengimplementasian program Atma Kerthi di Kabupaten Karangasem yaitu Faktor penghambatnya yaitu perencanaan anggaran yang kurang maksimal, kurangnya partisipasi masyarakat dalam memahami informasi terkait layanan program atma kerthi serta sarana dan prasarana pelayanan yang kurang memadai. Sedangkan faktor pendukung pengimplementasian program Atma Kerthi ini adalah standar layanan yang memadai dan kompetensi petugas layanan yang memadai.
