Abstract

Indonesia telah mengesahkan Undang-Undang Nomor 11 Tahun 2020 Tentang Cipta Kerja. Konsespi hukum Undang-Undang Nomor 11 Tahun 2020 pada sebagian sektor mengatur mengenai pengakuan hak atas tanah ulayat masyarakat hukum. Jenis penelitian yang digunakan adalah penelitian hukum hukum normatif. Pendekatan hukum yang digunakan dalam penelitian ini adalah pendekatan peraturan perundang-undangan dan pendekatan konsep. Hasil penelitian menunjukkan bahwa Undang-Undang Nomor 11 Tahun 2020 telah mmengatur hak ulayat masyarakat hukum adat pada bidang investasi. Namun dalam pengaturan tersebut, Undang-Undang Nomor 11 Tahun 2020 menerapkan prinsip persetujuan dalam pengelolaan dan pemanfaatan tanah ulayat masyarakat hukum adat. Hal ini sangat bertentangan degan prinsip dalam Free, Prior, and Informed Consent (FPIC) yang mengabaikan dua prinsip lainnya yakni free and prior dalam pengelolaan dan pemanfaatan tanah ulayat masyarakat hukum adat. Pengabaian prinsip FPIC terhadap pengaturan hak-hak masyarakat hukum adat telah menjadikan kedudukan hukum masyarakat hukum adat semakin lemah dalam hal pengambilan keputusan terkait pengelolaan dan pemanfaatan tanah ulayat apabila berhadapan dengan pemerintah atau perusahaan swasta. Sedangkan menurut Teori hukum kritis pengakuan hak masyarakat hukum adat dalam Undang-Undang Nomor 11 Tahun 2020 ditemukan beberapa persoalan baik persoalan pada dimensi prosedural, distributif dan kontekstual. Saran dari penelitian ini adalah UU No. 11 Tahun 2022 perlu dilakukan revisi, revisi UU No. 11 Tahun 2022 dapat direvisi melalui pengujian pasal-pasal yang berkaitan dengan tanah ulayat masyarakat hukum adat di Mahkamah Konstitusi yang mana proses pengujiannya berlandaskan padal Pasal 18 B ayat 2 UUD 1945 terkhusus yang mengatur prinsip persetujuan yang harus berlandaskan pada prinsip Free, Prior, and Informed Consent (FPIC). Selain itu pula, perlu dibuatkan Perpu yang berkaitan pengaturan tanah ulayat dibidang investasi dengan berlandaskan pada prinsip Free, Prior, and Informed Consent (FPIC). Hal ini penting untuk menjamin kepastian hukum masyarakat hukum adat atas tanah ulayat

Abstract

To foster stability, order, and peaceful conditions in society, as well as to instill a sense of discipline and habitual behavior among individuals in South Buton Regency, the South Buton Regency Regional Regulation Number 2 of 2020 concerning Public Order and Community Peace was established. This regulation underscores the significance of community participation in enhancing various aspects of life, including knowledge, economy, social structures, environment, and politics. Active engagement from all members of society is essential in creating a safe and comfortable environment. However, the effectiveness of this regulation is hampered by the lack of public awareness and understanding, primarily due to insufficient dissemination of information. As a result, many community members are unaware that they may be violating the regulation, leading to inadvertent non-compliance. The absence of proper socialization efforts from relevant authorities means that the public does not receive necessary information or warnings about the prohibitions outlined in the regulation. This gap in communication and education is a critical factor contributing to the lack of adherence to the regulation and underscores the need for more robust public outreach and education initiatives. By improving socialization and awareness efforts, the authorities can ensure that the community is better informed, which will enhance compliance and ultimately contribute to a more orderly and peaceful society.

Abstract

The aim of this research is to analyze witness protection in divorce cases in Indonesia. Witnesses are one of the pieces of evidence used in divorce cases in the Religious Court, yet witnesses brought forth during trials face threats and legal demands. Meanwhile, the aspect of witness protection remains unregulated. This article questions why it is crucial to protect witnesses in divorce cases in religious courts and what constitutes an ideal concept of witness protection. This research employs a legislative and case-based approach. This article suggests that witness protection is highly significant as witnesses are often utilized as evidence. Based on 709 applications from non-criminal cases seeking protection from the Witness and Victim Protection Agency, it is evident that the Witness and Victim Protection Act only regulates witnesses in criminal offenses. It extends beyond the interests of the petitioner and the respondent. Yet, it has to be in the interest of the witnesses and the court so as to achieve truth and justice. Simply speaking, the protection of witnesses should be regulated under the Witness and Victim Protection Act.

Abstract

Health law counseling is a preventive effort to equip nursing students with a strong understanding of ethical and legal responsibilities in nursing practice. This activity was conducted through an educational and interactive approach based on health law counseling. This community applied a descriptive qualitative method involving 30 nursing students as participants selected purposively. Data were collected through observation, in-depth interviews, and written reflections. The results of the activity showed a significant increase in students' understanding of legal issues such as malpractice, informed consent, and the scope of professional authority. Students also demonstrated increased confidence in responding to legal dilemmas during clinical practice. Law counseling based on case studies and simulation proved effective in building students’ legal awareness and professionalism. The result of this community service affirms the importance of integrating health law into the nursing education curriculum and highlights the need for continuous legal education programs as part of the strategy to improve the ethical and legal competencies of future nurses.
