Abstract

This study aims 1) to find out how effective the formation of regional regulations for Batang Hari Regency is based on the Regulation of the Minister of Home Affairs Number 80 of 2015 concerning the Establishment of Regional Legal Products. 2) To find out the inhibiting factors in the formation of regional regulations in Batang Hari Regency. The type of research is empirical juridical. The procedure for sampling is done by purposive sampling. Then the analysis of the data obtained, namely primary data and secondary data collected is drawn into a conclusion inductive method, namely from general data formulated in the form of questions. The results show that the formation of regional regulations in Batang Hari Regency is based on the Minister of Home Affairs Regulation Number 80 of 2015 concerning the Establishment of Regional Legal Products, the proposed Ranperda can be submitted by the regional government or DPRD. With the existence of local governments, it is expected to be effective in the practice of making local regulations by adjusting the interests of the community. The formation of regional regulations is required to prioritize the interests of the community, so it is hoped that there will be maximum cooperation between agencies related to the regional government so as to produce a regional regulation that has aspects of justice and legal certainty for the people of Batang Hari Regency.

Abstract

The government system in Indonesia is organized in stages starting from the central government, provincial, district/city and village governments. All government affairs are divided into each level of government. The village government is the spearhead that has direct contact with the community in real terms. Historically, the existence of villages in Indonesia existed before the Unitary State of the Republic of Indonesia existed or was formed, therefore, if you look at Law No. 6 of 2014 concerning Villages, it is stated that Villages are Villages and traditional villages or referred to by other names, hereinafter referred to as Villages, is a legal community unit that has territorial boundaries that has the authority to regulate and manage government affairs, the interests of local communities based on community initiatives, rights of origin, and/or traditional rights that are recognized and respected in the government system of the Unitary State of the Republic of Indonesia. Openness in the administration of village government is absolutely necessary as a form of accountability for all decisions and policies that have been taken and implemented related to the implementation of development, community development and community empowerment. Openness is needed to increase community participation in development by providing input, support and control over the running of village government. The reality on the ground is that in 2015 the consequence of implementing the Village Law was that funds were disbursed from the APBN which were quite large at the village level, however openness regarding the implementation of village funds was very minimal until now, the human resource capacity of village officials was very minimal. so that it greatly influences the management and management of village funds to create an independent and prosperous village community based on the principles of good governance, namely accountability, transparency and participation.

Abstract

Introduction: Differences in legal position related to the division of bankruptcy between creditors holding collateral and labor rights in the of the Bankruptcy Law and in other laws and regulations will actually create legal uncertainty in providing guarantees of protection to labor rights and cause conflicts between legal norms. Purposes of the Research: To find out the various provisions of laws and regulations governing labor rights for the division of bankrupt debts and synchronization between Law No. 37 of 2004 concerning Bankruptcy with other laws and regulations in regulating labor rights to the division of bankrupt and the application of legal protection of labor rights to the division of bankrupt debts. Methods of the Research: The type of research used is normative juridical research. The nature of this research is descriptive. The data source used is secondary data. The nature of this research is descriptive analytical research and drawing conclusions using deductive methods. Results Originality of the Research: The research results show that the synchronization of Law Number 37 of 2004 concerning Bankruptcy with other provisions in the interpretation of the law has been assigned on the decision of the Constitutional Court Number 18/PUU-VI/2008 and 67/PUU-XI/2013 that the payment of labor wages must take precedence over the bills of the state and separatist creditors while severance and other rights are granted after the compliance of the invoices of separatist creditors. In addition, the legal position for labor is determined by the Law and the decisions of the Constitutional Court as a preferred creditor of the proceeds of the sale of the boedel and its enforcement of the law refers to the lex specialis derogat lex generalis while take to consideration other term governing the rights of creditors. Legal implications to bankruptcy companies, the compliance of labor rights is determined by the proceeds of the sale of boedel which is based on the provisions in Article 95 of Law No. 11 of 2020 about Omnibus Law as amended from the provisions regulated in Law No. 13 of 2003 about Manpower, Article 49 and Article 50 of Government Regulation No. 36 of 2021 about Wages.

Abstract

Reintegrasi sosial merupakan proses penting bagi narapidana setelah menjalani masa hukuman, khususnya dalam hal adaptasi sosial saat kembali ke masyarakat. Kegiatan ini bertujuan meningkatkan pemahaman warga binaan pemasyarakatan (WBP) terkait hak-hak pasca-bebas serta aturan hukum yang berlaku. Metode pelaksanaan terdiri dari empat tahap: identifikasi kebutuhan melalui survei dan wawancara; pemberian materi tentang hak-hak WBP dan pemahaman hukum; sesi tanya jawab dan diskusi; serta evaluasi melalui pretest dan posttest. Hasil menunjukkan peningkatan pemahaman hukum peserta sebesar 50%. Reintegrasi sosial tidak hanya berdampak pada individu, tetapi juga pada pembentukan masyarakat yang lebih adil dan manusiawi. Dukungan dari negara, masyarakat, dan keluarga berperan penting dalam mengubah mantan narapidana menjadi agen perubahan positif. Dengan membangun ekosistem yang inklusif dan suportif, diharapkan mata rantai kejahatan dapat diputus, menciptakan masa depan yang lebih baik.

Abstract

Kenakalan remaja adalah perilaku yang menyimpang dari norma, aturan, atau hukum yang dilakukan oleh remaja, sedangkan Kekerasan seksual adalah Perbuatan yang merendahkan, menghina, melecehkan, dan/atau menyerang tubuh, dan/atau fungsi reproduksi seseorang. Kekerasan seksual bisa terjadi di setiap komunitas dan korbannya tidak memandang jenis kelamin dan usia. Kekerasan seksual dapat berupa perkataan dan tindakan yang bersifat seksual, yang bertentangan dengan keinginan seseorang dan tanpa persetujuannya. Kenakalan remaja dapat disebabkan oleh faktor internal seperti krisis identitas atau kontrol diri yang lemah, dan faktor eksternal seperti keluarga yang broken home atau teman sebaya yang kurang baik. Tujuan dari Pengabdian ini adalah memberikan pembelajaran bagi Siswa- siswi yang ada di SMA Negeri 3 Kabupaten Kepulaun Aru agar dapat terhindar dari Kenakalan Remaja dan Kekerasan Seksual di era zaman ini, mengingat Kabupaten Kepulauan Aru sangat marak terjadi Kekerasan Seksual di kalangan pemuda dan remaja. Metode Pelaksanaan Pengabdian dilakukan dengan cara Sosialisasi Bagi 30 Siswa – Siswi SMA Negeri 3 Kabupaten Kepulauan Aru dan Para Guru di Sekolah.
