Abstract

The purpose of this research, which is based on an evaluation of Indonesia's cybercrime legislation, is to examine the difficulties encountered by the Indonesian National Police in carrying out their duties to combat cybercrime and computer crime, and to draw conclusions about how recent technological advancements have contributed to an increase in both the frequency and severity of these crimes. This study employs a philosophical and analytical approach to normative law as its research methodology. It examines applicable statutes and regulations, as well as legal theory and current practices in law enforcement. Cybercrime is on the rise, and the study's findings suggest that this trend is directly tied to the expansion of information technology, which in turn allows cybercriminals to employ more complex strategies. Not having clear legislative restrictions pertaining to cybercrime, insufficient preparation on the part of law enforcement, subpar system security, and an uninformed public are the primary challenges. Some of the proposals include creating communication platforms amongst law enforcement agencies to boost collaboration in the fight against cybercrime, educating the public and conducting targeted investigations using cutting-edge technical methods, and expanding outreach and education efforts to the general population.

Abstract

The purpose of this research is to examine the criminal difficulties and legal ramifications of the modern era's epidemic of disinformation on social media in an effort to come up with thorough answers to these issues. The proliferation of hoaxes and other forms of misinformation has threatened Indonesia's social, political, and economic stability in recent years, thanks to the proliferation of social media and other forms of online communication. Another major problem with prosecuting hoaxers is the difficulty of law enforcement in the digital sphere, which includes factors like the anonymity of the offenders, different interpretations of rules, and the general public's lack of competence with digital technology. A descriptive-analytical technique is used in the research method of normative legal studies. In order to find problems and provide answers, this study compares applicable rules with international standards, namely the Criminal Code and the Electronic Information and Transactions Law. Laws, judicial judgments, and other primary legal documents are complemented by secondary legal items such as scholarly publications and literature. The study's findings reveal that despite the existence of laws like the Electronic Information and Transactions Law, its execution is often hindered by the international character of cyberspace and the dearth of funding for digital forensics tools. To combat these issues, the report suggests more adaptable regulation updates, societal efforts to increase digital literacy, technological advancements for law enforcement, and international collaboration. Additionally, law enforcement must strike a balance between protecting individuals' right to free speech and discouraging criminal behavior

Abstract

Abstract

The policy in handling street children is a required aspect of the state's duty to guarantee rights for children, as mandated by the rule of law and good governance standards. The researcher has as it's target measured the difference between ideal principles under the rule of law metrics such as certainty constructions, fairness equations, equitable distribution of social costs (which benefits more people than capitalism gives in general) and protection for children who are not old enough to protect themselves and the specific policies that emerge in Indonesia's traditional manner of dealing with street kids. This study also examines how public policy governance can be strengthened to be more aligned with the principles of accountability, transparency, effectiveness, institutional coordination, and responsiveness. Based on a study of various bureaucratic policies and practices at the central and regional levels, it was found that there was a discrepancy between the values ??that should be the basis for policy formulation and the conditions of practice in the field. The gap can be seen in the weak database, limited basic service facilities, lack of coordination across institutions, and policy orientation that tends to be reactive and unsustainable. This study recommends strengthening public policy governance through institutional integration, more consistent planning, more accurate data utilization, and the application of an approach centered on the fulfillment of children's rights to ensure policy conformity with the principles of the rule of law and good governance.
