Abstract

Riset ini bertujuan untuk mempelajari bagaimana konsep harta dalam pandangan islam. Harta dalam Islam bukan hanya sekadar alat tukar atau sarana memenuhi kebutuhan hidup, tetapi juga memiliki dimensi spiritual, sosial, dan etis yang harus dipahami dan diimplementasikan oleh umat Islam. Penelitian ini bersifat kualitatif dimana studi kepustakaan digunakan sebagai pendekatan penelitian. Hasil dalam penelitian ini didapatkan bahwa terdapat perbedaan mengenai esensi harta. Jumhur ulama mengatakan, bahwa harta tidak saja bersifat materi, tetapi juga termasuk manfaat dari suatu benda, karena yang dimaksud adalah manfaat, bukan zatnya (bendanya). Sedangkan menurut Hanafiyah bahwa harta mesti dapat disimpan, maka sesuatu yang tidak dapat disimpan tidak dapat disebut harta, maka manfaat menurut Hanafiyah tidak termasuk harta, tetapi manfaat termasuk milik

Abstract

Islamic mortgage financing (KPR iB) is one of the flagship products of Islamic banking in Indonesia, designed to facilitate home ownership in accordance with Sharia principles. However, customer participation in KPR iB remains suboptimal compared to conventional mortgage products. This study aims to examine the factors influencing customer decisions in choosing KPR iB, particularly from the perspective of Islamic Economic Law. The study specifically analyzes: (1) the influence of Sharia compliance, product innovation diffusion, promotion, and product quality on customer decisions to choose KPR iB in Bogor; and (2) the mediating role of customer decisions in the relationship between those variables and the increase of Islamic bank market share. This research employs a Mixed Methods approach, with an Explanatory Sequential Design combining quantitative and qualitative analyses. The theoretical framework includes Rational Choice Theory (Gary Becker) as the Grand Theory, Islamic Consumer Behavior Theory (Umer Chapra) as the Middle Theory, and Sharia Compliance Theory (Monzer Kahf) as the Application Theory. Data were collected through questionnaires, observations, interviews, and document analysis. The data were analyzed using Structural Equation Modeling (SEM) with SmartPLS 3.0. The findings indicate that: (1) Sharia compliance does not significantly influence customer decisions; (2) product innovation, promotion, and product quality have a significant positive effect on customer decisions; and (3) customer decision does not mediate the relationship between Sharia compliance and market share, but effectively mediates the impact of product innovation, promotion, and product quality on increasing Islamic bank market share.

Abstract

The purpose of this research is to analyse the legal status of children born from marriages of different nationalities in the perspective of Indonesian Civil Law and Islamic Law. This research is important because children born from mixed marriages are entitled to protection of their legal status in order to maintain the continuity of life, legal position and civil interests. The research method used is normative juridical legal research with qualitative data types in the form of secondary data consisting of primary legal materials, secondary legal materials and tertiary legal materials relevant to the topic of this research and data collection techniques using library research or literature studies with legal material analysis techniques using descriptive analysis methods. The results of this study state that the law of marriage between different nationalities in the perspective of Indonesian civil law and Islamic law raises problems with the law of marriage itself as well as the legal status, civil rights and citizenship rights of children. In the perspective of Indonesian civil law and Islamic law, the law of marriage of different nationalities is a valid marriage and the legal status of the child is a legitimate child, the civil rights of children from marriages of different nationalities are the same as children in general and the legal status of the child's citizenship as an Indonesian citizen follows the citizenship of the father or mother who is an Indonesian citizen and can also have dual citizenship until he is 18 years old or married, after which the child must declare choosing one of his citizenship.
