Abstract

This study examines the performance of law enforcement officials in applying Article 33 of Law No. 11 of 2012 within the context of the Vina Cirebon case. Utilizing a qualitative approach, the research employs juridical normative analysis to explore the effectiveness and challenges faced by officials in enforcing the law. The findings reveal varying levels of understanding and awareness of Article 33 among law enforcement officials, impacting the consistency and effectiveness of its application. Key challenges identified include insufficient training and resources, discretionary decision-making, and difficulties in victim participation. Despite the potential benefits of diversionary measures, inconsistencies in their application and a lack of follow-up mechanisms hindered their effectiveness. The study concludes with recommendations for enhancing training programs, standardizing procedures, improving victim engagement, and increasing resources to support the successful implementation of diversion measures. This research contributes to a deeper understanding of the practical implications of legal provisions and offers recommendations for strengthening the juvenile justice system in Indonesia.

Abstract

This paper examines the application of Law Number 12 of 2022 on the Crime of Sexual Violence in addressing cases of gender-based violence (GBV) within Indonesia’s creative economy. Using a juridical analysis approach, the study explores the effectiveness of the law in protecting victims, prosecuting offenders, and preventing future incidents of sexual violence in a sector characterized by informal employment and unique workplace dynamics. Case studies of sexual violence incidents in the creative economy reveal challenges in reporting, barriers in legal processes, and the critical role of industry stakeholders in mitigating or enabling GBV. While the law offers comprehensive protections, including victim support and criminal sanctions, its effective implementation requires enhanced law enforcement training, workplace safety policies, and accessible reporting mechanisms. The study concludes with recommendations to strengthen the application of Law Number 12 of 2022, ensuring greater protection for creative industry workers from gender-based violence.

Abstract

The enactment of Law No. 27 of 2022 on Personal Data Protection marks a pivotal moment in Indonesia’s regulatory framework, particularly for industries that handle significant amounts of personal data, such as the financial technology (fintech) sector. This study provides a normative juridical analysis of the PDP Law and examines its impact on the fintech industry. The research focuses on the law’s key provisions, including consent requirements, data breach notification, and data security obligations. Additionally, the study explores the operational challenges fintech companies face in complying with the law, such as the costs of compliance, technical requirements, and the need for employee training. While the PDP Law enhances consumer trust by offering greater protection and transparency, it also presents hurdles that fintech firms must overcome to ensure compliance. The analysis concludes with recommendations for fintech companies to balance legal obligations with innovation to maintain competitiveness in Indonesia’s evolving digital economy.

Abstract

Praktik bisnis berkelanjutan telah menjadi fokus utama dalam konteks korporat modern, dengan perusahaan semakin memahami perlunya mengintegrasikan pertimbangan Environmental, Social, and Governance (ESG) dalam pengambilan keputusan keuangan mereka. Artikel ini bertujuan untuk mengevaluasi dampak praktik bisnis berkelanjutan terhadap kinerja keuangan perusahaan. Metode penelitian menggunakan analisis data keuangan dan indikator ESG untuk sejumlah perusahaan yang menerapkan praktik bisnis berkelanjutan. Hasil penelitian menunjukkan bahwa perusahaan yang menerapkan praktik bisnis berkelanjutan memiliki kinerja keuangan yang lebih baik dibandingkan dengan yang tidak menerapkannya. Penilaian ini mencakup aspek keberlanjutan, tanggung jawab sosial, dan tata kelola perusahaan yang efektif. Penelitian ini memberikan wawasan mendalam tentang bagaimana ESG mempengaruhi kinerja keuangan, mendukung argumen bahwa praktik bisnis berkelanjutan bukan hanya tanggung jawab sosial, tetapi juga memberikan nilai tambah finansial bagi perusahaan.

Abstract

This study employs bibliometric analysis to map the research landscape of Corporate Social Responsibility (CSR) over several decades. By synthesizing data from extensive academic databases, this research identifies thematic clusters, trends over time, collaboration networks, and potential future research directions within the field of CSR. The thematic analysis highlights the evolution from foundational CSR concepts to more nuanced discussions on the economic and strategic implications of CSR. Temporal trends suggest a shift towards integrating CSR into core business strategies, with an increasing focus on economic outcomes and shareholder interests. The author collaboration network reveals both dense and emergent clusters of researchers, indicating robust areas of established inquiry alongside emerging research fronts. Additionally, this study identifies underexplored areas such as the cost implications of CSR, its integration with marketing strategies, and the influence of regulatory frameworks, proposing these as vital for future research. This comprehensive overview not only maps the current state of CSR research but also directs future scholarly efforts towards areas with the potential for significant impact.

Abstract

Studi ini mengeksplorasi evolusi dan dampak transparansi serta akuntabilitas dalam pelaporan keuangan sektor publik, dengan menggunakan pendekatan bibliometrik untuk menganalisis literatur yang relevan. Dengan memetakan tren, tantangan, dan hasil yang berhubungan dengan praktik ini, penelitian mengungkapkan pergeseran fokus dari pelaporan yang komprehensif menuju tata kelola dan etika yang lebih kompleks. Hasilnya menyoroti hubungan penting antara praktik pelaporan keuangan dan peningkatan tata kelola serta kepercayaan publik, menunjukkan peran krusial transparansi dalam mengurangi korupsi dan meningkatkan integritas sektor publik. Penelitian ini juga mengidentifikasi area yang kurang diteliti, seperti peran perbankan dalam transparansi dan audit internal, yang membuka peluang penelitian lebih lanjut.

Abstract

Proliferasi perjudian online menimbulkan tantangan yang signifikan bagi pemerintah di seluruh dunia, termasuk Indonesia, di mana norma-norma budaya dan kerangka hukum dengan tegas melarang kegiatan perjudian. Makalah ini memberikan analisis normatif tentang strategi pemerintah Indonesia dalam memerangi perjudian online, memeriksa kerangka hukum, langkah-langkah penegakan hukum, dampak sosial, pertimbangan etika, dan perspektif komparatif. Meskipun ada larangan yang ketat, perjudian online tetap ada karena kemajuan teknologi dan operasi transnasional. Analisis ini menyoroti dilema etika dalam menyeimbangkan kebebasan individu dengan kesejahteraan masyarakat dan merekomendasikan pendekatan regulasi yang lebih baik untuk mengurangi bahaya sosial sambil menjunjung tinggi nilai-nilai budaya. Dengan mengevaluasi lanskap regulasi Indonesia dalam konteks global, studi ini memberikan kontribusi wawasan tentang strategi tata kelola yang efektif untuk mengatasi praktik perjudian online.
