Abstract

Permission to practice polygamy can only be granted by the Religious Court if a husband has fulfilled the alternative requirements in accordance with Article 4 paragraph 2 and fulfilled the cumulative requirements of Article 5 paragraph 1 of the Law. No. 1 of 1974. However, in the decision of the Serang Religious Court, decision no. 0602/Pdt.G/2020/PA.Srg., alternative conditions not met; Nevertheless, the judge still granted the polygamy permit. By paying attention to the formulation of the problem that has been mentioned, the aim of this research is to find out the analysis of the judge's considerations in this polygamy permit application case. In this research using normative juridical methods, it was concluded that the judge's consideration in granting permission for polygamy was based on considerations of benefit, namely to avoid adultery, obtain consent from the first wife, and fulfill procedural requirements in the form of written evidence and two witnesses. Even though the alternative conditions are not met in accordance with Article 4 paragraph 2 of Law no. 1 of 1974, but based on maslahah considerations, polygamy is considered an urgent alternative, on the other hand, husbands can be fair to their wives, both from a material and biological perspective.   Keywords: polygamy permit, judge, religious court

Abstract

Keluarga memiliki posisi sentral dalam Islam sebagai institusi pembentuk nilai moral, spiritual, dan sosial. Konsep keluarga Sakinah yang dilandasi mawaddah dan Rahmah merupakan cita ideal dalam ajaran Islam. Namun, dalam kehidupan masyarakat modern, nilai-nilai tersebut menghadapi berbagai tantangan, seperti meningkatnya angka perceraian, kekerasan dalam rumah tangga, pergeseran peran gender, dan pengaruh globalisasi yang sering kali mengaburkan nilai-nilai keislaman. Penelitian ini bertujuan untuk mengkaji konsep keluarga sakinah dari perspektif sosiologi hukum Islam serta menilai penerapannya dalam masyarakat Muslim kontemporer. Metode penelitian yang digunakan adalah deskriptif-kualitatif dengan pendekatan studi pustaka. Data diperoleh dari literatur primer seperti Al-Qur’an, hadis, kitab fikih klasik dan kontemporer, serta regulasi hukum keluarga di Indonesia. Analisis dilakukan melalui pendekatan sosiologi hukum, membandingkan antara norma ideal (das sollen) dan kenyataan sosial (das sein). Hasil penelitian menunjukkan bahwa meskipun nilai-nilai keluarga sakinah telah diatur secara komprehensif dalam hukum Islam, realitas sosial menampakkan adanya kesenjangan implementasi. Ketidakseimbangan peran, lemahnya pemahaman agama, dan kurangnya dukungan institusional menjadi faktor penghambat. Oleh karena itu, dibutuhkan reformulasi hukum keluarga Islam yang kontekstual serta penguatan nilai keagamaan dan komunikasi dalam keluarga sebagai solusi untuk membangun keluarga sakinah yang berkelanjutan. Kata kunci: Keluarga sakinah, hukum Islam, sosiologi hukum.

Abstract

Marriage in Islam regulates the rights and obligations of husband and wife, which are important for the creation of harmony in the household. However, the implementation of these rights and obligations is often influenced by various social, cultural and economic factors, which can have both positive and negative impacts on the husband-wife relationship. This study aims to analyze the rights and obligations of husband and wife from the perspective of the Qur'an and hadith, and identify the social factors that influence their implementation in society. The main research questions are how religious teachings on the rights and obligations of husband and wife are translated into social practices, and what social impacts arise from their application in daily life. This study uses the Library Research method with a qualitative approach, analyzing the texts of the Qur'an, hadith, tafsir, as well as related literature, by connecting the theories of sociology of religion and social justice. The findings of this study indicate that a balanced and fair application of rights and obligations can strengthen the husband-wife relationship and create family harmony. However, an imbalance in the fulfillment of rights and obligations can lead to conflict, inequality and even domestic violence, affecting the overall quality of family life. Thus, this study emphasizes the importance of understanding the social and cultural context in the application of religious teachings to achieve a harmonious and just household.

Abstract

Polygamy remains one of the most debated and controversial practices in Islamic family law, raising significant questions about justice, gender equality, and family welfare in contemporary Muslim societies. This study seeks to answer the central research question: How is polygamy understood and practiced today in light of Islamic legal principles and what are its social and psychological impacts? To address this question, a systematic review and meta-analysis were conducted using the PRISMA framework, analyzing 45 peer-reviewed studies sourced from Scopus, ScienceDirect, PubMed, and other reputable academic databases. The review focused on the legal interpretations of polygamy, its regulation in various Muslim-majority countries (such as Indonesia, Morocco, and Egypt), and its social and psychological consequences for women and children. The findings reveal that while polygamy is religiously permitted as a legal dispensation (rukhshah), it is heavily conditioned on the requirement of justice (as emphasized in Quran 4:3), which is extremely difficult to achieve in practice. Quantitative evidence shows that women in polygamous marriages report significantly lower marital satisfaction and higher levels of depression and anxiety, while children face greater emotional and behavioral challenges compared to those in monogamous families. Moreover, global trends indicate a decline in the acceptance and practice of polygamy, with many legal systems introducing stricter regulations or discouraging it altogether. Despite these insights, research gaps remain, particularly in understanding the long-term effects on children and the perspectives of men in polygamous marriages. Overall, the study underscores that polygamy, as currently practiced, often contradicts the higher objectives (maqasid) of Islamic law aimed at ensuring justice, compassion, and family well-being, suggesting that monogamy better aligns with contemporary ethical and social realities

Abstract

This study examines the phenomenon of early marriage in Pandeglang District, a region with one of the highest rates of child marriage in Banten Province, Indonesia. Rooted in socio-cultural traditions, economic hardship, and low levels of education, early marriage persists despite the revision of Indonesia's Marriage Law through Law No. 16 of 2019, which sets the minimum marriage age at 19 for both genders. Positioned at the intersection of Islamic legal norms and national law, this research explores how early marriage is legitimized or challenged through both religious and state frameworks. Using a qualitative socio-legal approach, data were collected through in-depth interviews with religious leaders, judges, families, and underage spouses, alongside analysis of legal documents and classical Islamic jurisprudence. The findings reveal a gap between legal norms and community practices, where dispensations granted by religious courts often undermine protective legislation. Moreover, interpretations of Islamic law that emphasize baligh (puberty) over psychological readiness contribute to the persistence of early marriage. This study highlights the urgency of contextualizing Islamic legal principles—particularly the maqāṣid al-sharī‘ah—to align with child protection standards in national law, emphasizing that legal harmonization must be supported by educational and cultural transformation at the grassroots level.   Keywords: Child Marriage, Islamic Law, Positive Law,   Abstrak Penelitian ini mengkaji fenomena pernikahan dini di Kabupaten Pandeglang, sebuah wilayah dengan tingkat pernikahan anak tertinggi di Provinsi Banten, Indonesia. Praktik ini berlangsung karena tradisi sosial-budaya, tekanan ekonomi, dan rendahnya tingkat pendidikan, meskipun Undang-Undang Perkawinan telah direvisi melalui UU No. 16 Tahun 2019 yang menetapkan batas usia minimal perkawinan 19 tahun bagi laki-laki dan perempuan. Penelitian ini berada pada titik temu antara norma hukum Islam dan hukum positif, dengan tujuan memahami bagaimana praktik pernikahan dini dilegitimasi atau ditentang oleh kedua kerangka hukum tersebut. Dengan pendekatan yuridis-sosiologis kualitatif, data dikumpulkan melalui wawancara mendalam dengan tokoh agama, hakim, keluarga, dan pasangan usia dini, serta analisis dokumen hukum dan literatur fiqh klasik. Hasil penelitian menunjukkan adanya kesenjangan antara norma hukum dan praktik masyarakat, di mana dispensasi yang diberikan oleh Pengadilan Agama sering kali melemahkan perlindungan hukum. Selain itu, penafsiran hukum Islam yang menitikberatkan pada baligh dibanding kesiapan psikologis turut memperkuat praktik ini. Penelitian ini menegaskan urgensi kontekstualisasi prinsip hukum Islam khususnya maqāṣid al-sharī‘ah, agar selaras dengan standar perlindungan anak dalam hukum nasional, serta perlunya harmonisasi hukum didukung oleh pendidikan dan transformasi budaya di tingkat akar rumput.   Kata Kunci: Pernikahan Anak, Hukum Islam, Hukum Positif
