Abstract

This study discusses the legal awareness of the people of Bali are influenced by local wisdom in the face of pendemi covid-19. The purpose of this study is to analyze the success of handling Covid-19 in Bali in conjunction with legal awareness/ social culture of the Balinese people. There are two issues to be discussed, first how the legal regulation of countermeasures and efforts to break the chain of plague Covid-19 in Bali. Second, whether the local genius and social culture that has been there and is inherent in the fabric of Balinese life is effectively help the success of the handling of the Covid-19 in Bali ?The Research method used is normative law research Method reviewing the written law from various aspects, the approach of legislation (statute approach), the historical approach (historical approach), and a conceptual approach (conseptual approuach) and comparative approach (comparative approach) with the writing of descriptive analytical. The results of the research show that the Law is used to direct it to the goal-the desired destination, and creates patterns of behavior of new/social change in line with one of the functions of law, namely the function of the law as a means of social change, or a means to engineer society (social engineering). Tri Hita Karana (THK) as a frame of local wisdom in Bali in the life of indigenous peoples has been attached is the local wisdom that are rooted from culture and the hindu religion be a guideline and reference by the public in Bali to act/ behave this affects the legal awareness of the public to remain obedient and loyal in lawless in the community.

Abstract

The initial prediction is that the condition of covid-19 pandemic will shake people's lives in all aspects, and this condition has a great potential for rising crime. With all of its character, it is very interesting to discuss how street crime developed during the Covid-19 pandemic. This study use a mixed research method, where data is collected from facts in the field, legal sources or applied regulations, associated with legal materials obtained from literature review research and overall data obtained from both primary data and secondary data. The conclusion from this research is that street crime during the Covid-19 Pandemic cannot be stated expressly decreased or increased for each region has dynamics that differ from one another according to the characteristics of the region. The correlation of PSBB policy during the Covid-19 Pandemic with the level of street crime in the perspective of routine activity theory can be seen from several street crimes that change the type and location of their objects / targets as well as the increasing number of drug and cybercrime cases that are striking. PSBB conditions during Pandemic Covid-19 against crimes that require a new system that is integrated with the internet, a pattern of punishment with massive amounts of assimilation to reduce the density of prison and a virtual court examination system that should be a part of the criminal justice system in Indonesia

Abstract

Indonesia telah mengesahkan Undang-Undang Nomor 11 Tahun 2020 Tentang Cipta Kerja. Konsespi hukum Undang-Undang Nomor 11 Tahun 2020 pada sebagian sektor mengatur mengenai pengakuan hak atas tanah ulayat masyarakat hukum. Jenis penelitian yang digunakan adalah penelitian hukum hukum normatif. Pendekatan hukum yang digunakan dalam penelitian ini adalah pendekatan peraturan perundang-undangan dan pendekatan konsep. Hasil penelitian menunjukkan bahwa Undang-Undang Nomor 11 Tahun 2020 telah mmengatur hak ulayat masyarakat hukum adat pada bidang investasi. Namun dalam pengaturan tersebut, Undang-Undang Nomor 11 Tahun 2020 menerapkan prinsip persetujuan dalam pengelolaan dan pemanfaatan tanah ulayat masyarakat hukum adat. Hal ini sangat bertentangan degan prinsip dalam Free, Prior, and Informed Consent (FPIC) yang mengabaikan dua prinsip lainnya yakni free and prior dalam pengelolaan dan pemanfaatan tanah ulayat masyarakat hukum adat. Pengabaian prinsip FPIC terhadap pengaturan hak-hak masyarakat hukum adat telah menjadikan kedudukan hukum masyarakat hukum adat semakin lemah dalam hal pengambilan keputusan terkait pengelolaan dan pemanfaatan tanah ulayat apabila berhadapan dengan pemerintah atau perusahaan swasta. Sedangkan menurut Teori hukum kritis pengakuan hak masyarakat hukum adat dalam Undang-Undang Nomor 11 Tahun 2020 ditemukan beberapa persoalan baik persoalan pada dimensi prosedural, distributif dan kontekstual. Saran dari penelitian ini adalah UU No. 11 Tahun 2022 perlu dilakukan revisi, revisi UU No. 11 Tahun 2022 dapat direvisi melalui pengujian pasal-pasal yang berkaitan dengan tanah ulayat masyarakat hukum adat di Mahkamah Konstitusi yang mana proses pengujiannya berlandaskan padal Pasal 18 B ayat 2 UUD 1945 terkhusus yang mengatur prinsip persetujuan yang harus berlandaskan pada prinsip Free, Prior, and Informed Consent (FPIC). Selain itu pula, perlu dibuatkan Perpu yang berkaitan pengaturan tanah ulayat dibidang investasi dengan berlandaskan pada prinsip Free, Prior, and Informed Consent (FPIC). Hal ini penting untuk menjamin kepastian hukum masyarakat hukum adat atas tanah ulayat

Abstract

Fulfilling the rights of victims of criminal sexual violence is very important, starting from procedural rights, medical rights, psychological rights, and physical protection, but is often forgotten by law enforcement officials. This research will analyze the LPSK integration model at the investigation stage in fulfilling the rights of victims of criminal sexual violence. This research uses normative juridical, legislative research approaches, primary legal materials on the Witness and Victim Protection Law, the Sexual Violence Crime Law. Secondary legal materials, journals, books and other references that have relevance to this research. The analysis technique used is descriptive analytical, the interpretation used is systematic and grammatical. The results of the research state that the LPSK integration model at the investigation stage has been regulated in Article 43 of the Sexual Violence Law, within 1 x 24 (one time twenty four) hours from the granting of temporary protection, the investigator is obliged to submit a request for protection to the LPSK. However, problems arise if the investigator does not apply for protection or ignores these legal obligations. This creates a legal vacuum. Future suggestions for the government and law enforcement agencies need to align perceptions regarding the protection of victims of sexual violence and the involvement of LPSK in the criminal justice system. In this way, it is hoped that the rights of victims can be fulfilled.

Abstract

The Case Tracking Information System is a system established by the Supreme Court which functions to track a case. However, in reality, it has been found that sensitive information regarding victims of sexual violence, such as names that should be kept confidential, is disclosed. The purpose of this research is to examine and evaluate the case tracking information system regarding data on child victims and to develop an ideal model for protecting the data of victims of sexual violence within the case tracking information system. The research method used is normative juridical research with a case approach, statutory regulations, and conceptual approaches. The research findings indicate that five laws (the Witness and Victim Protection Law, the Sexual Violence Crime Law, the Personal Data Protection Law, the Juvenile Justice System Law, and the Child Protection Law) regulate the confidentiality of victims to prioritize the best interests of children as the nation's future generation. However, in reality, it has been found that some courts, such as the Baubau District Court, display information such as the victim's name, while the Pasarwajo District Court in SIPP only displays the victim's data in the form of a pseudonym, namely a child witness.
