Abstract

This study raises the case of a judge's rejection of a claim for compensation for the management of a dowry dispute at the Bantaeng Religious Court. The case involved a couple who separated after the husband took back the land that had previously been used as dowry. Although the judge decided to return the land to the wife, the judge rejected the wife's claim for compensation for the management of the land. In this context, the rule of Al'adatu Muhakkamah is one of the principles used in determining the law when there is no shar'i evidence that explicitly explains it. This study aims to analyze the judge's decision to refuse compensation for the results of the management of the dowry dispute and analyze the use of the Al'adatul Muhakkamah rule in the decision. The research method used is normative legal research method with a qualitative approach. The qualitative approach was chosen to describe the research results with sentences that categorize the data according to certain categories. With this approach, the research can provide in-depth conclusions about the application of the Al'adatu Muhakkamah rule in the judge's decision. The research findings show that the judge should have granted the compensation claim based on the analysis of the al-'adatul muhakkamah rule. Islamic law aims to realize human welfare, including by recognizing that customs that are still valid for generations have a significant influence in determining legal decisions. However, the main principle of sharia must still be the top priority, especially if there is a conflict between custom and Islamic Law.

Abstract

This study discusses the implementation of Qawā‘id Fiqhiyyah (Islamic legal maxims) in addressing and resolving increasingly complex contemporary issues in line with the advancement of time, particularly in the social, economic, and technological domains. Qawā‘id Fiqhiyyah serve as foundational principles in Islamic law that are universal and flexible, enabling them to be applied in response to new problems not explicitly regulated in the scriptural sources (nash). Maxims such as al-‘ādah muḥakkamah (custom is authoritative), al-maṣlaḥah al-mursalah (unrestricted public interest), al-ḍarar yuzāl (harm must be eliminated), and al-mashaqqah tajlib al-taysīr (hardship begets ease) form essential foundations for formulating contextual and beneficial Islamic legal solutions. This research is normative juridical in nature, using a statute approach. Data were obtained from primary legal sources such as the Qur’an, Hadith, and classical texts on uṣūl al-fiqh and qawā‘id fiqhiyyah, supported by secondary and tertiary legal materials. The data analysis technique used is qualitative, with a descriptive-analytical approach. The results of the study indicate that Qawā‘id Fiqhiyyah are capable of serving as adaptive guidelines in establishing Islamic legal rulings on modern phenomena such as digital transactions, sharia-compliant fintech, and contemporary social issues. These maxims provide both theoretical and practical foundations for scholars and academics to perform legal ijtihad, ensuring that Islamic law remains relevant and solution-oriented across eras

Abstract

This study aims to examine the practice of angkap marriage in the Gayo traditional community through the Maqashid Syariah perspective, especially in the aspect of safeguarding property (hifzh al-mal). angkap marriage is a form of social adaptation that arises as a solution to the problem of the absence of sons in a family, as well as the economic obstacles experienced by the male party in carrying out marriage, especially in terms of fulfilling the dowry or edet. This research uses a normative juridical method with a statute approach, namely by analyzing written legal norms and related maqashid sharia principles. The analysis technique used is qualitative. The results show that angkap marriage provides a practical solution in maintaining the continuity of family property through the appointment of a son-in-law as part of his wife's family. The implication is that the husband changes his position in the inheritance system and becomes the protector of his in-laws' property. This tradition does not substantially contradict Islamic law and instead reflects the objectives of Islamic law, namely maintaining benefits, strengthening family resilience, and keeping property in a safe and reliable environment.

Abstract

This study is motivated by the absence of social considerations, such as long distance marriage, as a valid legal basis for marriage prevention under positive law, despite empirical evidence indicating that such conditions often lead to marital issues. The aim of this research is to analyze Decision Number 32/Pdt.P/2019/PA.Bn concerning a marriage prevention petition filed by a father against his daughter’s prospective husband on the grounds of kafa’ah incompatibility and the risks associated with a long-distance marriage. The method employed is normative juridical, using a case law approach and a conceptual review of Islamic legal principles and Indonesian legal regulations, particularly Law Number 1 of 1974 and the Kompilasi Hukum Islam (KHI). The findings show that the Panel of Judges rejected the petition on the grounds that the reasons presented did not meet the formal legal requirements as stipulated in Article 13 of the Marriage Law and Article 60 of the KHI. The panel adhered to the principle of legality and ruled that long distance marriage and kafa’ah incompatibility cannot serve as legal grounds for preventing a marriage. Nevertheless, from a social and jurisprudential perspective, long-distance marriages have frequently been identified as contributing factors to divorce in various religious court decisions. The study concludes that although social reasons such as long distance marriage have tangible impacts, they are not yet normatively recognized within Indonesia’s marriage law framework. The implication is a need for regulatory reformulation and more adaptive interpretative approaches to social realities, along with the strengthening of premarital counseling programs and labor policies that support family cohesion.
